Re: We don't know what to do

You can certainly speak to an attorney to see if you have a case or not. Basically, the mother has a right to complete her case plan to achieve reunification. If she is successful, then she will get the kids. I don't see how you would have any standing to bring a suit against the Mom, but I'm not an...

Re: Does the court order an evaluation at the end of the pla

I can't speak for all cases or all states, but I was subjected only to a single psych eval near the beginning of my case. It found no diagnosable conditions. I did not use the state-recommended psychologist, but one I sought out myself. I would recommend everyone else do the same if you can afford i...

Re: What happens if you disobey court orders?

This is an interesting question. I'm sure you realize that TPRs require clear and convincing evidence, whereas it only take a preponderance for the state to assume temporary legal custody. You should have been given a case plan. This plan was formulated by the state, negotiated with you and approved...

Re: daughter not allowed to go to school for over a month

If the state has custody of your daughter, you should at least have a court-appointed attorney representing you -- one who is on the public payroll. He/she might not have much time for your case in particular, but it's better than nothing.

I would have your attorney take this issue up with the judge. Now that the state has assume custody of your daughter, it is responsible for all of her needs, including education.

I'm very sorry all this is happening to you, but sadly I'm not surprised by any of it. It's good you have "good" attorneys working for you and that you have found the courage to go public with your situation. I hope and pray that you get your children back under your care ASAP.

Re: Need serious advice, how can they do this??

What does it mean that the judge ordered the termination on two of your kids? That would imply that it has already happened. Maybe what the judge did was to approve the state's goal of adoption or permanent state custody for the two that were not returned to you. The prosecutor wants you to voluntar...

Just because the child is staying with her grandma doesn't mean the state has legal custody. It could be a "voluntary" placement.

Re: Hospital visit turns into CPS/Police investigation

I expect the petition is for CPS to be given temporary legal custody over the child. It won't be to file criminal charges. Only the DA prosecutor can do that.

Re: Motion to remove children false allegations of neglect

You should proactively collect evidence while you can that the children are not neglected. Take pictures of the house, with a time stamp, showing that it is safe for the children. Get a statement from their pediatrician that they are not neglected. Get a drug test on the father to show he is not hig...

Re: What happens if you disobey court orders?

The adjudication is to determine whether the state is justified to assume temporary legal custody of her. The next trial is to determine whether to terminate your parental rights, clearing the way for adoption. You have about a year to successfully complete your case plan. If you do that and can doc...

Re: What happens if you disobey court orders?

That's not the way it's "supposed" to happen. For example, in my case, the foster parents knew that they were only giving temporary support to our family. They already had four kids of their own, and didn't want any more. They didn't let my kids call them "Mom" or "Dad."...

Re: What happens if you disobey court orders?

I think you're giving up way too easily. By ordering you to take a psych eval, they're actually giving you a chance to reunify with your daughter. Psych evals are pretty painless, and relatively easy to "pass," with you looking perfectly "normal." Also, you're still a long way fr...

Re: I stood up for myself and lost-still keep hope

What an abusive relationship you have been suffering under! I would seriously think about writing down all the things he has done to you and get an attorney to file for a protection order for you. If your case comes to the attention of CPS, this will hopefully make you look like the responsible, pro...

Re: Kids taken from me because of hearsay in Montana

It's true that without a court order, a CPS worker cannot order you to do anything. Caseworkers do sometimes ask a party they're investigating to voluntarily comply with a Safety Plan to ensure the child is safe while the investigation is ongoing. By allowing your daughter to temporarily stay with y...

Re: When your case closes can you decide where you live?

I would say the answer is 'yes,' but with the caution that if it ever comes to the attention to CPS that your current living conditions are similar to those that led to their previous intervention, they will act with a vengence against your family.

Re: So what happens if an unfit parent has more kids?

A previous involuntary TPR can serve as grounds for a state to ask a court to terminate parental rights of the new child. The state still has to prove its case to the judge that it is in the best interests of the child to be put up for adoption. There are several new mothers on this board who have h...

Absolutely correct. There's no way you can follow a plan you're not allowed to see. Also, to be a valid plan, it has to be approved by the judge, so the court should have a record of it.

No, there's no such law. However, you will have to form a credible plan for how you're going to keep your other children and yourself safe. No knives in the house? Maybe take a class in how to safely restrain an out-of-control child. Medication and a written statement from a psychiatrist saying it's...

Sorry if you may have already answered this. I'm just catching up on your case. The 11-yr old is also your child, correct? It sounds like she's really dangerous. It surprises me that the state would put her in a foster home, or that any foster family would accept her. I hate to say it, but she proba...

Re: I finished

I'm not sure what stage your case is in, but if your child is in foster care, the standard amount of time it takes to get him out is one year. It doesn't matter (at least it didn't in my case) that you've finished everything on your case plan in one month. CPS will want to see a durable change in yo...

Re: CPS cases are about more than just the fate of the child

My troubles with CPS came a few weeks after a letter was published in my name in the local newspaper, strongly criticizing US involvement in the Iraq war. I can't prove there's any connection between the two, but it is a little suspicious. As far as enforcing societal norms is concerned, when I was ...

I am so glad this is turning out better than I had feared. I cringed when I saw your Amber alert, and was really afraid for the trumped up charges you faced. I also hope you can keep this fight up until you get your son back, and NM CPS has total egg on their face.
