Re: In Need of Services?

I've been told that there is no appeals process, but I don't know if that means no administrative hearings. I briefly spoke with my new caseworker today. There was no mention of their standard services (parenting classes and counseling), thank God. The case plan will revolve around me continuing to ...

In Need of Services?

This is my 5th (stupid) investigation, and I just found out that this time I have been found "in need of services." Right now I don't know what they'll try to force me into, but I know it could only further harm instead of help. I do know that this case was apparently an assessment instead...

Re: unhappy happy ending

Aaaawww, that is sad that your post is the last. This forum does seem to have less traffic than it used to, although maybe I'm wrong about that. I'll try to remember to post a happy ending post when my case closes. I still have my kids, at least. But in my case, it still won't be a totally happy end...

Re: CPS Investigation in South Cali PLEASE HELP Hearing on T

Unfortunately, I don't think I have the answers to your questions. I am interested in an update, though. Maybe someone will see it and have answers this time, assuming the kids are still in state "care."

Repeated cases related to ignorance of son's disability

Le sigh. As of this past Thursday, I'm currently in my fifth CPS investigation. Some of you will remember me from before. This report is more of the same old, same old, with a few new things thrown in for good measure. The main allegation seems, once again, to be that my severely autistic son is agg...

Re: Should parents let CPS in willingly or not?

I didn't let them in during my last investigation this summer. HSLDA wrote them a letter on my behalf stating that they had no grounds to force entry. They never came back after that. I let them in during my previous investigation and I regretted it bitterly. My experiences won't be exactly the same...

Re: Should parents let CPS in willingly or not?

I respect that opinion. Personally, I don't trust the system enough. If you let them in, it gives them the ability to twist anything they see and use it as justification to stay in your life. The smallest imperfection can be used against a family if the worker wants to. I personally believe that cit...

Rural vs city, poor counties versus richer counties

I was wondering if anyone knows if the rates of removal are higher in cities and/or richer areas versus more rural and/or poorer areas? Do the cities/richer areas have more funding for foster care that may make them more likely to remove kids "just in case"? I might buy a home later this y...

Re: Here we go again...

It's around the 60 day mark of the investigation, and I just got a letter that seems to imply that the case is now closed! Woohoo! I lost my letter from the last case from a few years ago, but I think the wording was basically the same. It didn't use any terms like substantiated/unsubstantiated, fou...

Re: Here we go again...

Last week I decided to compromise and send pictures of our food supply and the kids' beds, since the CPS worker repeatedly only mentioned those things as what CPS needed to see in the home (on all 3 of the occasions she mentioned it, those things were all she mentioned). I emailed them to her and sh...

What is meant by staffing a case?

I emailed the CPS worker pictures of our food supply and the kids' rooms. She repeatedly said that's why she needed to come in (those are the only reasons she listed), so I decided to compromise by sending pictures. Hopefully that'll satisfy their requirement without further violations of my family'...

Re: Should parents let CPS in willingly or not?

I'm bothered by the fact that willingly letting them in waives a family's rights. It's so unfair. :( I just wish the system would hold CPS accountable to keep them honest.

Should parents let CPS in willingly or not?

I would like to see the opinions of everyone willing to post. Who recommends letting CPS in willingly? Who recommends making them force their way in? The latter seems to be the only way to preserve your standing to sue, right? I'm wondering how many recommend that parents submit to CPS and who recom...

What kind of attorney is needed to sue CPS?

I'm sorry if this has been covered before and I just didn't find it.

I know that my family law attorney can't help me sue, but I really want to pursue a lawsuit based on constitutional violations if I can. What kind of attorney should I search for? Constitutional law? Civil law? Litigation?

Re: Here we go again...

Part of me has considered that, but ideologically I don't think I can do that. I really don't want to lose my 4th amendment rights by voluntarily waiving them, first of all. Second, yes...because of what happened last time that "wasn't pretty", I know that once they come in they can latch ...

Re: Here we go again...

I just got an email from my Prepaid Legal attorney. She's currently still playing phone tag with the CPS worker. The attorney is now considering whether I need to retain her and what services she could provide if we go that route. I'm so pissed that it's even gotten to this point. The investigation ...

Re: Here we go again...

CPS came back today. It was the first time I've seen them in about 2.5 weeks. And of course today is my birthday so CPS showing up has practically ruined it. :( Now my daughter and I are so shaken that we need time to calm down before going about our plans together. Seriously...why today?! I'm reall...

Re: Here we go again...

Still haven't heard from CPS yet...hmmmm. I had an IEP meeting for my son today over the phone (since I don't have a car). Last week, I'd been told that they wanted to provide instruction through SKYPE. That's ridiculous but I knew I couldn't change their mind without an attorney and I haven't been ...

Re: Here we go again...

Well the last time I've heard from CPS was last Wednesday. I expect to have another surprise visit sometime tomorrow (Wednesday). If she doesn't come tomorrow, I'm sure she will by Friday. I wish this case would be over so we can try to get on with our lives. I'll need to get back in touch with my l...

Re: Here we go again...

I don't have a good relationship with the current pediatrician, and I'm hoping to switch soon. However I'd have to ask Medicaid for another instead of finding one purely on my own. In the meantime, I do have Jared's psychiatrist who says she's never had any concerns about my care. There are currentl...

Re: Here we go again...

I'm fighting the school system in addition to CPS. I don't believe they're providing enough services for my son. They have taken advantage of the fact that I work from home to put all of the responsibility of his education on me. Right now he's not going to school at all because they can't handle hi...

Re: Here we go again...

Well I just moved in December to a location 5 minutes from my old place. Same town. I'm locked into a lease. I've had 2 CPS investigations in this town and 2 in my previous (large) city. I'm afraid that it would be even worse if I move to a larger, better-funded county after having several additiona...

Re: Here we go again...

Monkette, I agree. What makes it worse is that this is my 4th investigation. My son is so severe and people keep confusing his autism symptoms and thinking *I* must be at fault. I'm afraid that if it happens again, they'll call it a "pattern" and remove on the first day of the next investi...

Re: Here we go again...

I do believe that some CPS workers may see it that way. However, I highly doubt it would hold up to a constitutional/due process review if taken OUTSIDE the family courts. In general a parent is supposed to be presumed fit to take care of their children and to be presumed to be acting in their best ...
