Re: Why did people stop using this forum? 2019

Because it got overwhelming for the moderator. I think there was an explanation on the home page a while back.
The forum is much harder to find, last I checked. I don't think there is a link on the main pages.

Re: Probable Cause

I am not an attorney; but I think the same judge would have to be shown evidence or cause to review the hearing. I wasn't present for one, so it was re-done as a matter of procedure, but that was just for show because the train was already speeding down the track. Also, I got a one day continuance a...

Re: Firefighter who helped save lives needs help now!

I have wondered how my cases will haunt me. I find out tomorrow, if it will bar me from a job. It requires a deep background check. There was no place on the 43 page application to disclose it. Given that they wanted me to list every parking ticket and traffic violation, I am worried. I know there i...

Re: Direction Needed ASAP... Please

Yes, they are very secretive about Juvenile cases. You have to physically go to the clerk office and show ID, but I assure you, there is almost no way they can withhold the file from you. Only once was it kept from me, because I wasn't yet a party to the case, having made a special appearance and ch...

Re: Direction Needed ASAP... Please

You can go to the court anytime they're open and inquire about the case. The clerk can show the file, docket, and calendar.
You are not helpless. You are a party to the case and you get due process.

Re: kidnapped and held hostage!!

1. You have to follow the law/ rules, they don't ; because 2. The people in the system are either: bad people, become bad people, or quit. 3. They need children in the system for the system to be relevant; thus, they have jobs, and 4. The more kids are in the system, the more money they get and the ...

Re: Need immediate help in buffalo ny

It is almost always hard to get a child back. There is no easy path. You are dealing with government and generally bad people.
Because you are taking action, you have some leverage. You might be able to get your attorney to negotiate a simple plan or go right to a family maintenance plan.

If they can claim it was a sudden or emergency doctor visit, there's no intent to evade the order.

Re: can we sue the hospital and Cps?

Chances are, they are already afraid of a civil suit. You need a civil tort lawyer and they probably want you to keep quiet about suing until you see where things go. But, yes, when there is a violation of law or rights, there is often a viable suit. CPS won't have to pay, because they are personall...

Re: What happens if a foster parent violated a court order?

Unless there is evidence of intent to defy the court, I suspect nothing will happen. While it does seem like a contempt, my experience suggests that foster parents are virtually immune. Without going into stories, I'll just say the foster parents of my children were less qualified and provided worse...

Re: Can CPS tell my ex to violate visitation order

IF CPS is involved, you are a party to the case and would have been served. CPS is not the law although they act like it. The current court order is the law unless the kids are in protective custody. Again, you should have been handed documents and been in court by now if that was the case. Ask your...

Re: CPS approval of people you live with

When my ex got guardianship of a nephew, I had one short interview with a social worker. The boy was taken because the mother tested positive for pot. Frankly, she also did plenty of meth, weed, and alcohol during the pregnancy. That child had significant issues. Anyway, I don't recall a background ...

Re: Do step parents who adopt have priority over other relatives

While your importance and attachment between you and child is clear, it isn't a slam dunk. The process is strict and methodical. I've been on both sides. I fought TPR and fought presumed parentage when the bio-father was begging for his rights. You didn't address a vital question: Is there a father'...

Re: ONE MORE THING

This post has inspired a lot of thought. And, LindaJM makes great points. If we did what we could, at the time, with what we knew, we did enough. At some point, you are a victim, not a failure. This does happen in big cities, and the smaller. We have to keep living; more than surviving. I shut down ...

Re: My daughter is sitting beside me - UPDATE: Big mistake :(

It was in counseling that I came to that conclusion. "You tried your best and nobody can take that from you." There came a point when I had done everything I could; literally.(short of violence) I found peace in that. I had truly done everything I could and made the best choices I could, w...

Re: Loving Grandparent attacked for trying to get CPS to understand Truth

I am not an attorney, this is not legal advice. My opinion : Go silent, disappear, and work on a secret plan to help if he gets them back. He should be ready to move to another county or state the day his case is closed. Consider the following: 1. The judge decides, not CPS. Procedure is just as imp...

Re: Termination of My Parental Rights

My story is similar, having gotten the 2 older kids back and losing the younger 2. The external forces that motivate keeping the younger 2 is obvious. It shouldn't surprise anybody that my little babies were both adopted by a wealthy single white woman with government connections. They are being rai...

I once confronted a social worker with statistics and she didn't deny or refute them. She had asked me why we were so resistant to their "help". (I hid the kids for 2 weeks and we hid our new baby for 2 months) I explained that foster care is more dangerous than home. Furthermore, my ex an...

Re: Do step parents who adopt have priority over other relatives

Great. I was given legal advice in CA, that the other parent's rights had to be terminated first. And, that was almost impossible without marriage or CPS. We know CPS can do it but marriage gives the new partner the right to seek termination for the purpose of adoption. I was also told that it is a ...

Sorry for the late response. I hope your family is doing better. I hope it isn't too late but yes, take them seriously. They can and will show up and use violence to take your children. You are smart to be wary of their questions and the "help" they will offer. It sounds like you have a to...

Re: Do step parents who adopt have priority over other relatives

I think I follow, and that kinda describes me both during my case and after. There is a list of factors and a hierarchy of importance. It may vary by state but biologic relation isn't as important as it once was. The adoption, however, should be a strong factor and give you the same parental rights ...

Re: NEED ADVICE ON VERY BIAS GUARDIAN AD LITEM

It is still a little unclear but: if there is no DCFS-CPS whatever...case open, then this is a custody case in the version of family court at your county. If the GAL isn't going to communicate, then stop wasting your time. That is what court is for. Convince a judge. Or, force the GAl to talk by way...
