Re: Should parents let CPS in willingly or not?

You can assert your rights again in the middle of an "inspection" ... revoking permission and booting them out. Yes, it's been court affirmed but I don't have a link for it.

Re: no warrant

They can take a child(ren) without a warrant when the children are in imminent risk of harm. Meaning... there is no possible way to leave them unattended for the amount of time that it would take to secure a warrant (let's ballpark 2-3 hours, depending on where you live). This requirement is routine...

Re: CPS nightmare ((Please Help))

Every mother and every pregnancy is different. Unassisted home births are hugely risky. You should use a midwife and/or birthing center if you don't want a hospital birth. Personally, I believe hospital births are WAY overdone, mother are over medicated and/therefore cesarean rates are through the r...

Re: Parental Rights

Where are the kids? If there was no abuse or neglect, going by your state laws, then you should prepare a document to submit to court that supports that.

Just to clarify, the "petition" can only be filed by CPS... do you mean she made allegations?

First rule of the law... NEVER talk to police unless you are trying to press charges toward someone else.

Everyone is entitled to their opinion. :)

What a shame that your experience with police is so negative.

What state & county are you in?

On the address, unless it's a mistake that will materially impact the case, then it's not important. Now, if they had the wrong child/family... that'd be another story.

Re: Upcoming CPS "Interview"

In terms of confidentiality, they mainly want to protect the children of real abuse/neglect from exposure/gossip, plus, they don't want parents manipulating real victims into being afraid to tell the truth. Otherwise, I know of no laws dictating what parents can/can not do/say/talk about. Free speec...

I heard about the glitch too. If I were you, I would find the news articles about the glitch and contact the author of the articles. Tell them your story and maybe he/she will want to do a follow up/human interest story on how the glitch has fouled up your lives.

If you haven't had the interview yet, I will just add... Yes, they are federally required to give you the allegations. Here's the DHHS affirmation of that: http://www.acf.hhs.gov/cwpm/programs/cb/laws_policies/laws/cwpm/policy_dsp.jsp?citID=353 Second, take a neutral position... don't say "he w...

Re: I also have an "ignorant" question but... RE: Adoption

I remember going to the health center at college one time, sitting in the waiting room. There were two large binders filled with "letters" from families wanting to adopt. Hear-tugging letters with pictures of couples, sometimes with a child and wanting to add siblings. Clearly they were ta...

Re: Parental alienation syndrome

Yes, you absolutely have rights to your child's medical records. Find the law in your state that says that, then call each successive person from your caseworker up (supervisor, manager, director, state ombudsman, state agency which oversees CPS, etc.) and get each person on record refusing to follo...

Re: Help in Kentucky Plz

Yeah... Kentucky sucks. There are virtually no attorneys in KY to help parents. The few you can find treat you the same as the court-appointed attorneys... "sit down, shut up, do what CPS says." I know that is no help. There is a very recent filing, and he's pro se (no atty) so you can may...

Re: Can an Adopted child "terminate adopted parental rights"

BTW, in TPR cases, it is the *PARENTS* rights which are terminated (even though you had arrangements otherwise)... *NOT* the child's rights. The CHILD still has rights and should be able to reach out to you... it just doesn't work the other way around.

You can ask for a Marsden hearing to either replace your attorney or get him/her to do his/her job!

This would be a good question to ask a KY attorney. You could even call the district attorney and ask... but confirm what they say.

Purely heartbreaking. :( I'm so sorry. Imagine how different your life would have been had someone been a little more understanding, asked a few more questions, looked for the root of the problem. So wrong. :( If you don't mind, I'm going to put this in the "former foster children" section.

Re: Unfair "founded" ruling, likely lose kids, please help!

Don't write off the police... they don't have a financial incentive to lie and fabricate evidence. In our case, having a police investigation and officer affirm that there was NO abuse/neglect was a huge help. They both follow the same laws so to have the police say you're innocent puts them in a po...
