Re: Case Supposed to close but ex has kids please help

IF the only court documents state you have custody, you can attempt this option. Ask the local police to meet you to "preserve the peace." Explain to them what you have stated here, and show them the court documents stating you have custody. If the other 1/2 cannot produce a court document...

Re: dcs letter

Of course they can. For example they could rule the case unfounded and close it. Or based on the nature of the complaint, they could contact the DA and file for court ordered services stating you are uncooperative.

Re: Case Supposed to close but ex has kids please help

You will need to get then back with whatever legal documents you have, possibly your divorce. If CPS believes they are at further risk, and somebody calls them, they will reopen the case. However, it sounds like they haven't even closed it so that makes it easier for them to get involved. If you hav...

Re: I'm a mom, not a monster. I need advice and guidance.

The investigation sounds rather normal. Most likely the DR's office reported the possible abuse. Most dr's are not experts on abusive injuries and it would be normal for an expert to conduct a work up on the child. I have seen time and time again children with abusive injuries that a regular pediatr...

Re: When tofile Statement of Objection & Correction

If the child is now in foster care medical will come in the form of medicaid or whatever they call it in your locality. Depending on our courts, there are time tables for documents to be filed. I am not an attorney, but this would make sense to me: you might check with the court clerk and asked the ...

Re: CPS INSANITY #980980975898433..........

Sounds like a lot going on. Just some general comments based on the post to alleviate or address some of your concerns. CPS can run a TRO/PPO check in NCIC so there is no issue with an official faxed copy with all the details of what they already know from the online inquiry. A young child alone in ...

My kids were taken back in August due to "neglect". We didn't have enough money to support them and two days after they were taken they were supposed to have been on a plane to family until we could get back on our feet. I was having issues with PTSD and the house was a bit of a mess, but...

Based on your post it seems there is no sense of urgency with CPS. That they have been to your house several times with no response.

Try one of the 1-800 numbers for attorneys. IF there is a case to be made with $ for the attorney they will take the case. If there is no case they won't take it.

Re: CPS says 3-6 months before mom can come home

Is this a court ordered case or a voluntary plan? That makes a big difference. If no court order nothing legally obligates your from following the plan. However if you do violate the plan, CPS may then file for court orders. From your post the complaint was about drug allegations and apparently they...

Re: CPS INTEROGATTING ME WHILE IM ON OPERATION DRUGS FROM CS

Unless I'm missing it as the big letters are hard to read on my old eyes, I don't see the reason for the removal. I only get that you had a c-section, were interviewed by child services and your child placed into foster care. Why were they there investigating you? I know the most common for a birth ...

A "subdural hematoma" found on an infant that stopped breathing is certainly more then a bump on her head. The dr's are not going to inform you of SBS because it is not their place to do this. They will call in a CPS referral. This will then become a joint police/cps investigation. The hos...

Re: Should IWe Fight a CPS Finding of "Reason to Believe" (R

I read your lengthy hypothetical report. BTW probably the best I've read on here and easy to follow. The entire process sounds very normal and you dealt with professionals. RTB is reason to believe. This means there is a preponderance of evidence to suggest the person did in fact commit a defined ty...

Re: TRICKED BY POLICE AND CPS.REPORT IS ALL LIES

I don't know about the lie part with limited info, but it would be normal for the police to do a welfare check of the child, and if they felt the child at risk they are mandatory reporters that must notify CPS. They may have told you they were calling cps to bring the child home, but once CPS is inv...

Re: How to find Expert Witness AMBP Specialty ABUSE

You need somebody to review the case and see what is factual and what isn't and go from there. Your attorney should be able to find an expert witness. I know there are not a lot that take the defense side in child abuse. You just need one to go by the facts, whatever they may be.

You will get a letter once they submit their report and it is approved. There could be a delay in that due to their high case volume, ect.

I think once you are caught up in the courts they follow the same game plan, services, studies, a set amount of time ect. Most of the attorneys I have seen don't do a whole lot expect collect their pay check.

Re: Need to know if I really have a case against cps.

A police officer can enter the home to check the welfare of the child. CPS is not supposed to enter in this manner unless invited in by the home owner. Based on what I read this sounds like it was out of control by all parties. I would assume that the police were wearing video so they should have a ...

If they find sufficient evidence to convince the prosecuting attorney that he/she can get a conviction in a criminal court, they will...

while there is foster money, ect. the case worker doesn't make any more or less when doing an investigation. Placing children should be a LAST RESORT and only when absolutely necessary for their safety.
