IF the only court documents state you have custody, you can attempt this option. Ask the local police to meet you to "preserve the peace." Explain to them what you have stated here, and show them the court documents stating you have custody. If the other 1/2 cannot produce a court document...

Of course they can. For example they could rule the case unfounded and close it. Or based on the nature of the complaint, they could contact the DA and file for court ordered services stating you are uncooperative.

You will need to get then back with whatever legal documents you have, possibly your divorce. If CPS believes they are at further risk, and somebody calls them, they will reopen the case. The investigation sounds rather normal. Most likely the DR's office reported the possible abuse. Most dr's are not experts on abusive injuries and it would be normal for an expert to conduct a work up on the child. Try one of the 1-800 numbers for attorneys. IF there is a case to be made with $ for the attorney they will take the case. If there is no case they won't take it.

Is this a court ordered case or a voluntary plan? That makes a big difference. If no court order nothing legally obligates your from following the plan. You need somebody to review the case and see what is factual and what isn't and go from there. Your attorney should be able to find an expert witness. I know there are not a lot that take the defense side in child abuse. You just need one to go by the facts, whatever they may be.

You will get a letter once they submit their report and it is approved. There could be a delay in that due to their high case volume, ect.

I think once you are caught up in the courts they follow the same game plan, services, studies, a set amount of time ect. Most of the attorneys I have seen don't do a whole lot expect collect their pay check.

A police officer can enter the home to check the welfare of the child. CPS is not supposed to enter in this manner unless invited in by the home owner. while there is foster money, ect. the case worker doesn't make any more or less when doing an investigation. Placing children should be a LAST RESORT and only when absolutely necessary for their safety.
