Couple wrongfully accused of child death settles for $31M
I know it's been a long time since I've posted. Everything is still here as far as I know so you can look at where we came from and where we are now. I hope many are encouraged by this and consider this a personal victory for all of us that have been in the ring with CPS. http://indianalawblog.com/a...

Be encouraged
Been a while. Without discussing details you can imagine that legal actions are still pending. i learned early that the only good detective work I can attribute to my state is finding my posts on this site and misrepresenting them and creating discord in out family. So when I ignored advice to be ca...

I predict that CPS will ignor the brittle "bone issue." During our case there was a BB case inwhich the father went to prison for 4 years. The same doctor that CPS used against us they used against him. Started with an accusation of 18 fracture but there was accually only one. And of course the baby...

Thanks The exact words at the end of the decision were: "In this case, remand (to send back to the agency) is not appropriate given the overwhelming medical evidence that Jessica died from prescription errors combined with her underlying medical conditions, the lack of any evidence to support DCS’ c...

Hello As usual I have to start by saying its been a while etc., but we have had a recent victory through the court I hope is encouraging to others. Our judicial review was ruled on in our favor. Well the state has responded to our judicial review. They assert that it is our fault that we did not warn the doctor and pharmasist of mistakes. They say that we should have recognized the FDA black box warning about coumadin even though it hadn't been issued until 10 months after Jesica's death. A...

Trish I'd love to roast them all. No offence against Mitch but when an appointee of yours goes on TV to support his departments illegal and unethical practices you, as Governor, have to know about it. He must know. And if he does in fact know then he doesn't care. Not about us or anyone else. So tha...

We were fortunate to get a lawyer who became interested in our case and faught it pro bono, even traveling 3000 at a time to our state and livingt at our home a total of 4 months during that year. Our other lawyer is local and was appointed originally but is still representing us pro bono for severa...

We're just getting set back up. As I promised we will be sharing the brief in our caseso that readers can see what the issues in our case are. I hope that it inspires others to stand up for their rights and realize that we can win against CPS. We just found out about another case in our state. The 2...

We're moving tomorrow but when we get set up I'll try to post the text. I'll probably delete names just because at this point it's still the right thing to do. However, it's not a matter of public record and will be available on a government site. (Not sure what that is either. Thanks for all the (y...

Today we filed a civil action against key players in our case with the federal District court. We're told that it could be bound in litigation for up to 5 years. The only present consulation is that most likely they may experience a fraction of what we did do to their incompetence. I'd like to be a ...

Our first judge was a former CPS lawyer in that county. I believe he still sit on some department comittees but not sure.
On appeal our case was before an administrative law judge (ALJ). Her motion was written on department letterhead.

Update
Ok this is a good time for an update since we got home from court today. After the criminal and Child in Need of Services (CHINS) cases were dismissed we thought things were over for the most part. The original post on this thread shows the coroner and other expert opinions. Still DCS has a registry...
