Re: Kept them at bay **UPDATE #4...The police**
Look ,you call you self a Homeschoolmom. I have great respect for homeschooling but there is a law for this and you should be registered as a home schooler. You should have done this from the get go. You can't just call yourself a home schooler. I venture to say that the Home School Legal Team turne...

Re: The Burden of Proof
In my humble, personal, lay opinion as I am not an attorney, I would say that, yes, court often involves, unfortunately, lies. I am not sure exactly how to explain court except that it is a game, not a friendly game. I wouldn't recommend going to court expecting truth and justice, not that that can'...

The Burden of Proof
All of you who are victims of CPS investigations must be frustrated because, as Americans, we are taught that the burden of proof rests upon the accusers. In family/dependency court, you quickly learn that the burden of proof somehow has been shifted to rest upon the accused. If you all would look t...

Re: Gdaughter taken and threatening to take unborn too
Eljay is right in that, you can petition to have an attorney --a private atty -represent the child but it may be shot down as I am sure the court has already assigned a GAL to do same. But it would, of course, be something to speak with your atty about.

Think Small
I know that many of you fighting CPS are frustrated, fatigued, and perhaps at your wits end and I know that some of you want to sue, and want to bring the whole Constitution down against your accusers. But, think small. Think small. Many of you if not all of you are not in the United States Supreme ...

noroses, the same holds true in the UK. That is, if a parent had ever been in 'care' most likely all of her children will be taken away at birth. The UK and Canada and Australia and the US all seem to follow the same policy.

I wanted to say more. I received your PM. I know that you have experienced a lot during your life and have made some bad choices, but apparently, now, you are looking to the best interest of your child. That is to be commended. This is your choice. I agree that the odds of getting your child back ar...

I am not savvy as to AZ courts. That being said, my experience in case law involving other state courts concerning 'shaken baby syndrome' is that most local courts depend upon local medical authorities. Can this Stanford guy direct you to medical experts in AZ? Can your attorney research other more ...

Re: Gdaughter taken and threatening to take unborn too
I received your email and have sent you an email back. As Eljay has stated it is not for the faint of heart whether going pro se or with an attorney. This stuff is real and, in some cases, everlasting. I hope that I might be able to afford your new privately retained attorney some good contacts on t...

If you are happy with the foster family having custody then it should be very simple to faciliate same.
Or, perhaps, there might be another relative beside your father, whom you might want to approach to take your son.
Yours is a very sad story and I am sorry for all the pain.

Re: Is a SLAP considered child abuse?
In NY, by statute, a slap (flat handed) in of itself is not abuse provided said slap has not done irreparable harm to the child. Now, that is up to interpretation. Basically, if no marks are left, one might be okay but I have read case law wherein social services has argued that the slap has left em...

Perhaps I have missed something here but the Home School Organization has a very powerful legal team in force that has taken CPS on in the past. Truth be told, I have skimmed through these posts and perhaps I have missed something but has the original poster even contacted the Home School Organizati...

Much of this will depend upon the expertise of your attorney. Traditionally, Grandparents don't win in CPS cases --athough they do win when CPS is not involved, sidebar there, sorry long history for me with the Troxel Case USSC 2000. As long as your rights have not been terminated, you still have a ...

Re: Gdaughter taken and threatening to take unborn too
To the Original Poster. I am a paralegal in NYC. I can not, by law, work in this state without attorney oversight. I believe it is different in California where paralegals are licensed. If you have found a private attorney to take up your cause and if such attorney wants any case law background, I w...

Re: Gdaughter taken and threatening to take unborn too
While I respect Mr. Henderson greatly, I am not sure if he actually "won". To win is to have your child back at home without court and to have your name cleared i nthe Registry and to be forever free, both the parents and the children from CPS.

You need a privately retained attorney or one from legal aid or another local legal services group. Also, if your daughter is somewhat disabled, mentally or physically, you might want to reach out to any organization concerned with Americans with Disabilites. ADA. Yes, you are right, it was not fair...

It is actually two separate hearings and venue, The family court and then, if you chose to file a petition in Federal Court but one can not really change the venue-two separate proceedings.

I have been in touch with the Citizen's Voice. Hopefully, they will be able to tell me who is representing Carol. I recognize that Carol is perhaps not the prime victim of child abuse laws, not the poster child victim as she is not middle class, not very well educated and as it has been mentioned, s...

Linda and Monkette, Oh, I just can't shut up. As I have said, Tigress and I are eons apart. She lives in rural America, I live in NYC. She is not well educated, I am. She does Karaoke, I go to the Symphony. But I still believe in my heart that this woman is being railroaded. Apparently, the two, hus...

Yes, Linda, Tigress had a tag team friend and the information they were posting wasn't so much in error but cockeyed. I'll try to explain. Tigress was smart enough to research online but not smart enough to actually research case law. She was smart enough to grasp some of the tenets of law but not t...

CPS trauma has to be the worst of any trauma. I know, I've been there. And, I have survived many things including 9/11 in NYC. A year after CPS entered my family's life (we won hands down without going to court and our names have been cleared in the Central Registry) I went to a therapist who was a ...

AMLC where are you? You don;t have to be terribly specific about same, just your state and county would do alright as there are many smaller legal aid groups across the country who may help in these matters.

Perhaps Nevada is different, I don't know but in most states, you do not need to be brought to court to be placed on a state's child abuse registry.
Have you checked the Nevada statutes?
