Re: APPARENTLY ITS CHILD ABUSE TO BRUSH MY CHILDREN'S HAIR?
Knowing what state this is happening in would aid in offering relative information. While there are federal mandates governing CPS across state lines, each state has their own specific statutes right down to their legal definition of child abuse/neglect. Regardless of what state it seems to me that ...

Re: Social worker home visits after reunification
In my state the department does monthly wellness checks for a year after the children are returned home if you voluntarily signed a case plan or were found at fault during the adjudicatory hearing. Also in my state they are required to conduct some unannounced visits, which does not make you "o...

Re: Questions about TPR and appealing PLEASE ADVISE
I'm not an attorney but it was my understanding that an appeal based on ineffective assistance of counsel will only be considered if the issue was brought up as a matter of court record during the original hearings rather then being introduced as an issue for the first time on appeal. While there ar...

I would suggest you look on the court orders generated at the 72 hour hearing. Then look up the policies and procedures for the department or contracted service provider managing your ongoing case. As a general rule, since your children are in the temporary care and custody of either the state or th...

In my own experience with CPS, the Judge ordered mediation after my daughter's continued refusal to sign a case plan either before or after she made her plea of "DENY" at her arraignment. Mediation turned out to be nothing more then another attempt by CPS to intimidate my daughter into sig...

You've asked a question that has more then one answer, depending on where your family is in the process and what the formal complaint is about. Additionally, knowing precisely to whom to lodge a formal complaint with is further complicated in Florida because although the Department of Children and F...

If you haven't already taken your son to his pediatrician to be examined due to his constipation and accidents at school you will want to do so immediately to rule out any medical issues that might be causing the problem. You can explain to your pediatrician what you have identified as precipitating...

I wouldn't take the children out of the DCF visiting office unless you have something in writing by them stating that they have given you their consent to do so. That way there is no he said she said and no room for misunderstanding or for negative consequences for your having done so after the fact.
