Re: Firefighter who helped save lives needs help now!

Sorry, long time no post. The kids and their mother have moved out of the grandparents home a month ago. They were able to move in with the new boyfriend who has proposed marriage. He has a decent income, kids are no longer crammed into one room at night. They have started at new schools (for the th...

Re: Firefighter who helped save lives needs help now!

Continuation of notes - CPS still holds all the cards, will not offer expungement to father even after they lost the court battle. He gets buy on jobs here and there and working for other family members. He is out of a car. He does borrow one to come and see the children. He is very good about it an...

Re: Firefighter who helped save lives needs help now!

Just a note....3 more months pass and the father has not been offered an expungement yet. He may never be able to return to his paramedic job. Not sure what force has to be applied to get off the list. Can't see paying a lawyer again. He will just have to keep asking. Kids suffer from lack of father...

Re: Firefighter who helped save lives needs help now!

Finally, mother gets expunged from listing. The mother, as you may have read earlier, was labeled with "Failure to protect". She had let her ex-husband (who she knew was not a threat, but only had a sleep disorder) come by and decorate the apartment for the next day birthday party for thei...

Re: Firefighter who helped save lives needs help now!

This is pretty much it--- According to Michigan DHHS: Under the Child Protection Law, you have a right to seek amendment of your Central Registry record or report, or expunction (removal) of your name from the Central Registry by making a written request for administrative hearing to your local MDHH...

Just a note - CPS still dragging their feet - no expungement granted yet - not even a reply.

Re: Firefighter who helped save lives needs help now!

Still waiting on replies to our requests for expungement. Meanwhile, father is enjoying time with his children which he so missed. But, he is still trying to recover from the financial devistation CPS caused. It may take quite some time. No money for the kids or the ex-wife. Grand-parents have been ...

Re: Firefighter who helped save lives needs help now!

Just a note -
After many requests to get names expunged, CPS is not returning calls, just dragging their feet. They seem to be reluctant to do the right thing. Oh wait, that is pretty much their signature move.
Will keep you informed on when and what other hoops we have to go through.

Re: Firefighter who helped save lives needs help now!

The day has finally arrived. Friend of the court was early in the morning. They were happy to sign an order giving the father parenting time. Both ex’s agreed on everything. They would work it out day by day by themselves. Friend of the court said that’s the way it should be. They went right from th...

Re: Firefighter who helped save lives needs help now!

One thing i forgot to mention. The week before the trial, the mother and daughter met with the prosecuting attorney to prepare for the trial. As you know, the mother and daughter were on the father's side. The procecuter has known this all along. During the meeting he said" If I don't win this ...

Re: Firefighter who helped save lives needs help now!

Thank you for the reply. What took the jury several hours to figure out and conclude with certainty that he was innocent has taken CPS nearly 3 years. I'm sure they still believe what they believe because of their ignorance. They will probably go away kicking and screaming. I say, in order to reduce...

Re: Firefighter who helped save lives needs help now!

NOT GUILTY!!!!!!!!!!!!! It was a three day trial starting 6-7-16. One whole day was picking a jury. We could tell some disqualified jurors were pre-judging and walking out saying things against the defendant even before hearing the whole case. Anyway, the mix came out in the middle of your normal ra...

Re: Firefighter who helped save lives needs help now!

Another outcome of CPS destruction, mother is now going through bankruptcy proceedings. Previous decent living is wiped out and she needs to wipe out the mounting debt. The father was able to keep away from bankruptcy so far.

Re: Firefighter who helped save lives needs help now!

Not without a 2 day parasomnia montage sleep study. That would be $5000 out of pocket and a wait and see if we were lucky enough to catch an episode. Now that he has reduced his stress, stopped the weight loss pills and is not working at the firehouse, his chances are lower. He also has been useing ...

Re: Firefighter who helped save lives needs help now!

Yes, all it is grinding up is the green stuff until it disappears. Anyway, the trial is on for the first week of June. Talked to some "parasomnia" experts yesterday. They agree that he probably has a Non-REM sleep behavior disorder (sort of like sleepwalkers). He has had all the signs and ...

Re: Firefighter who helped save lives needs help now!

Well, it just keeps on postponing along, There was no interaction with the attorney until yesterday. And guess what, the trial is post-poned again till June 7th. I'm guessing the ability to prepare a trial is impossible when you are an attorney with several other big cases going on at the same time....

Re: Firefighter who helped save lives needs help now!

Trial on track for March 29th. Attorney seems to keep us in the dark a bit. No changes otherwise. CPS still makes their visits. Caseworker says that the father could apply for visits with the other 2 children. He seems to be in too much turmoil to deal with CPS. Any connecting with them could go the...

Re: Firefighter who helped save lives needs help now!

Linda, Thanks for the reply. Pre-trial was just the same old stuff. Showed up only to have the trial moved back TWO MORE MONTHS. The new lawyer is swamped with other "high profile" trials. He needed more time to get his attack plan together. Also, I believe he wants to have a word with the...

Re: Firefighter who helped save lives needs help now!

Site was down for awhile...mmm. Anyway, coming down to crunch time. January 21st should give us a good idea of what to expect for the actual trial. Our lawyer is one popular litagator and has a handful of high profile cases. I hope he has the time to slam dunk our case. Tensions are high. Thanks all...

Re: Firefighter who helped save lives needs help now!

Trial still on track for February. The newest lawyer is convinced the jury will understand the basics (passed the polygraphs, ex-wife and others have witnessed or have been on the receiving end of his parasomnias and even the so called victim is not going to help out the procecution. This means he s...

Re: Firefighter who helped save lives needs help now!

Thank you for caring, and sorry to here of your situation. The mother in this situation almost lost the children to Foster C. but we were lucky to find a local lawyer that worked for CPS for a few years before becoming a lawyer. She knew enough to shake their tree and let the kids stay with their mo...

Re: Firefighter who helped save lives needs help now!

Time doesn't seem to be healing anything. The trial is posponed to late January and early February. Again, another holiday season spent without the ones you love most. It's gotta hurt when your in this situation and the Christmas songs are playing everywhere. All you can do is hope that the new year...

Linda,
Will know soon. Was supposed to be early next month but now posponed again due to new lawyer needs more time. He just finished defending a local government employee. Ended up with reduced sentence.
The waiting game is still on.

Listening... Again, the previous lawyer was a suggestion from another lawyer, and he has had almost 2 years to get together a game plan, which he hasn't. Being that the time lapse is so long, tells me he is an expert at postponing trials (with a little help from the prosecution which we believe has ...

Re: Firefighter who helped save lives needs help now!

When your're life depends on it, you get desperate and you make desperate choices. Hoping something will turn the tide and keep you from drowning. You think things are going good, then you get the diagnosis that you have cancer (CPS) and you only have so much time. You'll try anything to take down t...
