Re: False accusation of Munchausen by Proxy

Munchhausen by Proxy is a term CPS likes to throw around a lot, without any knowledge. Any parent that has a special needs child is protective, and wants the best for them. Unfortunately lazy doctors, schools, and CPS will use this term as a punishment and so that the burden is turned on you and not...

Re: I finished

You know what you are doing Trina. Get the school to write a letter about their services and how they can help you daughter specifically. Get a behavior modification specialist if you need to and an IEP going, a behavior contract, and safety plans in your home. Parent that have children that have me...

Re: i would like to expose these caseworkers

They are dumb, which is why they use intimidation and the children against you. CPS creates the culture of no accountability. They hide behind the "department." It is in your interest though to try and nail one down, so they don't keep playing the shuffle game. Use the recordings at the ri...

Re: I finished

 hahaha Linda, that made me lol. One of the few times I've had a good laugh in the last two weeks, but very true. Familyman, spot on with how they operate. Unfortunately, once they have the kids little matters, not the lawyer, not the judge, not the social worker, not what you do. You can can j...

Re: Victory

Yes, you can also file a Motion to Compel. They must give you access to the case plan. Without access they are setting you up to fail. Remember, while it is frustrating, this goes in your favor. Every time you can point out their mistakes it helps. Bring it back to court. The judge needs to see.

Re: I finished

Unfortunately, this is usually just the beginning. CPS will often try and drag it out for as long as possible. Just keep in mind their goal is to make money. You can write an email to the social worker and explain you have done what is asked in a timely manner with the goal of having your kids retur...

Re: I cryed

:D That is great news!!!!! A criminal lawyer should take no bs. He knows how the courts are supposed to work. I hope him taking it on for free is a good sign of him wanting to put them in their place.

Keep doing what you are doing. And don't forget to document!!

Re: Hospital visit turns into CPS/Police investigation

You guys are going to have to find a way to find common ground, that is the baby. Put all else aside. I recorded my ex (he initiated the report) at all times. But ultimately your goal should be a unified front with the two of you. You know her best, and I would get her away from her mom so you and h...

Re: Hospital visit turns into CPS/Police investigation

It depends on what evidence they have. Criminal is possible. But they favor family courts because it doesn't have the same guidelines, it is easier for them to find you "guilty" than they would in criminal. Criminal while it sounds more horrific sometimes is better because the standard of ...

Re: Sad story

Don't do anything that isn't court ordered. If it is court ordered, file a response and contest it, if you lose, appeal it. In one of my motions I said if I was required to do a psychological evaluation and drug screens, then they should be. It is only fair. They have no license to speculate about a...

Hey Trina,

I am still here. Just got a little side tracked. But they can't keep me down!

It sounds like you are doing great. The parenting classes was a good idea.

Your psych evaluation should suffice. They want you to do it again?

Re: Hospital visit turns into CPS/Police investigation

I would assume they are going to come at you hard. Both of you. That is why you will need to become air tight. You two are a team. You need to realize if one of you falls you both fall, the cost is your child. There are no winners when it comes to CPS. I would think that the smoking would do more da...

Re: Hospital visit turns into CPS/Police investigation

You want to know everything about the process. You should become familiar with those laws and the handbook. Go through step by step, anything that they have not done by the book, you point out. This will help preserve your rights. If you don't speak out, the courts will never preserve them for you. ...

Hey family man, I know, no questioned the "medical attention." At all. That is how much power they posses. It is sickening. The arrest was for a bench warrant. I entered my appearance on August 19th. The same day the judge made a judgment for me to appear the following week on the 25th. Th...

Re: Hospital visit turns into CPS/Police investigation

I am sorry that this is happening to you and your family. Welcome to the site. I would look around, especially in the legal threads. There are things you can do to help your attorney. First and foremost, record and document everything. If you can get an email address, so there is record of everythin...

Re: Nationwide Amber Alert

I should clarify: I did not flee. CPS does what they do best, lie and manipulate. I left a MONTH prior to them filing. I requested to "appear" to the hearings by phone and was the request was granted by the court to do so. I was well within my rights. I have complied and met every hearing....

Nationwide Amber Alert

Hello, I am back. So, the State issued a false Amber Alert, nationwide. Nancy Grace (along with multiple other media sources) plastered my face on her show, although it ended up just being a 30 second spot rather than the lengthy one that the producers wanted because of "breaking news." Th...

Sui Juris, Orders Reviewed

So, now that I "represent" myself, when the judge makes a judgement, the attorney requesting the judgment has to write the Order and then present it to all of the parties for approval of "form" (that it is accurate). The last Order the attorney tried to squeeze in it that I had &...

Re: Should I hire an attorney?

No, don't put anything into it. They have 30-45 days generally depending on your state. You may have gotten a lazy one, who isn't going to do much investigating, she could just be busy with others, or out sick, or taking her time. Never know. Just don't let your guard down, keep getting your support...

Re: Should I hire an attorney?

You will probably want to get a letter from the psych about that too, and that you didn't just stop services, that he didn't need additional services. That the decision to not medicate was a medical decision that did not produce harm. Anytime, a child has a mental illness, they are at more risk for ...
