they are still in state custody, they are saying that he is going to get them. And want to terminate my rights to my younger ones because I left the state and got away from an abusive person. But I can have my teenager back. Who's "they?" The kids or the state? If its coming from the kids, I wouldn...

Hope it went well. You might try contacting your local women's shelter. A lot of times they'll have an attorney on staff that deal with similar situations. They will give you free (assuming it's a good shelter) legal advice on what you should do when an abusive ex does this, or even a referral to a ...

If you had had your children taken away, I would recommend petitioning the state to have your case re-reviewed by someone else. If you know anyone that did have their children taken by her, they should see if they can do that. Also, the google thing, you might try waiting a few days and search again...

Re: my question
my question is a simple one, and may have been answered several times, what is the difference between a social worker and a cps worker? is it the same? Not always. A social worker is licensed through the state. We have a set of ethical "laws" that we're mandated to uphold. If we violate those laws,...

Social Worker stated: How would you suggest parents defend themselves against such caseworkers? Documentation. Whenever possible, have a voice recorder going. Caseworkers can't say you aren't allowed to have a record of your own case. If possible, have witnesses during meetings and phone calls. It ...

http://www.ncsl.org/programs/cyf/kinshiphigh.htm Look at this part: SUBSIDIZED GUARDIANSHIP, KINSHIP FOSTER CARE AND OTHER CAREGIVER SUBSIDIES AND SUPPORTS It looks like they have some kind of program set up, for "kinship foster care" which is what you're describing. How it works I don't know, but i...

Social Worker- I am advocating the Law. There are safeguards in the law to prevent CPS from coming in and removing children and having social workers make the determinations that only judges can make upon EVIDENCE. Social workers are not judges, they are not MDs. they are not law enforcement. You a...

An appeal is not taken out of the county necessarily. An appeal is taken to a higher court. Most of this cases are wrong on appeal. The reason is that the judges i nthe higher courts actually adhere to the law. Many lower courts do not. You can not introduce any new issues in an appeal. What you ar...

A lot of counties have family court judges. Depending on how small the county is, there may only be 1 judge. That doesn't necessarily mean they're "CPS judges" but it does mean that they know all the CPS players pretty well. I would appeal, if possible, I'd try and get your case moved to another cou...

If the eval was ordered b ythe court, then you must comply or be in contempt of court (you don't want to be there). BUT- my strongest suggestion to yo uwould be to have another independent eval done by a doctor of your choosing. If the court-ordered eval comes up negative then you will have another...

Re: You can Report a Social Worker here's how
PLEASE SHARE THIS INFO ALL OVER! You can report social workers. They are expected to follow a code of conduct. See if the social worker in your case belongs to the national association. Keep a record of the wrong doings and submit a complaint. http://www. socialworkers. org/pubs/code/code. asp http...

And by the way-it is illegal to tell parents that you can enter their homes without a warrant or a court order and it is illegal to remove children without same. CPS is just counting on the ignorance of parents. You are trained to do so. I have read your manuals. It is illegal and is brought to tas...

Here's the deal-if parents had opportunity to legal counsel from the get go -much like Miranda rights-parents would realize that most of the "abuse" cases social workers "investigate' do NOT even meet the minimum of the state statutes-yep, they ,the social workers are bluffing it. They are bluffing...

You can do lobby work. You can do this in a couple of ways, 1 would be to sign up with an advocacy group that you believe in, you could work up to levels of government and basically meet your states representatives about your advocacy group's concerns. You can also do it on your own. You pay your re...

I wish I had an answer you want to hear, but I don't. There are lots of reasons there are problems. There are lots of reasons it works slowly, there are lots of reasons why it seems workers don't care. I've never met anyone who actually WANTS a child to be in the system. I have met many who see it a...

Technically, it is no marks, however, since most cases aren't looked into until much later, marks really can't be photoed and shown as evidence in a lot of court (here anyway) For the exact reasons you've said. There is no telling how those marks got there (you could get a mark from falling off a bi...

I don't think the original movement is the problem. The original laws of child abuse were created when a child was severely abused, beaten, and neglect almost to death. What created the movement for child abuse laws was that no one could be charged in those crimes, and by the law at the time, dogs h...

O.K. If I getting the necessary treatment for my daughter that mean I am meeting this statutue? Dawn P.S. does it state I have to believe what she is saying? I'm not extremely familiar with NAACP's legal program. However, here is a link to their legal resources. You might try contacting them and inquiring about legal aid, especially with the reasons Maggie talked about.

It means a child whom the state decides is being neglected or abused either physically, mentally or emotionally because the guardian isn't caring for those need. It gives a loop hole that the neglect, or abuse can't be due to poverty. Meaning if the guardian can't pay for shoes for example, it doesn...
