Re: Mental health disabilty and right to raise children

Each case is different and without knowing specifics of your daughter's case I couldn't say. It appears as though CPS had your daughter working a safety plan while the children remained in her care. CPS appears to impose their safety plans as an alternative to removal of the children and court inter...

Re: so extremely depressed

The answers to your questions largely depend on whether you had legal custody of your grandchildren. If you had legal custody, then you are a party to the case and can obtain a copy of the Petition from either the clerk or court or from the SW If on the other hand you had an agreement with your daug...

Re: Nervous hello

The way the Child Welfare System is run is reason enough for parents to be suspicious of the true motives and intentions of Foster Parent's in my humble opinion. Thinking back on my own personal experiences with CPS I'm persuaded that unless and until you're on the receiving end of being accused of ...

CPS is conducting an investigation on your family based on a hotline call. (She said someone called and said we were walking our child at 3 am and I was slurring my words and acting drunk and me and fiancé were arguing. I started laughing bc it sounded so ridiculous. She kept asking me if I do drugs...

Look up your State's definitions for child abuse/neglect - sexual abuse etc... There you will find the statutory language of what they will have to prove in court against whomever it is CPS has substantiated the neglect allegation on. Dependency court uses "preponderance of the evidence" a...

I agree that much of any State's Statutory language is subjective but in this particular instance it seems clear. DV when committed with the knowledge that a child/ren are present in the home, is considered DV in the presence of the child/ren. This alone seems to have given CPS their inside fast tra...

Look up your State's statutory definition of Neglect comparing it to the scenario you just described because that is the measuring stick and language CPS would/will use in any petition initiated for court intervention.

I think what's happening is that child welfare statutes and state specific abuse/neglect definitions have not yet caught up with the States that have only recently legalized medical marijuana such as Colorado. Colorado Physical Abuse Citation: Rev. Stat. § 19-1-103 • A child tests positive at birth ...
