Re: Sui Juris, Orders Reviewed
Thank you for sharing this. It's very informative. It really is a full-time job to keep on top of all this. Ordinary parents who already have a job and have to jump through CPS hoops don't have a reasonable chance to represent themselves. The deck is really stacked against them.

Re: Should I hire an attorney?
Most investigations **are** closed with allegations ruled out. You just never hear about them in forums like this one. Since coming to TX, we've been investigated three, maybe four times already. All of them were closed with all allegations ruled out and risk factors deemed to be under control. They...

There are better ways to fight the system than taking your own life. I am very sorry that this is the path taken by your wife, and I am glad that you remaining in the fight.

Re: Lack of clarity about what can make you lose your kids
I agree to the point that we longer are living in a free society. The pressure to conform to societal norms is increasing, and not just in the realm of parenting. My political views, for example, are pretty far outside the mainstream. I feel I cannot discuss them in public, at my job or in my commun...

Re: Florida Two and a half years and still being harrassed
When my case was finally completely closed, I was already living in another state (TX). Since that time, we have tried very hard not to let our past involvement with CPS become known to anyone. My son's psychiatrist knows. A few psychologist/therapists that we used during our ordeal know, but we don...

Re: Worth a Shot
One of the terrible consequences of CPS involvement is how one's reputation in the community is destroyed. Once your friends, neighbors and coworkers find out that that your children have been removed from you due to your abuse and neglect, they will ostracize and gleefully spread vicious rumors abo...

if charged with this how will it effect her case to get her daughter back. It will become more difficult for the mother to get her daughter back if she is charged with DV. It will basically put her entire CPS case on hold until the criminal case is decided. If she is convicted, she may never get he...

Your objective in taking any kind of CPS or court-ordered psych evaluation is to make it come out looking as normal as possible. This is usually not too difficult to accomplish if you make a conscience effort to answer the questions in a consistent manner, in the way you think a "normal" p...

Your family sounds a lot like mine was when we got into trouble with CPS. It sounds like they have already made up their minds to take custody of your child. I'm so sorry. You might still be able to head it off if you make some dramatic improvement in your living conditions by hiring a moving compan...

Re: My Second CPS Case
So are you planning to represent yourself at the adjudication? Do you know how to subpoena and introduce evidence, call witnesses, cross examine witnesses, file pretrial motions, when and when not to object to the preceedings? Your letter reminds me of something my own attorney might write, after sh...

Re: Focus on fighting CPS
Fighting CPS is a little different from defending yourself in a criminal prosecution. The former is conducted in civil court, where decisions are made by a preponderance of evidence. CPS does not have to convince a jury that you committed a criminal act beyond a reasonable doubt. They only have to c...

Re: Language Change from Imminent to Impending Danger
When my case was finally closed with my family reunited, I was so exhausted financially, mentally and emotionally, that I did not file a counter suit against CPS. This was despite the fact that my attorney thought I had a case against them. That's all I'm saying. Maybe another family like the Gates ...

Re: Language Change from Imminent to Impending Danger
CPS is not supposed to be able to change the law (either case law or statutory). CPS is supposed to only follow it. CPS by itself cannot change its regulation from "imminent" to "impending" without a new law or some precedent-setting ruling from a superior court, which itself cou...

Re: LEARNING FROM EXPERIENCE
OK, now I better understand. What a mess! I suppose the best advice is Linda's to write your side of the story in a Declaration of Facts affidavit that you try to introduce into the court record. This may be the only way the judge may come to an understanding that (1) your grandSON was not abandoned...

Part of my problem in responding to this situation is that the posts were scattered across various threads and forums. I have tried to collect all the posts into one thread, so that we can better understand the situation. Another problem I've had is the acronyms. What is a POA? What is a DOF? Appare...

There must be a court order if your grandchild is in a foster home. The order awards temporary physical custody to the foster parents, and temporary legal custody to CPS. Furthermore, there must a case plan for reunification that your daughter must follow. This plan is also approved by the court. Yo...

Re: Out of state Parenting classes
To recap your situation: Your son wants to his daughter, who is currently living in a foster home in KY, to be placed with him in IN. The mom lives in KY and is completing services to be reunited with her daughter. I don't understand why KY CPS would expect your son to have to attend a parenting cla...

Well if you really are the author of these emails and posts "indicating your pedosexual lifestyle," I would commend CPS for their thoroughness in investigating you, while at the same time time giving you a way to demonstrate you are not a risk to Piper. I don't know how they "prove&qu...

Emergency custody for you son might have worked before KY CPS took legal custody. Now the only way your GD could be placed with your son is through the ICPC. During your son's home study, make sure that they interview you as well as your son and that your income is included as possible support for y...

Re: Granddaughter Taken by CPS becuase of a water bill
First your son has to prove in a KY court he's the father of your granddaughter if his name is not on her birth certificate. He can do it the same way he proved it in IN. Next, KY CPS has to initiate an interstate placement of her in IN. A formal procedure for this exists, called the Interstate Comp...

Re: CALIFORNIA FALSE ALLEGATION - very puzzled
There are the not-so-small issues of custody, child support and visitation to consider. If your daughter stays with her father for an extended period of time, he will have a good case that he deserves custody and child support from you, not the other way around. You will then have to defend your pos...

What could happen? Anything between nothing or completely ruining your lives. I would say you are quite lucky so far that (1) the criminal investigation is closed and (2) CPS hasn't taken you to court yet. I'm glad you decided to quit pot completely. I'll never understand why parents or anyone else ...
