The search warrant was legit. The only question we have is that on the second warrant, it stated the specific items to be taken out of the home.... As embarressing as it is, they came in for dildos, vibrators and sex toys..... In the process, the decided to remove a box of condems. I question if the...

Disgusted with the Adjudication Hearing...
So yesterday we had our second day of the hearing. The next one is scheduled for the end of February and then another day in March. I just cant believe how much this is being dragged out. I mean basically, we are going to court one day a month just for the adjudication hearing. Yesterday, they allow...

This is only through our state legislature but look for this in other states. I just hope it will become a trend and other states will pass a similar law! I hate to be the pessimist but CPS and the police departments will find a way around this one too. Since when do they abide by any of ours or ou...

I can only speak from my experience here. I was/am considered the non-offending parent. I followed the safety plan to the "T". This is all documented. Oregon filed petition for removal of my children because I was defending my husbands innocense and I did not immediately bring our daughter to counse...

UPDATE: I've spoken with a lawyer which wanted a 1k retainer, charging 120 dollars an hour. How can any normal citizen afford that? Justice is for the wealthy! Your gettin' it now! Most can't! Thats part of the goal you see.... Break up the family, cause an unimaginable stress between you and your ...

I am just assuming, and I know I shouldn't after what we have been through that the judge has agreed on the jurisdiction facts. He even made the statement that we willingly left Oregon for NH so this is where this will all take place even though... NH is doing the leg work for Oregon. As far as the ...

Heres one for you, he works for the Oregon State Police... he is a detective and a polygrapher. So he works for the PD. This was not ordered.... stupid us requested it. He is licensed through the state. I found minutes posted at a committee meeting where he discussed how he keeps records of the ques...

Even if they are qualified, you have to distinguish between fact and hearsay and object to all hearsay statements. Whoa... fact and hearsay... I thought that those were all acceptible in family court? And what do judges think about down right lies? Ok, so here is an example... I moved back to NH la...

Does this apply to anyone else working with DHS/CPS? I think in our case, they attempted to cover their tracks by forwarding the information to several different people to make an administrative finding against my husband. The actual worker says that he did not make the finding but that someone else...

There is an interesting book, I believe called High Risk Children. It deals with the issues of R.A.D., Reactive Attachment Disorder. Some portions of the book I did not care for because it requires you to do things that I didnt feel comfortable with but I was interested in reading the cause and effe...

I forgot to mention that another part of our dilemma stems from our motion for discovery. The judge granted the motion but as far as I can see in the broad spectrum of things, it means nothing. For instance, they sent along some garbage notes pertaining to my husbands polygraph but not the video, qu...

This has been discussed with the attorneys and that is their intent. Right this very moment, the overwhelming feeling that people just give two craps about our children and more about their investigation, is just getting the better of me tonight. We did, when we had the computer over a year ago have...

I am so sad this evening. We have such nasty allegations against us. The worst part, is that if anyone took a minute and used half a brain, they would be able to look over the papers from DCYF in both states as well as the police reports and see that there are some serious issues in regards to hones...

Polygraph.... Need input quick!
We finally received the WRITTEN polygraph examiner's notes. Obviously it is filled with lies and half truths. My husband, according to the examiner and the detective, was 99.9 deceptive and, I quote, "failed worse than a murderer". I went through the time line. They have not released the video, just...

I could be mistaken but I think that NM is the only state that allows polygraphs admissible as evidence during a criminal trial. The other 49 dont unless both parties agree. As far as I can see, anything fly's in Family Court.... it's an unconstitutional court as far as I am concerned. Hearsey, poly...

I know from conversations with the attorneys. In Family court, hearsey is accepted right? All the police and DHS did in Oregon to start the ball rolling is state that my husband failed the polygraph. Because of this comment, well, who doesn't know that he failed? It even states it in the petition wh...

While going through the papers that were received through the attorneys, there is a complaint to our local pd from ...

Stay far away! Polygraphs can be used as evidence is family court but not in criminal court unless both parties agree. You name it, it can affect the results. The other problem with these tests is easy..... Not only are the results read by machine, they are also read by man (or woman).... Thats like...

Frustrated... I think you might have misunderstood. The allegations by my sons father came out 2 weeks before the kids were taken (and we did not know about them until now). That will be a second round of issues with DCYF we believe. To be honest with you, I dont know why the police or DHS is having...

They obviously did not follow code when obtaining the samples, but I went through something similar and it was legal because I did it voluntarily. You each received your own attorney because otherwise, it would be a conflict of interest in the event either parent accused the other of the allegations. Confusing, I know.... but everyone needs to feed of something in this vicious cycle. When you go to the pre hearing, your lawyer needs to find ou...
