Texas CPS workers

In Texas, just as I assume in all other states, anyone can be subpoened to any court hearing.

Workers cannot go to a court hearing (policy not law) unless it is a CPS case or they receive a subpoena.

Criminal case vs Civil case

In Texas CPS cases ae civil and not criminal. There is a different defination in the law for civil than for criminal cases.

Also crimial cases are filed by the county District Attorney and civil by CPS.

There is no Mike Lockett employed by Theas Department of Protective and Regulatory Services. Befora a parent can have their rights terminated then MUST have an attorney appointed and in court to represent them. Look in your lcal news paper for ads from attorneys that do uncontested divorces for $175.00 to $300.00 they also will do uncontested guardianships for the same price.

I have never seen the term prior to tonight. I do not know what it means but based on the defination I saw in some post any judge would throw any case based on this term out of court.

All removals must relate to one of the abuses or neglects as defined in Texas Family Code.

In Texas it is illegal to intervrfere with a CPS

investigation. Regardless of the reason.

This is a seldom used provision of the law because it is investigated by law enforcement not CPS. Law Enforcement usually wants to start their investigation by having CPS remove the children.

Texas & child attorney

In Texas every child in CPS cuswtody is appointed an attorne to represent him/her. Also Court Appointed Special Advocate is named for every child. CASA meets with the child on a regular bases and acts as their personal spokesperson in court and all meetings.

If there is a Court Appointed Special Advocate Program in your area contact them immediately. They will have someone to go to court to represent your daughter and only your daughter. CASA does not represent parents only children.
