I have not done this and am not too familiar with the process. This is an old post so I am not sure if the links still work, but hopefully will point you in the right direction.

Hi and welcome Trina.
I am glad to hear you have some things going for you.
Why did your son try and stab the Fosterer? It is good that you have her number and can talk.

Re: Mom Fatally Shoots Case Worker After TPR
Thanks Linda, I look forward to reading the article. There are a lot of brainwashed people. Our government has done a good job at dumbing people down and diverting their attention. It is so far out there in left field that our government would steal children for money, and people feel powerless to d...

Re: Mom Fatally Shoots Case Worker After TPR
I tried to keep up and encourage people to get educated about the corruption as this is a great platform (sad it has to come to something like this for the attention), but I wasn't able to post anymore. Just think though, Linda 10 years ago, it would have been few and far people speaking out against...

RE: CEASE AND DESIST As you are aware, I have not been adjudicated of abuse/neglect. The State has thus far failed to provide any substantiated evidence of any such allegations. Furthermore any allegations of abuse/neglect are adamantly disputed and denied. Statements made that are untruthful, have ...

Re: Feel like we are being railroaded
Especially if your child has a disability there will always be a risk in CPS coming. If you are too involved, if you push any service to do their job, if you get a second opinion, if you stop services, etc. there is "cause" for CPS to storm into your home and turn it upside down. The worke...

I've heard this is a new tactic they use Linda, to call for a Hearing the same day. Its been reported that they will call the parents and say you need to get to court now. Infinity, welcome. Once you have done these things, continue to educate yourself. Learn about your Bill of Rights. Read up on case law. Read the Children's Code, and Judicial process in your state. Learn about a Motion, and how to write one. Knowledge is Power.

Re: Wish i didn't need to be here.
You will need to put your feelings aside. You can vent and get mad here, but not in front of the worker. This is a very serious situation. She will abuse her power, because she has the power. She has the power to take your child. She has the power to destroy your relationship. And you better bet tha...

Re: Flood the CW with Paperwork and Other Time-Wasters?
I agree with the approach Linda stated. Document everything. Keep them busy. Have them enter a copy into YOUR file. Number them, and refer to them constantly, to show that they are not doing their job. Whether they read it or not, you will use these to build a case against them. Yes, CPS is lazy. Th...

Re: missing child visits due to reasons not caused by parent
Yes, this is great to show their non-compliance to Court Orders. Visitation is generally Ordered, if not file a Motion to have it Court Ordered. The more you can show they don't follow through and in fact hinder reunification and alienate the parent-child relationship the better for you. You can fil...

I really liked what Eljay had to say. Very good. I wanted to point out as well, always, always, always document. You then write your summary of what took place and send it in email to the case worker/supervisor/whoever. You add on the bottom of the email something to the effect, "This is true a...

It depends on how the Court Order was obtained. If you have bases to challenge the Court Order/Warrant, then you have the ability to challenge that they have violated the 4th Amendment.

CPS cases are confidential. Since he is a party to the suit, he can request his file from his attorney, the department, or go to the Court. If he goes to the Courthouse he will have to pay for copies. You will not be able to obtain copies on his behalf.

Re: Regarding monitored visits.
You can file a motion and show your income. That this is a financial hardship. They even do this is in custody disputes. There are many options, including sharing the costs, meeting half way, etc. Typically this is just another way to inch you out of the children's lives. But you want to show that t...
