Now the SW is threatening to sue me!
Katrina, I do not see how Deborah Lewis and I being sisters is a conflict of interest. You began attending Parenting Classes through Hartley House at least a month prior to my relocation to ***, and being assigned your case. I make this statement for the following reasons: #1. The Parenting Class pr...

But after an unannounced visit by the case worker resulted in the removal of both children from our home because my wife left our grandchildren with our 17 yr old and his girlfriend while running an errand and the 17 yr old son tested pos for marijuana. At what point did they test the 17 yr old? Wh...

Bring a notebook and document EVERYTHING. Take down everyone's name and a business card if they have one, even the people at the front. Document if you bring them anything. If you bring them money or anything write a letter specifying what the money is for and get several date stamped copies. Write ...

Abuse and or neglect is defined, but I don't believe there is a code that clearly states that they must tell us what if any allegations there are. But clearly if a social worker is not telling you of any allegation then there is no need for them to be at your door and absolutely no need for an inves...

If you refuse to let the child talk to her, she will probably go to her school and pull her out of class. Teach her to say " I want my lawyer or parents present" like a broken record, over and over.. Or you can print these cards off and all she has to do is hand it to them: http://home.sc.rr.com/nb...

I am assuming since you said that it took a week to get the ball rolling before they took the kids that they did it through a court order? You should be given a lawyer and you should be going to court to respond to whatever allegations they have made towards you. If this is the case I would write up...

Sherri, I think you have several actions of recourse right now. #1 would be to protect your daughter as much as possible. I begin by writing a Hatch letter to your school and making it clear that no one can interview her period. If you don't already get a hand held tape recorder, cheap ones are abou...

Why refuse the test if you are clean? WHY NOT? You are not guilty until proven innocent in this country and there is no reason any of us should be pulled off the streets and treated as if we are criminals and waive our own liberties and rights just to please someone else!!!!! Why should anyone give...

Thank you. I wasn't sure if I switch my motions and petitions to Petitioner or if I remain Defendant or if I change to Defendant/Petitioner. I guess I will just put defendant/petioner to be safe. I am sorry to hear about the Lunsford case. I had kept up with it for quite a while and hadn't heard any...

I still don't understand these two, if someone could help, thanks: Yabarra v. Illinois (1979) Where the standard for a seizure or search is probable cause, then there must be particularized information with respect to a specific person. This requirement cannot be undercut or avoided simply by pointi...

A couple of questions
When you are the defendant and then you file a motion or you make a petition do you still refer to yourself as defendant or do you put defendant/petitioner?
Do you file an actual motion to challenge jurisdiction or do you just put in your motions that you do not accept jurisdiction?

The best news I've had in 19 months
The counselor that we meet with weekly seems to be listening! He said that he has gone to the "people in charge" at CPS and expressed that he thinks that everything should be started from day one! He has told me that he has no reason not to believe me as I have shown him facts to support my stance. ...

Anxiousmom, I am going to say this in the kindest words I can, please know if anything comes out the wrong way it is not ill intended. With that said. I agree that if you start making a big fuss waving a bunch of disguisting pictures around you will seem like a kook. Your kids are not in your custod...

I would take all the preventative measures possible. You do need to have the kids in a school or registered that you are home schooling, in most states there are requirements you cannot decide to just pull your kids and teach them yourself. When/if you do place them in school I would start with the ...

I am sorry. Please do not give up. I still hear in your wife's voice a desire to fight. Because of her past and background I can understand her decisions and it is tiring to go through a childhood like that and to make better decisions just to have the finger turned around and pointed at you and to ...

I really think you need to get out of the hands of CPS and into criminal courts. Have you filed for your ex's parental rights to be terminated or for sole custody? I think that you need to call the police and make a report and then file the proper custody papers. If he is non-compliant with CPS then...

You did file an ex parte custody order against your ex? Can't you call and press charges against your ex/ex's gf for the abuse? Have you contacted the district attorney? I am confused as to why you want the case with CPS to remain open? If you have your son and he is safe then this is a criminal iss...
