Re: Father and records

Wait a min here, if he is not the legal father and paternity has not been established he has no intrest in any info. He is a legal stranger to the child. YOur lawyer should know this. If that is the case I would look up HIPPA laws and file a greivance cause they essentially gave private medical inf...

Re: Father and records

In Texas the legal father of a child can obtain all records on his child except the identity of the reporter and a copy of the interview film. He can view the film if he is not being named in any criminal action. That makes perfect sense. However, in this case, there is no LEGAL father yet. He has ...

Spoke to the lawyer today. Supposedly, according to the County Attorney's office, in the case of suspected child endangerment and/or custody cases, the medical records of the parents CAN be given to each other. So, we are filing for a protective order stating he cannot give or show those records to ...

If my daughter is put on that registry, you can bet I'm going to do everything I can to get her taken off. Her only "crime" is that she talked to her doctor about her fear of developing postpartum depression and CPS is making it sound as if -- no, they are actually CLAIMING -- she was actively havin...

I have not, but I may very well be doing so before long. I've been told by the counseling worker who provides home-based services for my daughter that this entire case is not being handled properly by CPS. She also told me yesterday that she has talked to her supervisor about it and he agrees. Not s...

Okay, thanks for the advice about the journal. I'll do that. As for the GAL not being our lawyer and being very careful about anything we say to her, I do already know that part. We have a hearing next week, and it will be very interesting to see what she has to say, considering she's never seen the...

They also must disclose PHI when required to do so by law, such as reporting suspected child abuse to state child welfare agencies. Okay, I totally understand that statement -- I'm not objecting to CPS having the records. What I'm trying to find out (and isn't stated in anything I can find) is wheth...

DCFS/the County Attorney sent my daughter's medical records to her ex-fiance (the baby's father). Can they DO that?!

My daughter still has the baby, though. That's the other thing. They are supposedly SO worried that the baby is in danger, yet they are doing nothing to check on her -- we've not had any visits from CPS since June 11, no inquiries from the guardian ad litem. The woman who is providing "home based se...

Guardian Ad Litem My A$$

A Guardian Ad Litem was appointed to represent the interests of my infant granddaughter (CPS is claiming my daughter is a threat to the baby because of bi-polar and depression) on June 9. It is now July 14 and we have had absolutely NO contact with the Guardian Ad Litem. How the hell is she supposed...

I am at work, so I haven't seen them yet, but we were served with papers this afternoon to appear in court next Monday. My husband and daughter were on their way out the door to my daughter's OB appointment when the social worker and police came to the door, so he hasn't had a chance to read them ye...

Upset grandmother

My daughter gave birth to her first child eleven days ago. She is not married and lives with my husband and I. She is 22 years old. My daughter has been in treatment for depression and bi-polar disorder for a number of years. After she got pregnant, she quit college and as a result could not be cove...
