Sorry, there is no link to the Dutkiewicz lawsuit. I contacted him and he sent me several documents via e-mail. If you want, contact him yourself and ask if he is willing to send you the same material. As far as the 13th Amendment, please read the link below entitled "CHILDREN AS CHATTEL: INVOKING T...
Re: sue them
Can we go back and sue CPS for not having all the facts and for embarrassment and all the money we have had to put out thanks margo Unfortunately, you can't sue CPS if they acted in good faith. They do have at least qualified immunity. It is difficult to prove that they may have acted in bad faith....

The United States Constitution is the SUPREME LAW OF THE LAND and all its provisions apply everywhere and override any and all state and local laws and even federal laws that may conflict with it . It's irrelevant what state the federal opinion stemmed from. Any federal opinion is case law which is national. Not only do all 3 children have a right to an attorney, they must be assigned one to protect their rights, that is now the law. If the court does not assign each of the children an attorne...

I also did a search for a judges bench guide for Pennsylvania but nothing came up. Apparently, this may be something unique to California but the point is that the mentality is probably nationwide that judges are more interested in making money for CPS than protecting the best interest of children a...

Heads Held High
Heads Held High is an advocacy group that was formed by Bruce and Angela Bayer in Monroe County, Pennsylvania (Poconos area), after Monroe County Children and Youth Services illegally seized their two children and placed them in foster "care" in November 2003. Bruce Bayer is the Chairman. My wife an...

Why do the children have a Public Defender? Recent case law determined that children in state custody must be represented by an attorney every step of the way to protect their best interest. If their Guardian ad Litem is also an attorney, then they are represented. The fact that parents are charged...

I don't know how much influence Jane Pauley may have with her producers (I assume a lot of influence), but if there's any way you can get your associate to contact her to get the show to do an expose of CPS in America, definitely go for it. I feel it's not just a matter of focusing on the disorder, ...

**Important - Seizure from schools ruled unconstitutional!!!
The Seventh U.S. Circuit Court of Appeals ruled in April 2003 that it is unconstitutional for government employees, including caseworkers and police, to seize children from schools and interrogate them without a warrant. These constitute violations of the Fourth and Fourteenth Amendments. The case l...

There is nothing to prevent you from filing a federal civil suit at any time. The statute of limitations is 2 years from the date when the violation occurred. The exact timing may more be strategically advantageous after they've done all their misdeeds but it's impossible for me to determine that. I...

Although you may want to sue on another issue, the way it's normally done, you sue everyone involved in the same suit and in federal district court for violation of your civil rights under color of law. It's called a Section 1983 suit. You sue all individuals in their official and personal capacity....

We found an attorney and hired him to take over 2 of the lawsuits. This attorney already won a whistleblower and civil rights case against the CPS we sued. The whistleblower was a former caseworker who was fired by that CPS. Part of his suit alleged that the CPS endangered the welfare of the childre...

Dutkiewicz lawsuit
This lawsuit looks just like ours. However, we are about to amend our federal Complaint to include violation of 13th Amendment rights (involuntary servitude), among other things. If we win on that count, we will be setting precedent that many others can use.

In Pennsylvania, the Guardian ad Litem has a duty to interview the child and make known to the Court the child's wishes. There are 6 very specific tasks mandated by Pa. law that the Guardian ad Litem must perform and that's one of them. The one assigned to our sons did not perform even one of these ...

Well I'm certainly glad to hear that as these bogus Texas laws are clearly unconstitutional. Even though the ACLU has gotten involved with some CPS issues in the past, I am extremely angry at the national ACLU for not tackling the national CPS atrocity in general. This is one of biggest and most per...

Michael, If you read the CPS laws, you would know that you are required by law to help alleviate any and all negative conditions in order to make REASONABLE EFFORTS to reunite mother and child. Only and only IF it isn't possible after making every reasonable effort that the child will not be able to...

Government Control
I don't know anything about what you claim Mark but I have no doubt our government wants to control us. One of the most effective ways of control is through one's children. I know first hand all about that kind of insiduous control. If they take your children that you love, you'll do anything to get...
