I emailed a family member who is a DA about the search and seizure issue. Here is what he had to say.... The Fourth Amendment requires any government agent to obtain a search warrant to enter private property. One exception to the warrant requirement is where the agent is given valid consent. Valid ...

i just want you to understand where most people on here come from. some have no or little education, some can barely read or write, some have mental health issue, etc. i was able to defend myself, build my case and afford a good attorney. the majority of people involved in cps are not that lucky. i...

Momoffor, Since you post is nothing more than an attack this is all I will reply. Apparently you didn't read my posts. This was part of my 1st post. 1. No matter if you're guilty or not of what you are accused, threatening, encouraging, or even implying violence by posting names and addresses of tho...

Kat, First of all all of that sucks. It really does, I don't blame you for being angry at the child. I can't imagine anyone on the planet who wouldn't be. It sounds like she has severe enough problems she really should be in a live in facility with an extensive treatment plan, has anyone warned her ...

You're right. Don't feel bad. You can't always save everyone in your family, at 21 I assume he's able bodied, he can figure it out.

Kat, I'm not 100% sure of what you're asking. So, I'll try both ways I'd interpret it. You're talking about a family who either was becoming a foster family, or at the very least completed the process, correct? As a social worker, I wouldn't have removed the father from the home once it became appar...

Re: I'm new

If you were being 'totally honest' then you shouldnt have to worry about what is told or reported to the board in your state would you? Because after all, YOU and you alone were the one that decided to work for such an agency that is so honest and does so much good. Why should you be afraid of the ...

socialworker i have read your post. i find they completely unfeeling and meaningless. That's your opinion, and I'm sorry you feel that way. What may I ask do you think you'll gain from that? If I were unfeeling I wouldn't be here. End of story, or I would have logged in and laughed at the stories, ...

Marina, I'm not going to argue with you. You can either accept what I have said, or don't. Frankly, it's not any skin off my nose. I've been posting information on ways to file complaints and things that can help when you are trying to fight the system while being in it. You seem to want to keep arg...

I have a few questions for the social worker. Why is it that caseworkers can just make something up? Why do they do this. And will say it's confirmed with out any kind of questions or investagation? Now it comes to the end of my case which I thought. I am not poverty or below poverty, and I am educ...

I'm not sure if you're still following your thread or not, or if this can still help you. Hair folical tests are much better tests than urine tests. You can take one, and it will show basically any drug use you've had the for the length of your hair (years.) If you can show that there were no drugs ...

. Social workers have a legal responsibility to protect the legal rights of children and families, whether they know it or not. Parents are just as much the "clients" of Child Welfare agencies as the children are. Code of Virginia § 63.2-1502. Establishment of Child-Protective Services Unit; duties...

I'm new

Well, this isn't my first post, but I'm new. As my screen names says, I am a social worker. I joined so that I might be able to help answer questions people might have or advice that might help those that are needing some help. Just FYI, I don't think CPS is evil, just something that needs reform, s...

I think socialworkers are taught basic law as it applies to their particular position.. Socialworker never claimed to work in the CPS field, therefore, probably wasn't taught the laws that apply to that position.. A socialworker that works in income maintenance, child support or medical eligibility...

I beg to differ. We live in the United States of America and all citizens of this country must be informed of their rights. That is due process, the 14th Amendment and no one -no matter what the reason should be, should be able to withhold this information in any sort of investigation. Particularly...

More to Social Worker -4th Amendment-search and seizure. I see you have been taught to circumvent the law. Very interesting. Might I ask what state you practice in? I would like to take this up with your state's Inspector General. Thanks again for your input! I have been answering questions as they...

That depends. Not all states require that CPS workers must be licensed social workers. There is a difference between a case manager who calls themselves a social worker and an actual licensed social worker. Only a licensed social worker is bound by those ethics to the point where there are conseque...

Oh, I get it. So Constitutional rights are not adhered to. I don't know of any other single instance where this applies in our country. Very very interesting indeed. So an unlicensed social worker can mandate what is in the best interest of a child without any oversight whatsoever. By the way, do t...

If the social worker is unlicensed (how many are unlicensed, do you suppose?) then just complain to the Inspector General. Thanks for clearing this up. I've never heard of the inspector general. I dunno where you live, maybe it's a state thing? Or maybe that's the title of the person over seeing th...

Hello Social Worker- I appreciate you coming to this board to, as you say, assist those unfairly caught up in the "system". I have a few questions too, mostly about the investigation and case plan processes. When a social worker makes the first visit following up on a complaint -is it procedure to ...

Hi socialworker I'm wondering if I can pick your brain for alittle info.. I know socialworkers are guided by a "Code of Ethics" and it is written that CPS workers must follow them also. http://www.naswdc.org/pubs/code/code.asp Who would you file a complaint with over violations and what would they ...

I would suggest those credit consolidating places for the credit card problem. I have a friend who used it, and it worked out wonderfully. They'll ask that you don't get any more cards, and your cards would still be unusable, but they will contact the companies, can lower your interest, and you woul...

I don't know the circumstances for the original removal. It's pretty irregular that a newborn is taken unless there is drug use or no progress. You say they see your progress since they are allowing you unsupervised visits. Unless they have told you that you have to notify them if you're having anot...

The 1st thing I would tell you to do is to find out the laws in the area where this happened. You're case will be through them. Secondly, get a hair folical test. A folical test will show a much longer time of potential drug use. I don't know what kind of medicine they gave you, I'll assume it was s...
