To clarify, Walsh vs Erie was an issue of clutter on the front porch. From that case: “There can be no doubt that the state can and should protect the welfare of children who are at risk from acts of abuse and neglect. There likewise can be no doubt that occasions arise calling for immediate respons...

If they came in without a search warrant and against the wishes of the parents, constitutional law would be a valid defense.. In fact, constitutional law is a valid defense in any child custody issue, not just a 4th Amendment question, because such an issue always potentially infringes on constitut...

Someone might get that impression because you wrote Someone? Only "someone" like you who is apparently hell bent on insisting that the family court is not the proper venue to assert one's civil rights and that one should only assert their rights during the appeals process. "Someone" who doesn't und...

If your attorney or you fail to preserve appealable issues you can lose on appeal also. That's why it's so important that one asserts all rights beginning with the lowest court. The problem is, most people don't know that, lawyers don't do it and end up screwing the CPS victims. I only wish I knew ...

I'm not surprised your lawyer never talked about your constitutional rights, most don't. There is no best way to get your children back but you must assert your constitutional rights as part of your legal defense regardless, the judge may just be on the level and abide by constitutional law, you nev...

It doesn't state in the Constitution that someone can't sell illegal drugs from their home... so if CPS removes children from a home because it's used for illegal drug sales is the Judge required to return the children because it's not in the Constitution? It also doesn't doesn't state in the Const...

Then how could you claim that the primary defense of criminal and civil chargers is Constitutional law? Very easily, if the Constitution is the primary law and trumps all other laws, you don't have to be a rocket scientist or even a lawyer to figure it out. Then who is your statement "Yet the Const...

Please post the links for that wonderful bit of information, Bob. I already did, did you read it? Are lawyers taught that the primary defense is Constitutional law when their client is in a criminal or civil action? How should I know? I never went to law school. Or is that simply one of your opinio...

Even if someone asserted their rights in Family court and they lost, wouldn't the appeal be base on the denial of their constitutional rights? That would be part of the appeal and any other question of law. I didn't imply anyone should wait for the appeals process to assert their rights. Well I gue...

You must always fight for your rights, whether the lower courts recognize it as a defense or not, the higher courts do. That would be in an appeal to a higher court after the lower court made an unfavorable decision against the family, correct, Bob? You're assuming the lower court made an unfavorab...

trying to fight for your rights is not going to work until the court recognizes it as a defense, and right now they dont. You must always fight for your rights, whether the lower courts recognize it as a defense or not, the higher courts do. Again, if you don't fight for your rights, you waive them...

I'm glad you got your children back Florida and I agree that one must do whatever it takes, first and foremost, to get their children back. Of course, one has to know what that is and the fact is, no one really knows because every CPS is different, every caseworker is different and every judge is di...

I was able to find out that even if I sent a letter like this to our school, it would get me nowhere. So you have nothing to lose and at least you get to tell them where you stand, that you're not going to be easy prey. And regardless, the school will not sign such a letter because it puts too much...

As I've posted florida999 got her children back in three months using that method. You can keep posting it as often as you want, what or may not have happened in one particular case doesn't mean a thing. People get their children back for all sorts of reasons, insinuating to CPS and the family cour...

I thought you never signed a service plan It wasn't a service plan, it was an agreement that we could only have our children returned under the terms of that agreement. There were 3 service plans that my wife signed that I didn't sign, those were very specifically service plans, this one wasn't, ev...

I certainly don't know everything but I never heard of a case where the CPS victims negotiate an agreement with CPS, they dictate all the terms, take it or leave it. We were handed a BS agreement that we had to sign in order to get our children back. I wanted to sign it with "UNDER DURESS" under my ...
