Re: Can CPS tell a parent to live with a specific person?
When you consider there is a lot going on besides the fantasy of well intended workers seeking reunification, you can see that there isn't a direct relationship between compliance and reunification. It was explained to me that they always asked for TPR along the way as a C.Y.A. standard practice. Th...

Re: FAQ/FACTS AND QUESTIONS
I am not an attorney and this isn't legal advice. Maybe you can find a way to get the older children's statements heard. Maybe a motion or petition by you is appropriate. OR It sounds like the kids need their own legal counsel. They get one during DCFS cases. Unless you are squeaky clean, you don't ...

First, count the positive things: Your kids are with a relative. You still have some contact. The DCFS case is closed. You maintained parental rights? "now its just the GAL and the courts." <----celebrate that. Now, it is a custody case. You can look into the benefits of changing the venue...

Depends on the state but she should be able seek some sort of "relative placement". Also depends on timing. If it has been a while, they are less likely to move a child. Guardianship may be an option, too. I paid for my aunt and parents to try that. It was $5k in one state and free in anot...

Re: Can CPS tell a parent to live with a specific person?
The agency will almost always move toward a TPR hearing as a matter of course, standard operating procedure. My ex had been a foster child and she was on prescribed oxy for failed back surgeries; that's all the red flags they needed. Furthermore, she is a narcissist sociopath compulsive liar and I b...

Re: Can CPS tell a parent to live with a specific person?
They can't tell you what to do about such things but they will punish you if you don't comply. Nowhere, nowhere anywhere, in my lengthy case did a report or worker ever say that I should leave my wife. But, that was exactly what they wanted. I was blunt and honest with my attorney and he gave me the...

(I'm not an attorney and this isn't legal advice) Yup. We dealt with an investigation because my autistic step daughter told a story about a movie we watched. She would "script" to express feelings. The movie scene included a punch to the face in the film "2012" While I'm as para...

You have to obey and follow the rules, they don't. Yes, they get extra money for siblings, in protective custody. There is extra money for kids "diagnosed" with something and medicated. I fixed up a friends house for placement, never got inspected. We moved and maintained another 4 bedroom...

While the case is open make sure your home is literally spotless. Even a dirty dish can be twisted and used against you. I've seen it happen. If they close the case without taking your children consider moving out of their jurisdiction. They sometimes will come back and your previous case will be u...

My ex had a long, horrible, history with CPS as a child.
Throughout our case the workers used that as evidence against her. Eventually, she got to explain in detail why that motivated her to fight everything they were doing.

I was only involved by phone, not allowed inside, which shows how important I was to the team. I simply announced my objections where appropriate. Like any other action, it will be used to further the CPS narrative, regardless of your words. They get to help each other rationalize what they are doin...

Obviously, never post another word on those sites. (except to warn others) Yes, they have a case, because they want to. They are saving children from us terrible parents, that are just too human. They don't need more than suspicion to force their way into your life; and cops will stand behind them a...

Yes, they could very well intend on taking the child because of your history. Eventually, there will be search warrants and wellness checks. 2 babies were born during my case. Both were taken, never got them back. The only things that slowed CPS down was Power of Attorney and a guardianship case. We...

You have given up many rights already. You agreed to their plan. I relate to your story. We had 18 dogs at one point right before the CPS problem. Toys and clothes everywhere..... You could be my ex, the way you describe the drama. Choose your kids. You really could lose them over this. Choose the k...

(I AM NOT AN ATTONEY AND THIS IS NOT LEGAL ADVICE, JUST STUFF I LEARNED IN MY CASE) Social Workers are not your friend, assistant, or obligated to offer any support or help. https://protectingourchildrenfrombeingsold.wordpress.com/2010/03/16/best-practices-in-termination-and-adoption-cases/ I found this with google. Seems like you'd have to show the conflict of planning for "likely" termination vs the obligation to support reunification through reasonable mean...

Re: I need to know if I have a case against cps..
First, recognize what has gone better than it could have. A. You don't have an active CPS case. B. Your children are with a relative. C. You still have parental rights. D. You haven't been served for an action by your mother. E. You have some contact with the kids. F. The law is on your side when yo...

Their job is to find kids to take away and adults to drag into their system. This may have nothing to do with an allegation but I doubt it. Any contact they want to have, is to do their job. It is very similar to a criminal investigation. You need to find out what they are investigating without givi...

Re: Justice for Poor People?
It is unclear which battle you need to fight. If there is a CPS case in either state, that is your battle. If the CPS case is over, and you still have parental rights, then this is a visitation or "move away" custody case. Because the child has been in CA so long, they can, and will, go to...

When my ex was facing felony charges, we were able to use the criminal attorney as a friend of the court in the CPS case. That attorney was able to walk in, talk to the judge, and crush the CPS lies. He had access to all the evidence, experts, and a respected opinion. So, he was able to simply "...

Re: Lost in a system!!
You had several options in the beginning but some may be gone now. There may be room for an appeal, of some sort, if Utah made an error in procedure. Relative placement, guardianship, adoption. The relevant relationships (legally) were bio mom and bio-dad. Utah should have considered you for relativ...

At some level, yes, they all get paid from the same pool and they are all part of the same club whether it be County or HSA. However, they are considered to be honorable and capable of acting in the interest of their client. In practice, I saw the private attorneys behave more assertively than the &...

Yes, some of the truth eventually gets told. Yes, you are the only person you can trust to keep track of the details. I took outlines and timelines of the case so my attorney would remember what was happening. At my 18month hearing I testified and was finally asked the right question. There were gas...
