Re: Cps visit

Yes, it is legal to record the conversation. They may return to take the children. The best way to handle this is to hire a lawyer if you can but if you go to court they will have to appoint a lawyer for you if you're low-income. The court appointed lawyers are often not motivated to do much to defe...

Re: soon to be ex accused me of harming my son

This is wonderful news. I especially like that the judge wants to see a motion for unsupervised visitation. I think it is clear that the best thing for your son would be to be released from all the crazy unnatural restrictions. Things are going in the right direction. I'm glad that posting here has ...

Re: Any advise how to get custody of my granddaughter in GA.

Awesome. I'm glad to hear you're being proactive and creating the legal documents you need to impress a judge. CPS workers are sometimes shocked when someone knows what to do in a courtroom, because most of the people they deal with are defenseless doormats they can walk on and abuse.

Re: Mother in the dark

Hello again. I am so sorry you feel you can't afford a lawyer because you get only one chance to get your baby back again, and it sounds like you've got a evil and corrupt CPS worker who is working against you and persecuting you. Can you please find a drug expert to tell you when the baby would hav...

Re: Cps visit

Jimmy, yes, the kids can be removed whenever CPS workers want to. You could try to say that there's no immediate need but you might have to prove that to a judge. In general, there's a presumption that if there's violence in a relationship between parents, the children are in danger. You might want ...

Re: Any advise how to get custody of my granddaughter in GA.

I don't think she can just fire her lawyer - but she could tell the judge she wants a change of attorney because of lack of representation, or something like that. In criminal court people have to request a Marsden Hearing - and that's been tried in Juvenile Court too. Your notes on your daughter's ...

Re: Firefighter who helped save lives needs help now!

Sounds promising - especially with witnesses to his past history. I would like to have the expert witness on board, but at this point all you can do is trust the lawyer. Usually they are wise enough to suggest the right things. Thanks for the update.

Re: Any advise how to get custody of my granddaughter in GA.

I'm glad she has you to help her. About getting kinship care... there are at least three ways to proceed that I can think of just now: 1. Get a lawyer and try to get a judge to side with you. 2. Call the state dept. of social services to request an administrative hearing based on the issue that kins...

I hope you can invest in getting a lawyer to help you. Most child dependency lawyers offer a free introductory consultation. Even though you're not going to court a good lawyer could find ways to help you.

Yes, they learn to be manipulative because they want to win their cases in juvenile court.

How is your daughter doing now? Has anything changed for the better?

Re: To be guardian for my niece do i have to give dna!?

I've never heard of them asking for DNA. Can you prove a family relationship? From the social worker's reluctance I'm guessing she either doesn't like you, or she wants a specific foster family to have this child. Do what you can to prove the family relationship with birth documentation - and also, ...

Re: Phone call contact

It might be best to not allow them talk to their mother right now - even though it is cruel to the children and the mother. The reason why is that you don't want the caseworkers to lose faith in you, and take the kids to foster care. You can ask the caseworker if phone calls are okay. She might say ...

Re: soon to be ex accused me of harming my son

Hearing your good news about visitations (after all you've been through) gives others hope for the future. I'm so glad you're able to see your son again - and you're probably right, this is only one step toward being allowed unsupervised visitations in the future.

This was so long ago I can't remember all the details... but I think they beat the charges by hiring a well-respected expert witness to review the x-rays. Do you have any expert witnesses working for you?

Re: Hospital visit turns into CPS/Police investigation

There are a lot of people who went through similar cases and beat the charges. I remember one case where the supposed fractures never happened. That's why those x-rays are so important and your criminal case lawyer should be requesting them, right? Hasn't that been done yet? Doesn't the whole case r...

Re: Shelter Hearing

Who presided over the hearing if the judge wasn't there? Sometimes they appoint a juvenile court referee who is a lawyer. Did the parents sign a guilty plea or stipulation in court admitting some kind of guilt? If they did, the hearing is over and the children will remain in foster care until the ne...

Is the foster family trying to homeschool your child? Is she on independent study now? I don't see how they could just neglect her education entirely.

Re: Hospital visit turns into CPS/Police investigation

This seems excessive ... and have you ever seen those x-rays yet? I'd definitely get an expert to analyze them. Recently I had my feet x-rayed twice because I've had foot pain all year. The first x-rays supposedly showed a small fracture. Then I went to a specialist with a better x-ray machine and h...

I was going to ask how your 12 year old son feels about being adopted, but you answered that at the end when you mentioned him crying to be home with you again. Have you talked with him about the possibility of being adopted by his foster parents, to find out how he feels? They are putting you throu...

Probably they'd follow that recommendation, unless you had psychologists on your side of the courtroom saying the opposite.
