I can also point you to pro-spanking advocates, such as Dr. James Dobson. While he may be controversial, his credentials equal or exceed those of every expert cited in your links, firemonkey. I personally don't prefer spanking except in very limited circumstances. In my experience, there is usually ...

And guess what? If you have ever been in a case they have deemed abusive, including having a family member with a drug or alcohol addiction, they list that as a "pattern of abuse", and you're automatically suspect. When my wife was interviewed in my absence by the CPS worker, thankfully she wasn't f...

Good to hear the news! We can use you at all levels of participation, particularly with homeschooling/unschooling parents. Homeschooling itself is very poorly understood by most; and that is even more true of unschooling. You could be a VERY valuable resources for families that come by with problems...

Dazeemay and Bob, I HIGHLY recommend BOTH of you see if you can get your hands on a copy of Michael Badnarik's book "Good to be King" (best to buy, you'll probably want to highlight several sections). It will change your perspective on the Constitution entirely. As a historian, who is generally well...

I have thought of a roundabout way that a search can be conducted by court order. If a judge issues a subpoena to collect a certain item of evidence in a case, I believe the judge can direct police to enter a home and search for and retrieve that item. Someone please correct me if I'm wrong. That's...

So why not, instead of all this nonsense bickering WORK TOGETHER to get the information out to people. Fighting back and forth is counter productive. Trying to change laws is great except that still doesn't gaurantee they will be followed. Yes we all have civil rights but unfortunately when CPS get...

Why I WANT to See a Family in an Appeals Situation
NOTE: This is not meant to be argumentative, but a counterpoint to Dan's article explaining why he never wants to see a family in an appeals situation. I respect Dan and what he does, but we operate from two entirely different philosophical bases, and ultimately, it is up to the individual to decide...

This Amendment is most commonly brought up with regard to CPS violations. There are only 4 ways CPS may be able to search a home and/or seize children: A warrant, a court order, imminent danger and exigent circumstances. In some states, such as Pennsylvania, only the first 2 are authorized. CPS vio...

Is there NOTHING to be learned from what these people have done? See, this is where you lose me, Dan, with all due respect. What you seem to be saying, essentially, is that the ends justify the means; e.g., as long as your children are returned home, it doesn't matter that you must spend the remain...

If they said they could obtain a warrant, it was a clear bluff. Reason? Because, not only does the fourth amendment require warrants for entry, it requires they be "supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized". You ca...

examples? I could give several. If the children were interviewed, or the home was entered without a warrant, consent, or exigent circumstances, there's a clear fourth amendment violation. Denyong the family's right to interview witnesses against them is a sixth amendment violation. Forcing them to t...

Someone might get that impression because you wrote Someone? Only "someone" like you who is apparently hell bent on insisting that the family court is not the proper venue to assert one's civil rights and that one should only assert their rights during the appeals process. "Someone" who doesn't und...

Re: You do not have to let them in without a proper warrant.
When my husband asked the ACLU about this same issue he was told that here are cases against CPS and pretty much that they were not going to take our case becouse of the number of cases that they have against CPS now. Just for the record, their "cases" against CPS are highly misleading. The kinds o...

Bob, I agree, too many times it seems like the same song, second verse. What we need to do as activists is to be in this for the long haul. We need to pound away and pound away until we can't pound anymore, and then keep pounding. I have seen attitudes slowly change on the individual level; we CAN a...

Since the initial charge is abandonment, going to Florida without her son would only reinforce CPS' case. It seems like this move would be the best for her long term, but she really needs to regain custody of her son before she moves. Even if she asked for the court's permission, the lack of contact...

Greegor, Yes. They try hard to get you to let them in because they can only enter your home one of three ways: warrant, exigent circumstances, or consent. If they are asking you to enter your home, you can rest assured they do NOT have a warrant or exigent circumstances. They will swear to the court...
