Will the courts drug test?

I have a question. Here is a simple run down. Two parents fighting for custody back from CPS separately. One has a history of drug abuse (proof of usage in 2013). If the parent with the drug history makes a great enough case to get the courts to agree to sign custody will they drug test that parent first? If its been stated that the drug use is "legal" forms found at smoke shops like Spice and Bath Salts can they specifically test for those? Thanks for reading! Yes they will test. They often do so at the court.
