Important Please In Need Of Help!!!

We have dealt with cps in the past. All of our cases have been closed but create a lengthy pattern of past cases that are unsubstantiated we have always cooperated. This time we are fighting back and exercising our legal rights refusing to let them conduct their investigation unless everything is done by court order only because were tired of being harassed. We have 4 kids, 3 in school, and 2 are disabled with medical conditions. The school and cps made up false allegations to use against us. This is 1st time we fought cps and not cooperated its been almost 30 days no ones showed up or done anything they wont tell us anything but they are working with their legal team. Its a child neglect case and we live in a small town in Ohio. We are accused of sending the kids to school in urine wet clothing and shoes for multiple days, moms on some kind of drugs but cannot be proven at this time, medical neglect, one of child stealing from others, not supplying pull-up's for 8 yr. old who's behind, saying no washer & dryer, washing clothes in the sink, stained feces on the kids clothes, lied about medical issues saying our oldest has a kidney disease leading to kidney failure other supposedly has unknown cardiac issues. When in reality our oldest has seizures and our middle child has (hlhs) Hypo Plastic Left Heart Syndrome heart condition which the school has knowing about since school started. We weren't sure how serious of a case this would be considered by cps. Not sure if there's enough evidence for court intervention. Cps refuses to get back with us and let us know any updates on our case its driving us nuts not knowing anything with what they are doing in our case.The cps lawyer in our area wont even get involved until the kids are actually taken out of the home first then she said she can then get involved but not before hand. Sorry about all the questions any and all help would be much appreciated thank you!!


1. Not sure what is going on with our case is it normal for cps to ignore and not get back with you for almost 30 days and not even try to show up or try to do anything but they have only been working with their legal team since we requested everything be done by court order???

2. The supervisor said if they cannot get court intervention next step would be to close our case will they usually tell you the next step or could they be bluffing about closing it???

3. Does anyone know what type of case as far as seriousness a case like this would be considered as low priority, or medium priority, or high priority. Serious not serious???

4. Unless since its 30 days and nothings been done does this mean there is not enough evidence to pursue court action for warrant and or court order.

5. Wouldn't they of been able to obtain a court order and or warrant within the 30 days before now???

So cps has provided you with written notice that they are investigating an allegation of abuse of your children (child/children must be named). Does the notification identify you as the subject of the investigation? As the parent, even if you were not identified as the subject of the investigation you should have been notified as a person of interest as the child/children's caregiver. Has cps contacted you aside from the initial notification (i.e., via phone, in person, etc.). Have they come to see the house, interview child/children?

My suggestions are:

1. Get a lawyer.

2. If CPS doesn't contact you, don't contact them. Thank your lucky stars they are not contacting you. Hope that they forget your name. In some states they won't even contact you to let you know they closed a case.

3. Read your state's social services regulations. Find out if there's a limit on how long an investigation can last. Keep a notebook and record all regulations they are breaking.

The allegations sound serious but if they already discussed this with you they may believe the reports were exaggerated. If your children are still with you it is clear they do not consider this a matter of "immediate need."

If they do show up make sure to video record them. Look through the articles on this site and you will find the one where Linda herself was harassed by social worker once they found out about her site. She ended up writing a letter to them and many other sources like newspapers, legislators etc. detailing each interaction what was told to her and what she replied. Once letters went out no one bothered her for years.

Because they can take kids away based solely on the fact that there were multiple investigations.
