Help Me Help Her

OK. The only way for me to get the right help here is to tell the story exactly as it was told to me HONESTLY; no matter how it sounds coming out. I'll answer any questions I can based on what I know and what I don't know I'll find out from her. Here goes.....

SATURDAY NIGHT - Two married adults "Jack" and "Jill" and their 5 month old baby and 6 year old son go to visit a mutual friend that lives with his parents. This friend we'll call "Dave" had a cookout and invited several people to his home. Children were running around supervised by "Dave's" wife and "Dave's" mother while the other adults sat outside around the fire waiting on the food to cook and drinking a few beers. "Jill" does not drink or do drugs of any kind but "Jack" will take pain pills. "Jill" has been trying to work with "Jack" about stopping the pills. "Jack" has a habit of sneaking and taking pills and coming home to "Jill" stoned.

On this night in mention, "Jack" spent most of his time outside and "Jill" was in and out of the house checking on the children to make sure they were ok, talking with "Dave's" mother and wife, and stepping outside to talk to the other folks out there and keep an eye on "Jack". She left a soda pop bottle of Mt. Dew beside her chair outside. She said when she came back to get her soda that she noticed it had a twangy taste to it but she thought it was because it got hot sitting next to the fire. Thinking nothing of it she drank about half of it. Later on, she started feeling sick to her stomach. She said she felt like she was extremely dizzy and hot and couldn't get cooled down. She thought she was coming down with something and then as time wore on she said she couldn't see straight which made her sick and throw up. She said that "Dave's" mother called EMS and had her escorted to the local hospital.

Once she arrived at the hospital the doctor's asked her what was going on with her. She said she told the doctor's she had no idea, that she had felt fine earlier but now she felt like she was dying; that she felt strange. The doctor's immediately requested a blood draw. The doctor came in and told her that she tested positive for Oxycontin and Xanax. They immediately told her that they had seen many people die from taking that type of medication and that she shouldn't take medication that is not prescribed to her. She said she told the doctor's that she didn't take anything. They told her she was in denial about her problem and they suggested she make an appointment with a local doctor to receive further treatment. She declined the referral and told them she'd prefer to go home and rest and that she was almost positive somebody had drugged her drink at a cookout and as far as she was concerned she'd start keeping her drinks in her sight from now on. The doctor refused to believe her and tried to get her to admit to being an addict. As she leaves the hospital with one of her friends that drove her home "Pam", "Pam" told her that "Dave" called the hospital and told the ER doctor that "Jill" was a well-known pill addict and had gotten into some of his mother's pills. "Pam" proceeds to tell "Jill" that "Dave" only did that to cover his butt in case "Jill" told the doctor's that he drugged her. "Pam" said she overheard "Dave" telling his wife that he only did it as a joke because he knows "Jill" won't drink and she'd want to leave the cookout early. He was hoping she'd knock out and fall asleep; not get sick.

MONDAY CPS arrives at "Jill's" door while "Jack" is at work. "Jill" speaks briefly with her on the porch with the 5 month old on her hip and the 6 year old staring at them through the storm door. The CPS worker has in hand 2 forms that have been filled out beforehand for them to report to the county health department for a drug test. The phoned in tip was from the ER doctor stating that "Jill" had consumed prescription medication illegally and proceeded to do so in front of her children. "Jill" told the CPS worker that she did not consume any medication by choice, it was slipped on her at a cookout by someone else and even gave the name of the person who did it. She also referred the worker to her friend "Pam" who is well aware of what went down but the CPS worker refuses to discuss the case or her involvement with "Jill" and "Jack" with anyone. They were to report to the health department on Tuesday but they did not go based on the fact there is no court order for the drug test.

WEDNESDAY MORNING CPS worker shows up at the door to find no one at home. She leaves a note on the door requesting a phone call from them and wants to know why they did not go for the drug test appointment that she set up for Tuesday. "Jack" phones the CPS worker and tells her that she is to investigate the allegations of the report NOT conclude that they are guilty before she ever talks with them and that she already assumed they were guilty of doing something wrong by having her forms filled out before she got there to ever meet them. CPS worker calls back and says, "I need to know that you are both clean." "Jack" says to her, "Why do you need to know if I'm clean? Your report isn't about me." CPS worker says, "Well normally when one parent is abusing drugs, both parents are abusing drugs. In the rare case that one parent isn't using drugs, they are tolerant of the parent who is. Now what time will you two be able to go down for the test?" "Jack" tells her, "And if the test is negative what are you going to do about it?" The CPS worker says, "If it's negative I still have to stay involved for 30 days and if it's positive I'm still there. Our main concern is if your drug test is positive we have treatment programs available for the two of you to attend and while you attend those we stay involved with the family to make sure that everything is going ok. Once you've completed those programs, we send you for another drug test and once we see that you can keep it together and stay clean, we'll close our case." "Jack" then tells her, "These kids are not abused or neglected and my kids were not in ER with her so I don't get how you people could even get involved. I don't recall the doctor ever asking my wife if she had children. I don't recall my wife ever getting into the topic of having children or discussing our chidren the whole time we were there. " The CPS worker interrupts to say, "Well I'm sure when EMS arrived they saw your children there." "Jack" says, "I don't believe that and if you do you need help more than I do. There were probably 8 kids running around that night and nobody from EMS took out a pad and pencil and asked who's kid belonged to who. I know better than that. And if they did, don't you think you'd be investigating more than just my family?" He said she got aggravated with him and got off the phone.

They have been avoiding their home during the daytime and only going home at night to eat supper and go to bed in hopes to avoid her. I don't know what to tell them to do at this point so I am looking for something encouraging to tell her.

Can they afford a lawyer? If so, then have Jack and Jill refer the CPS worker to their lawyer, who will then discuss the laws and policies with her. If the CPS worker insists on meeting, then the lawyer can set up a time and place outside the home, to sit down and discuss these charges.

The CPS worker actually told them the doctor called it in? If she did, that right there is a no-no, and that would make me rather suspicious of what is going on.

Also, they should get a copy of the policy book so they know exactly what she can and cannot do. I find it hard to believe that without any proof of abuse of pills, this woman is forcing someone to take a drug test. Whatever happened to privacy?

I agree 100% with Scarfyyre. Jack and Jill MUST get a Lawyer immediately to protect their "Interests". They are already in really bad Hot water. They must get these drug tests court ordered.

I would suggest Jill to go to the Police Station and file charges against Dave for slipping drugs into her drink. There are so many People slipping drugs in the drinks. There were Date Drugs slipped into Girls' Drinks at the Bars, the problem is they don't know who did it. But now, if Dave admitted to "Pam" that he did it, the burden of proof is upon him. Charge him for giving Jill Drugs in her Drinks.

I think Jack and Jill should sue Dave for the Pain and Anguish that they went through for a "Joke" and make Dave pay the monterary Damages. Do this Later when the CPS Case is Closed.

I don't know what else, but Jack and Jill DEF. needs a Lawyer immediately. Because they could very well take the Kids away from them if they refused Drug Tests. If they did Drug Tests anyways, CPS Workers are KNown to make up Lies and saying it would be positive. Drug Testing, they always make them "positive", SO they can keep Jack and Jill on a Service Plan, go to Services, Treatment Program. It costs money, and that is why CPS wants funding coming in, by using them. Well, Jack and Jill should request these to be court ordered, and have CPS PAY for the Drug Testing, NOT them.

oh, my looks like they are in a bad Hot water already, and deeper trouble. IT would be difficult to get themselves out of Hot water. They need a Lawyer and have the Lawyer do the meetings, and meet them at the Office, etc..etc...negoitate with them. Tell Jack and Jill to tape record a Telephone conversation, or tape record the meetings in the Home if it happens, and tell them to write everything down and keep all documents for evidence. They need to prove that Dave is the one that slipped the drugs into her drink and that is PAM as a Witness. It is a sick Joke that Dave pull them through unnecessary treatment, I sure hope CPS is AT DAVE's Door! to investigate them too! He is the one that put drugs, so he is the one that is a trouble maker indeed. I would sue his arse off later on if I were Jill. I would go to the Police Station and charge him for putting drugs in my Drink! grrrrr that is horrible! It is not funny at all.
