I had a talk with a policy specialist today for the state dhr office. of course, i got alot of crap slung at me.
Here is the meat of it, they are blaming the judge why my case is court, sexual abuse has been unsubstaniated, but failure to supervise the children has been substaniated. ok, here is what failure to supervise consist of, the fact that my husband is male and was left alone with girls. ok, so basically no female child can be left alone with thier father. they denied that, but said that my niece was a previously neglected and abused child that no man should have been watching her alone....ok, does that make sense, it was thier office that placed these children with me, it was thier office has been in and out of my home talking with these children, it was their office that knew my husband was the primary caretaker. so where is the fault in that, shouldnt it have been their office that informed us that there could potenially be a problem with this. no agian, it was there office that said he should have spent more time with this child, he should treat her as his own, he should do things with her becuase she needs a father figure....i asked does it mean that we keep all children out of part of our house, that we should say no you cant do this or go there, she stated to me that she did not say that, that we should have been more careful being this child was a previously abused child....ok, when i asked the placement worker back in 2002 about the abuse my niece had, i was told that no sexual abuse was confirmed, but they thought she may have just seen alot of sexual things. in 2006, they tell me that they have reason to believe that this child was sexaully abused and that i failed to get her counseling. ok, so how the hell am i suppose to know things? isnt it the caseworkers job to inform me of problems? isnt the caseworkers job to help me get the services? i think these questions go back to a failure of the agency prior to placing the children with me and prior to the removal. they should have gotten off there asses when the child was living with her father who was arrested for molesting another child and is sitting in jail right for aggravated child molestation and removed them then, they should not have allowed the children to a mother who was a meth addict. all they did is pass the case off to one worker after another and now the are forced to deal with this child becuase she wasnt happy with rules and regulation. i think that they just used the failure to supervise a way to say we screwed up before and now we have to make someone pay so it will not come back and bite us on our asses. i am mad as an ole wet hen and i just needed a place to vent. talking to someone over the phone is just like pissing in the wind, no one is happy when you are finished. i do have a meeting setup to discuss my case with the district supervisor. maybe something can get done and someone can get off thier asses to complete something.

It sounds like they don't know what they are doing and had no evidence of any wrong doing. lol

I would feel like asking them "which was it?" It is like they don't know which foot is on at, but had their foot in their mouths. lol

Do you have a Lawyer? If so, I would suggest you to bring your Lawyer to the meeting to make or hold them accountable for such inconsistency. :roll:

OH i did, you can believe that!!!! I was also called today to setup this meeting. it is called a family facts meeting. the caseworker even admitted today that she could not substaniate sexual abuse, so since the cant disprove it either, they came up with a lesser abuse charge and substaniated it. sounds kinda of fishy doesnt it. i called my attorney and she told me that this meeting is an ambush to the family both his and mine to try to turn them against us and maybe confirm the sexual abuse by getting one of them to talk about it. my attorney feels kinda strong about going back to court, it looks as though they have broke their own case. she said if she would have know all this she would have asked them on the stand. dfacs also did not have answer for me on why if they did not substaniate it why they can keep bringing it up, there answer is that it was a past allegation and they have the right to bring it up. she started quoted the fact that all they need is a preponderance of evidence, which is a lie, in the state of georgia you have to have clear and convincing, which is more than preponderance. my attorney was really happy about all this, she said it is funny and as soon as i finish this counseling, we can go to court. she also told me that in this meeting they think they will turn family member against you, but it can also turn on them. she told me to give the hell and make sure not give them any ammo against us. dfacs has asked that i provide them with a list of people who will attend this meeting. so how many people should i invite? i have about 15 family and friends who want to attend? is that too many/few? i could probably get more.
i am really upset with them, but now i have a fear that they will come after me harder and take my children for standing up, of course that will probably just piss me off more and they will feel my wrath a little harder. right now i am holding back, trying to keep my sanity, but they are about to send me over the edge.

Oh that is wonderful!! that is great that you are thinking and recorded that. ha haha make sure you keep the tapes in a safe location where they cannot get to it.
Seems to be that you are on top of things. Great! Just keep on fighting for what's best interests for your Family. :wink:
