Met with my new therapist today for the 2nd time. He said my psych eval makes no sense.

The psych eval diagnosis says borderline personality disorder, but in the report I meet non of the criteria.

It recomends that I attend a class for attachment disorder, yet it says I have a healthy bond with my childern.

It expresses concern that I played with my children more like an uncle would and was not aware of the dangers, (I have boys who like to rough and tumble) But that I had compleate controll over my children and excelled in transitioning them from one activity to the next.

This therapist is very conserned about the way it contradicts its self.

But how do I disprove it?

I wouldnt think you would have disprove anything it sounds like the person who did your eval was the one with personality disorders. I would ask you lawyer to point out everything you just did in court.

I'm going through something simular right now. It was my daughter who got the messed up eval. CPS sent her to thier woman to get an eval when that came back to my daughters therapist she was stumped. She compaired that to a year's worth of therapy notes she had and combed the file for any matches and could not find any. So it was suggested that I have another done with a nother evaluator. I did. When it came back it made sense, the problems in it were the problems that she actually had and needed treatment for. It was also suggested that she receive an eval from the psy doctor to see what he had to say and if any meds were needed. The eval from him was close to the second eval and he put in his eval that the first one was inaccurate. So that was 2 evals that were close and one that was far off. Then I was told it was not the first time they encountered a problem like this with this evaluators work the said it was up to me but she is licesned, and the board can check into it. (Kinda like I can't tell you to file a complaint but hint hint wink wink do it)
My next step was to contact the board. I googled "WV psychological lisencing board" and got the wv psy board. Right on there was the complaint form. I emailed them to find out if she had any complaints what actions were taken and what her # was. They gave me the info and a form with the process rules. I'm in the process of filing out the paper work now and will probably mail it out in the next few days when I'm sure I have everything in it. I'll keep you posted if you want.

it is my understanding that the psychological exam done by a state therapist is just to find any trouble points and point the state in the direction of offering services. i was also told by several psychologist that the state tries to use them as an absolute diagnosis and that is not what they are for. no one evaluation can tell if you are bipolar, suffering from ptsd, etc... basically the first intial evaluate is just an evaluation, further therapy is used to explore the possiblities that are found during testing. only thing is the state often doesnt want to explore it, they just need ammo for court. the only way to contradict their finding is with one of your own, so bascially it become my expert is better than yours. another way is to discredit the person doing the eval. most medical state boards have complaints online for doctors, therapist, etc. you can see if any complaints have been found. if you like you can file one yourself.

That is true. I was also told the same thing. An evaluation is simply a snap shot of that person at that point in time and how the evaluator preceives it. Nothing more. It makes recomendations as to how to proceed and further explore that conclusion the evaluator came to. Example they say in the report you are boarderline personality disorder, they send you to therapy, after several sessions the therapist doesn't see it. That dx has been explored and found to be untrue no treatment needed for that problem.
The problem is that cps workers are NOT specialists in the feild of psychology they basically don't know what they are talking about. So they take the psychological and misuse it to fit thier agenda. To them it says it in the eval so it must be true it must be the case and needs to be treated. I've talked to several therapist and they all tell me they get pissed went they get a court order or cps worker call them up to say so and so needs therapy once a week for... Well that is thier patient, they know thier patient and they should be able to make the recomendation as to how much therapy they need or don't need and it is unethical for them to treat a patient for a certian thing when that is not what they have. In fact a therapist cannot treat you for boarderline personality disorder when in fact you don't have it, not if they want to keep thier licesence! You can report them for fraud.

All in all I would get a second opinion and maybe an eval with a psychiratist. Then you have 2 opinions to contradict the first bad one.

My worker has called me all kinds of derogotory names due to that eval, unfortunatly she caught me trying to record her when it it got bumped and started playing it back and she made me delete it. :x

Thankyou, I am going to call the Psyciatrist who I go to on my own outside of CPS and see if he will do one. Cps so far has refused to acknowledge any thing he has said, like the fact he thinks I am stable on my anti-deppressant and does NOT want me to stop taking it. CPS says I am addicted, despite the fact you can't get addicted to cymbalta!

Please keep me up to date on your complaint. I could possibly use help wording mine as well.

You know you do have a right to request a new worker. You need to call the workers supervisor and let the supervisor know what is going on at very least. You can also go directly to the office she works at and request from the receptionist a complaint form they must have it on hand in the office to give to you. I would make sure if you do complin to the supervisor you do it by cert letter and keep a record for yourself. If you file a formal complaint photo copy and keep one and send the other back by cert mail.
The worker has no right to "call you names" nor can she make you delete your recording if it was legal for you to record in the first place. You could have just told her to leave and you would be playing that for the judge in court if she did not. That is harassment.

Yes I know, I have done that and it didn't do any good. The supervisor said she thought my worker was just fine, and I needed to stop excpecting her to be my "friend"

On the brightside, I was able to scheduale a psych eval with a diffent person not related to cps. The soonest they could get me in was 4 days before court. I hope its not to late.

They won't have the results back if your taking it 4 days before court. The quickest I seen one come back was 3 weeks from the time it was taken. They have to sit down and go through the whole thing and some send off the answer sheets to a company to "grade" them. What you can do for court is get a letter from your therapist saying the eval is inconsistant and that he/she feels you need treatment for xyz or that you need no treatment at all. He/she can write a recomendations stating "My patient (you) has been seeing me for .... (amount of time) and I feel she had (the diagnosis) and we are working on that in therapy. I recomend that she (continue/discontinue) therapy for (dx) and go (frequency of visits) to help her work on this problem." Or something to that effect. Some judges will respect that others only care what cps has to say. Either way you need to get that in. Not to cps but to the judge and your lawyer should know how to do that.
As for this workers supervisor No you should not expect the worker to be your friend but she should not be your enemy either. She is a person who is supose to help you help your family. That is her job. Your supervisor also has a supervisor you may want to go to the next level and tell that person you made a complaint to the supervisor of your worker and they did nothing. State what he told you and then say I don't expect this woman to be my friend. I expect her not to be little me, degrade me, and act as my advacery. I expect her to follow the recomendations of my therapist and provide me with the services I need to get my children back and nothing more. I expect to be treated as a human being.

I doubt the scientific validity of psych evals in general.

Cross examine the heck out of the psychologist.
