CPS IS HORRIBLE!! PLEASE HELP

HI, I am a grandmother, watching my daughter and her fiance go through HELL! CPS took there 2 babies, after a trip to the ER. when the baby was having trouble breathing. the 6 mo old had a couple small bruises on his head from the oldest trying to share a toy and hit him accidently. that sparked a investigation.They say the found unexsplained old fractures. CPS swooped the babies away in the middle of the night, brought them to me, and then a wk later took them from me claiming a police report i had 5 yrs ago. meanwhile, CPS has already judged and convicted them both for being guilty of abuse, niether have a clue what happened. I have done massive reasearch since, and found a VERY good possibility of what could be wrong. the baby fits all the symptoms of OI- brittle bone disease, but CPS doesnt want to think anything BUT abuse.this story could go on and on.....but, our defence was , we wanted to take the baby to a unbiased dr. who specialized in OI. Well somehow they found out and now have "tainted" the clinics opinion i believe. Is that even legal? can they cloud the opinion of the "unbiased" Dr.? They are blocking EVERYTHING we try. also, how can my daughter get help, shes been appointed a lawyer for cps, but cant get a lawyer until shes been charged with abuse. therefore NOBODY can advise her on the process or what to do, what to say, or how to help. She, and I her mother are TERRIFIED that not only is she loosing her babies, but she will be charged with something she knew NOTHING ABOUT. OI is the ONLY chance. and from my reseach, it is REALLY COMMON, specialy in premie babys. PLEASE ANYONE WHO CAN, HELP!![/i][/b][color=blue][/color]

I predict that CPS will ignor the brittle "bone issue." During our case there was a BB case inwhich the father went to prison for 4 years. The same doctor that CPS used against us they used against him. Started with an accusation of 18 fracture but there was accually only one. And of course the baby was premature etc. We actually had the same lawyer I found out and they were refusing to do the tests for BB.

I don't mean at all to be negetive, but you just woke up to the nightmare. There are alot of good resourses here and people that share your experience and want to help. I'll try to fallow your case as you post and help if I can.

Contact State Senator Pam Roach. She is doing much to fight CPS for Washington citizens. ALSO----do not wait to have an attorney appointed. Hock the farm if necessary. Get your family a private attorney now.

Its been over 3 months now, and They have refused to do tests for Brittle bone, OI. Even tho its been court ordered. Cps keeps pushing dependency, and also haven't followed through with any tribal help. The children are now in there 6th going on 7th foster home. They were taken from the last home because of massive bruises , which the Dr. decided were "abuse" and wouldn't let them return. But do you think there will be any consequences? WHO'S GOING TO BE ACCOUNTABLE for CPS abuse? These children, my grandchildren, are being abused way more since being in CPS care, than any of the allegations that were made. BUT NOTHING WILL BE DONE! these people are ruining our entire family, and we cant do a thing! P.S. All this without ever seeing any xrays showing the fractures, how can they even pursue this without some kind of evidence? It went from 1...2 ,now 6 unexplained fractures. but where are the xrays or proof?

Have you tried to contact the tribal office?

Heresay is not enough as you know. I have no idea on this type of issue. Just enough to ask you the two questions.

I found this much A tribe must be notified about any involuntary child welfare proceeding in state courts involving a child subject to ICWA and has the
right to intervene in such cases.

States and tribes share jurisdiction over child welfare proceedings involving a child subject to ICWA who does not reside on the tribal
reservation. If a tribe or parent requests that a child custody proceeding be transferred to the jurisdiction of the tribe, the proceeding
should be transferred to tribal jurisdiction, unless either parent objects to the transfer or good cause exists to not transfer the case.
The tribal court has the right to decline any transfer request.

Definition of a child subject to ICWA
ICWA defines a child as Indian if he or she is a member of a federally recognized tribe or if he or she is eligible for tribal membership
and is the biological child of a tribal member. A child who has some American Indian blood, but not enough to qualify for membership
in a federally recognized tribe, or who is a member only of a state recognized tribe, is not subject to ICWA.

I agree, CPS is horrible. They have outlived their usefullness. It's like the post office hired postal workers deciding what to do with you children. Technology today is such that anyone who suspects abuse can notify police, doctors, nurses, specialists, etc... Think of all the tax payer dollars we could save by doing away with CPS. My suggestion is comply extremely and make friends with the case worker. I know it's hard but do it. Ask if there is anything else she or he thinks you could do to make things safe. On the down side, protect yourself. Get documents, pictures and record everything with a micro recorder. CPS is hard to fight. They are a large entity. You could spend thousands and it wouldn't do any good.

We ourselves are involved with CPS. I intend to smile and take it up the tailpipe but on the back burner, I'm fighting.

I am not sure if this is where i should post this or not, but here goes. This situation gets worse all the time, the children have been in 7 diff homes, been abused worse in cps care and removed from the homes, now those homes are under investigation, my daughter meanwhile has been doing everything in her power to comply, the caseworker has stated she really likes and doesn't think my daughter did anything and that shes a great mother, the father on the other hand is another story. He since has gotten into trouble and went to jail, great representation of a changed father huh? yeah were all just as impressed believe me. Anyway, cps was trying to get in home dependency for my daughter, until the boyfriend got out of jail, then everything changed. They didn't give a reason , but, its beyond obvious. the cps worker, who tried TO REASSURE MY DAUGHTER THAT SHE WILL GET THE KIDS HOME SOON, ETC, Just came to my daughters job, told her the detective said that because nobody can figure out what happened to the baby, where he got unexplained fractures, that he was going to charge them both. This cannot be! There is NOBODY who is out here to help!!! her public pretender isnt doing a thing, there is NOBODY out here to help. WHO FIGHTS FOR THESE PARENTS? WHO HELPS? COULD THIS BE A SCARE TACTIC FROM THE CASE WORKER? Why has it taken 6 months..no interviews or investigation on the part of the police, just cps opinion. CPS hasn't done anything but ruin another family's lives! i REALLY NEED SOMEONE TO HELP! this is killing me to watch such corrupt ways tearing my entire family apart. whos accountable for the abuse CPS causes, or the abuse inflicted on the children in CPS custody? If that happened at home, that would be reason for removing the kids, but since its cps, its pushed aside and forgotten about. Its way beyond rediculous, its a nightmare, not getting any better. the children need to be home with there mom, cps knows this, has stated this, then switched up and make a trip to her job to scare the crap outta her, saying she could be arrested at any time. PLEASE HELP!!!! I could go on and on, but this is just so ridiculously insane. Unbelievable how much craziness and insanity cps can inflict on people. CPS needs to be shut down!

This is ALL CPS.. the state that is doing this. no help from ANYONE! Only public pretender, who isn't advising..guiding in any way. Does anyone know of anyone who can advise? because being thrown into this, is so mind boggling, and very hard to know what the right move is. One wrong move and they kids could be gone forever. Thats what is scareing us all, my daughter is told she has to sign the dependency papers, but if she does, there is a chance they could take away her parental rights perm. The state is at a stand still because they saposably have these unexplained fractures, and cant prove a thing. detectives have saposably been investigating the criminal end, but havent interviewed anybody but CPS, and 5 min with the parents. THERE HAS TO BE SOMEONE WHO CAN ADVISE. They defiantly need a pro bono lawyer, to sue the state of Wa. these children have been abused more in the CPS care, than any allegations. They want to hold people accountable for there actions, ok, but whos accountable for CPS abuse against these children? If these things were going on in a home, that would be reason for taking the children, but since its cps foster care, its all OK. PLEASE.. if anyone can offer ANY advise..PLEASE, PLEASE DO.
