NEED URGENT HELP

My name is Jason, I am writing you in hopes that you can either do something to help or point me in the right direction.



My sister has three children, five years ago the state of WV kidnapped her children from the school under false pretenses. At that time Tammy’s family home had burned and the state alleged that she failed to seek medical attention for her three children, thus there reasoning for taking the children before any court order had been issued. Once the case went before the judge the CPS claims were found to be untrue, however the children were never returned to there mother’s custody. They instead launched a full out assault on Tammy and five years later have stripped her of her parental rights to her two oldest children and have placed the children up for adoption. Through all of this Tammy has done all that the state required of her and yet no home visits were ever done, no investigations into any of the allegations was done. Jerry Davis of the Lincoln County CPS office has been the captain of this shipwreck and has made this his personal vendetta. I moved home from Indianapolis to lend support to my sister in all of this but continue to run into one wall after another. Judge Pratt, the presiding Wayne county judge in this case made a direct statement the day he passed down his ruling that I find odd for a judge, he stated that he was tired of hearing this case and wanted nothing more to do with it.



On a side note, Tammy’s daughter sends her emails from time to time begging to come home, her son sought out Tammy’s where-a-bouts and ran away from the foster home to come and be with her. This is not a case of kids mistreated and in need of rescue. This children love there mother and want to be with her. We are all loosing hope and in desperate need of help.

The only thing left to do is to get a true lawyer who fights cps cases and one that is not in your county. I am sure he will see that see a big fat nest egg of a lawsuit coming your way. There are so many case laws that he could throw at the court in your sister's case.

Now finding one is the difficult part. Not just any lawyer will do as far as I am concerned because you have to know how they operate.

If you find one I would suggest handing him over every case law you can dig up and present to him or her. This will hopefully nudge him to consider your sister's case. There are case laws about TPR cases that the court or courts have overturned and the children were returned. This is all I know to do. I will be willing to help you locate these case laws if you decide to go this route.

If the children are up for adoption, can you offer to adopt them?

Use the Freedom of Information laws to find out everything you can on this Jerry Davis.

Ask for his internet history, his email history, etc.

Go to your state gov. website to find out what the FOI laws are. Then do a general internet search also, putting "west virginia" in quotes to distinguish it from Virginia.
