Our story, WIC, Seeking info on filing lawsuit against a MR

Washington State. New to this site and trying to navigate through it. I'm looking for answers for our case. We are only being investigated by the cps at this point. Our child is safe at home with us, but after reading countless stories of children being kidnapped in this most preposterous way, my husband and I want to gain as much information as possible to protect our family. Our story is: A few weeks ago I took my 2.5 year old son to a routine WIC appointment. The woman we met with was new to us, we talked for less then 10 minutes. WIC always weighs and measures children and then a brief discussion. My son has consistently been under the 5% for weight sometimes not even making on to the WHO chart. He's a little guy. He is however, a typical, very active happy two year old, with exceptional health. When he turned a year old our pediatrician gave him a "failure to thrive". She recommended a GI specialist for him and I asked her if she thought he was sick and she said no it was just a precaution. I took it under consideration and decided not to take him because my son is in perfect beautiful health (clearly thriving) and I have no wish to subject him to any unnecessary tests. So at this particular WIC appointment I mentioned this when she was concerned about his weight. I have had this same discussion with other WIC employees. We talk about about food and how difficult it is to try to feed an active two year old and then move on. This particular time I said too much to the wrong person and she took what I said completely out of context and without a full picture or evaluation of my sons apparent good health and normal behavior, took it upon herself to report us to CPS. Medical neglect. And as everyone knows this now has been a complete nightmare. Thankfully through this and other websites we were able to educate ourselves before the first meeting with the CPS troll. We did NOT allow her into our home and we were very guarded about what we said to her. She tried numerous times throughout the interrogation to get inside or talk to our son alone. She has accused us, harassed us. Coming to our house, phone calls and then two days after her first visit she brought the police. I was home with my son, my husband (who I insisted be present at every interview) was at work. I went out on the porch to talk to the police as my son was asleep and I didn't want to awake him. I ended up arguing with them for 15min. about how and why they could enter my home w/out a warrant. In the end they said if I didn't step aside they would arrest me. They said they didn't need a warrant because they were there to "check on the welfare of a child". I later realize that the CPS troll had to have lied to them and said my son was in "immediate danger". Which she clearly saw he was not. Once they saw that my son was just fine and we don't live in a pit of despair they backed off. They saw that I was resisting them not because I was hiding a severely malnourished neglected child but because I was mother protecting her baby. I've talked to several attorneys about what is happening and none of them think the CPS has a case against us or this will likely develop into a case. Which is somewhat comforting, however my husband and I don't want to take any chances and are taking this very seriously. We are being proactive and wish to protect ourselves in every possible way.
Does anyone know any precedent of suing a "mandatory reporter" for slander and/or false accusation? We plan on filing a formal complaint about the woman at WIC who reported us. Does anyone know how to make a complaint effective? Or to which office or agency would make a complaint most effective? We strongly feel this woman should be held accountable for making such a serious accusation with little to no knowledge of our lives. If any one has every done this or heard of any complaints or legal action against the person that made the call to CPS, please advise. Specifically a "mandatory reporter".

There are Federal Laws governing CPS and then there are individual State Laws/Statutes/Codes which vary state to state. You didn't mention the state your in which would be most helpful.

In reading about your concerns I have to agree that your very perceptive to take this seriously. CPS is nothing to take anything less than 100% seriously since they have tremendous power and discretionary powers to make subjective decisions. That being said, about the only advice I could offer without knowing what State your in, is that you may want to reconsider taking your son to a specialist, at least for a once over and consult. You indicated your sons pediatrician has designated him as a failure to thrive and that leaves you in a vulnerable position with CPS as they can try to spin it as Medical Neglect. I don't know when your son last had a check up but you also might want to schedule a physical for him to get him a professional clean bill of health. You will want to look up the statutes governing CPS in your state as well as your states definition of Neglect to see where your situation falls into/or not into your States Definition. Aside from that I would also suggest you do an online search for your states CPS policy and procedures manual for information on how they conduct their investigations, time frame and such. Right now they are on a fishing expedition and apparently don't feel they have enough to remove your son which is not to say they won't try the moment they find anything they do not like.

If they show up at your home again unannounced and uninvited I wouldn't let them in and whatever you do, don't sign anything. If they are concerned for your son's well being, you can ask them to wait outside, go in, shut the door behind you, and bring your son outside so that they can see he is fine.

Washington state. First words of my post. Thanks for responding. I took my son to or peds doc immediately and she referred us to a GI specialist and a cardiologist, both whom I made immediate appointments with. His heart is perfect and we have a follow up appointment with the GI specialist. Even though I know my son is in perfect health and does not need to be tested because just because he is considered under weight (aka "failure to thrive). I showed the referral letters from our peds doc to the police and that I had already made appointments. The police then told me the cps (troll, as we call her) was outside and I should show her the letters to prove we were taking this very seriously. I now regret doing that. Also, at the first cps encounter we did sign some papers. The first was signing a paper that we weren't native americans and the other I'm afraid to say I don't remember what it was. She came unannounced, after she had cancelled our first meeting 6 minutes after she was suppose be at our house. My husband and I were dressed and ready for her. She wanted to make the appointment for the following morning and I said no because my son and I have to be at a class at 9am. she came anyways at 8:30am My husband was still asleep and my son and I were getting ready to leave. It was very intrusive and she disregarded our need to leave in a timely manner. She made it seem like WE were the ones not cooperating with her because we wouldn't cancel going to our class so we could be interrogated by her. Even though she's the one who cancelled initially. I am following up on every doctors appointment and also telling them that we are being harassed by the CPS. I also was clear that I was not bringing my son to see them because I believed him to be sick but to be confirmed that the accusation was unfounded and my son is healthy in spite of his small size. All three doctors we've seen have been sympathetic. My husband and I are looking for possible avenues to go on the OFFENSIVE with these people. We do not want to be sitting ducks waiting for them to dictate their terms to us. So far we haven't found a lawyer that is interested in helping us. We really want to have an attorney present if this progresses any further. Any advice or links concerning CPS Washington State. Parental rights, cases involving medical neglect or "failure to thrive" issues, I'm looking for any information that could possibly help us protect our son and ourselves.

Also, does anyone have up to date info on the death (or murder) of Senator Nancy Schaefer. In my research about CPS I came across this story and want to know more. It sounds like plenty of people believe her and her husbands death was not a murder/suicide as reported but a straight up murder to silence her, because of her outspoken stance on the CPS/child trafficking and proof that people high up in the Georgia government were profiting off CPS corruption. But there doesn't seem to be much more on the subject.

It's concerning to me that you have signed something and aren't sure what it was. I know how pressured these child protection workers can make you feel but really they have no authority to make you sign or do anything.

As long as your continuing to do the medical follow up for your son, CPS cannot come at you that your neglecting your child by failing to act or to follow up medically on his behalf. You don't need CPS coming after you for risk of harm or potential for future harm.

Thanks again for responding. And for the links, I'll look them up. I feel a little better getting support from people who know what we're are facing. I do worry about what we signed, I have my regrets. But I know I was doing my best under the circumstances and can't beat myself up for making mistakes or being manipulated. On one hand I cannot see how they could possibly have a case to remove our son, but then I know the CPS to be corrupt. The CPS troll has already lied and harassed us, been coercive, and has tried to intimidate us. We haven't heard from her in while, being that it's the holidays I expected that, but I have a feeling she's still digging and we haven't seen the last of her. She could have easily closed our case after seeing our healthy normal son the first time, but she didn't like that we knew our rights and wouldn't allow her into our house. My husband is very smart and doesn't allow people to push him around. He's a salesman and is used to tactics and knows how to control conversations. And she didn't like that at all. I don't think she was expecting my husband and I to be intelligent and well-informed, especially because the complaint about us came from WIC, where their clientele are largely poor and uneducated. We are not a typical low-income family, therefore absolutely NOT easy prey. We don't make a lot of money partially because I chose to stay at home and raise our son and don't work. We are home-owners, we don't have debt and all our cars are paid for. So we are able to live on one income. We also have a very large family and extensive community all who very supportive and almost all of them know we are attacked by CPS. So I feel somewhat confident that we are going to be ok, however we are doing everything we can to protect ourselves, be informed, and not letting our guard down. Peace.
