And one other question for MsHeather:

Who is it ULTIMATELY up to for the child to be returned home?

My ex-caseworker told me to my face that the judge does not make that decision. The caseworker does. We have been informed on many occasions that we MUST follow court orders. That what a caseworker tells us to do are suggested plans, but cannot be enforced until they are court ordered. But if a judge says send the child home, a caseworker does not have to do that?

I am of the belief that that ex-caseworker, who appeared to be much better than some others, suddenly developed a power trip when she spoke those words to my husband and I, AFTER she was no longer our caseworker.

Yes there does but that's something most family courts ignore.

And as far as CPS workers following rules, our caseworker proudly told us CPS "has no guidelines".

Did you get a copy of their manual and show them otherwise?

I most certainly would have. And if I hear my caseworker tell me one thing that I know is against the guidelines, I will quote him page and paragraph.

I never got a manual from CPS..they actually took my kids without producing anything..here is a question MSHEATHER...when a CPS worker has an Emergency Removal Order...arent they supposed to show that to you and the cops before they can enter your home and scoop up your kids and just take them...??

Pebbles, that is the sad part our lack of knowledge and they know we have that lack of knowledge therefore it enables them to prey on us.

I would not have known to go and ask for the manual or download it off of my computer if it wasn't for this board.

That is why I am determined to educate other parents about what is headed their way and that they must arm themselves with the Knowledge because it will empower them to head them off at the door.

The local CPS I sued either has no manual or if it does, I have never seen it. But if they do, I will get it via subpoena. The only "manual" I have is a booklet listing the Child Protective Services laws in Pa. I have quoted every single law in that booklet that they have broken plus more in the federal complaint I filed (the US & Pennsylvania Constitution, at least 11 federal statutes and at least 27 Pa. statutes plus numerous human rights violations). If they didn't know the federal, state and CPS laws before I sued them, they are surely aware of them now.

No I knew that they had a manual I just didnt know that I was supposed to get one...I have never read it and what not..but I was trying to figure out the question I had about ERO's...Cuz as I have gone further into this case I have realized that when you have an officer at your door with social workers that they have to show the officer the emergency removal order...how are they otherwise supposed to know that the workers are telling the truth...the cops are just supposed to pull innocent children out of their parents house...with no questions asked..or even so much as a paper...and instead of chasing criminals around...only to find out later that they did not have permission..that is what I am saying...and I know TO THIS DAY..over two years later...almost three years into the mix that my kids were taken and I got arrested so the workers could take my kids out without me assaulting them...but yet I dont recall ever seeing an order saying that they had the permission to take them....someone help me....

pariann, for me, the caseworker told the childrens counselor (who then turned around and told me--I believe to hurt me) that if the judge ordered the children to return home with me, that she would just come take them from me again and again, until I cant ever have them again. So that is how Oregon works. At least THIS particular caseworker. She really isnt even a caseworker. Her title is: Kandi Nafzigger Social Services Specialist 2/CET....CET is Consultation Education Trainer. So I dont even know if she even HAD the right to do this to my babies and I. BUT the judge allowed it. So I guess she did. But then again, the judges allow a LOT of crap to happen that is wrong. I dono. I am getting frusterated again..... :evil: As far as your question Pebbles, I dont know WHAT to tell ya about your inquiry. I am shruggin my shoulders here, wondering what in the hell these people are doing to us and why...Well we all know why ....($$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$)....I will do a search for you tho. What state and county?

Yes Melissa there is a handbook/manual...but often times you dont get it...cuz they lie and cheat and apparantly we know that they steal...so you have to request for it...some states and some workers will actually provide it to you I am sure...I am not sure if that is something that they are required to do and just dont or not...but considering that they didnt give me one and it seems that they didnt give it to alot of people then you would figure it is not something that they are mandatory to give to you otherwise they would...to make sure that all their t's are cross and their i's are dotted...you know what I mean...cause if it is something that they were supposed to give to you then best trust and believe they would cuz there is no getting around that through the courts if it is mandatory...or was per say...

Your statement is exactly why I am beginning to work on an E Book so that many new people and old will be able to have it handy for research and what to do.

Linda made my post in the Announcement Forum a sticky so that anyone can give input to help me compile it.

I am like you I think I have heard and read what to do but, I still get confused as to the process of everything. Maybe just us blondes will read it. :? :lol:

well u know us blondes have to stick together, even if some of us aint natural, my friend tells me that everytime she dyes my hair the blonde sinks into my brain, that is the burning sensation lol...anyways, after you have that ebook done give me a hollar, i would more than enjoy reading it on a day i dont have a migraine from reading so much hehe...byes, Melissa 8)

I dont know if there is but there should be a way to access the manuels in based on each individual state...but I cant tell you how long it is cuz it could be a mile long...but I just thought I would let you know...there are tons of things that you can find on the net..just none of it happens to help me...Melissa just type in the agency name in the web browser or something like that...you can also put in rules and regulations..or policies on them...I mean hell if you put in Child Protective Services or whatever they call in your state then I am sure that there is going to be something that is going to come up...later when I have more time I will see if I can find it...what state are you in??

Getting a lawyer does not always help, because if they do not think they are getting they will sacrifice you and your family to CPS. Someone did give you some great advice something I had to learn document everything from a to z.
What I did was I started writing letters to supervisors I went up the ladder. First I went to the immediate supervisor then I went to their supervisor and so forth and so on until I started seeing the results I wanted to see.
A letter or two to the local newspaper or news media does not hurt either.
Right now CPS is in the lime light more than ever if keep questioning what they are doing and take the time to sit down and write they will sork with you and try to keep you satisfied so that you do not make to much noise about your case because they do not want the negative attention.
When writing make sure you keep reference to the child and how what mistakes they are making towards your case.
I am from Texas but in my case when ever CPS wanted or assign us to take a class or anything else it went thru their agency and we did not have to pay it may be different where you are but I understood that if they want you to go to class they footed the bill.
And whatever they have in your case file from beginning to end you want a copy and also what ever they tell you get it in writing no matter what it is. If you keep them on their toes about your case it will be over a lot quicker because it will keep things moving.

Another thing...when getting the information that you want...you need to keep in mind..if I was a news reporter what would I need..if I was another lawyer what would I need....hell with just going to CPS for your case file...go to everyone....the social workers..the psychiatrists...therapists...police...courts....doctors...anyone that you know that those kids have come into contact with right before the placement and right after or during placement...once you have a copy of them make a carbon copy of all the documents...just one and that way you have a copy that you can write little notes by...I have actually faxed thing to the news reporter through the tv station out here...no word on that as I havent had a chance to call her with all the other things going on but I aim to get back in touch with her...but in the end the things that will help you most is to have everything in your general reach and know what you have and also to read up on the law requirements in your state...it is only natural to know the regulations...so make sure you do that and maybe then you can get somewhere...

sorry, i have been having probs with the puter lately, i have been having to spend hours doing spyware doctor...okay, pebbles, i live in iowa...and i am having such a time, they have done the homestudy now and i called to find out when we go back to court and they dont know because the tribal court hasnt gotten back to them yet, but the dhs worker wants to come over on tuesday, does this mean that i am getting closer to getting my child back?? the worker has never been here and for that fact, when my mother in law got custody of her 2 grandsons, she was the worker then and she didnt come here then either...i have so much reading to do, but if anyone has more for me, i would be really, really greatful...and i will hopefully get the puter working better so that i can check in more, the blonde stunts me from that a bit lol...byes, Melissa :oops:

I did not read all of this as it got to be so long but I picked up on a few of the posts.

I too am a Gramma who had licensed family foster care. I also am a professional who happened to know the ins and outs of this horrible system.

What CPS did to me and to my grandkids and my husband is deplorable.

For 17 plus years I have put my life on the line for complete strangers, now I have to walk past these people ( social workers, GALS, Judges etc.) and I try to hold my head up but they have made some nasty accustions that are out there in the public and how do you ever erase whats been said about your reputation?

The main concern I have and always have had is my grandkids and CPS STOLE them from us.

The emotoinal abuse the grandkids are facing because of CPS is NOT RIGHT.

CPS should have left the kids with us for the kids well being and for this family. My daughter even wanted that.

Instead they spent thousands of tax payers dollars placing my grands with NON family. They lied on the witness stand.

They orchestrated this to their benefit.

THEY, CPS NEEDS TO BE STOPPED NOW!!!!!!!!!

I talked to One Foster Parent last week, she is from Missouri. She is a Foster Parent, and have seen them doing unnecessary things. She said the first thing she noticed was that the CPS are trying to get rid of the Kids quicker and put them up for Adoption, and keep the Foster Care Space empty as much as possible to keep the door open for more children. She said that they could not wait to get rid of them quicker so that they can go back to the Investigation on new Families. She has already 4 siblings in her Home, All of them are foster Children, 4 sibling are put up for Adoption, and the birth Parents are terminated of their parental rights, and the two girls 7/8 and 12/13 boys, are put up for adoption, but the thing is that the oldest 13 yrs old boy, does not want to be put up for adoption, and the rest did not mind or whatever. She said she is in pain that she could not adopt them all. Because she is already in process of adopting a new Foster Daughter 13 yrs old who was sexually molested by her brother, and her birth parents already got Parental Rights removed. All she has to go back to Court to confirm the Adoption procedure, and it will be the last court day for the Adoption Procedure and she would finally have her. BUT the Daughther that she is adopting, is HAVING MIXED Feelings, she was afraid that she would hurt her Birth Parent's feelings, that she is being adopted by her new Adoptive Mom. WHY would she feel that? IF she was definetely sexually molested, she would not feel that way, but why feel that she is afraid to hurt her Birth Parents?

She is already in Counselling, and she will have a LONG TERM Emotional Abuse from this. I am betting that this Foster Parent was told LIES from CPS< telling her that this girl is sexually abused, but probably wasn't true? Who knows? We all will know what this Girl will feel, and tell when she turns 18 yrs old. But now she is a Teenager, 13 or now 14, I am willing to bet, she will have more hardships in her Life, wondering, IF she did the right thing by letting her Adoptive Mom, to adopt her. Foster Parent, told me she told this Girl to make up her mind so she can adopt her, and she seems to be pushing her hard into Adoption. This Girl ended up sobbing, crying, screaming, wondering and confused what she wants. All of them, including CPS are pressuring this Girl to be adopted, then she cried, finally GAVE IN. Then the last day for Adoption, she cried hard. This is a 13 yrs old Girl being adopted out, and why would she cry so much? I am pretty sure it is not Cry of Happiness, it is a cry of sadness, because she lost her Family, she has other three Siblings, and her birth Parents that she lost. The other three siblings are still with her Birth Parents. All of them Boys. She is the only Girl left, so I can understand, it is easy for CPS to get her. She cried, because she felt hopeless, helpless, and feels like no one heard her. Everybody seems to be so happy to have her adopted, but at the end, she is crying in bed every night. She even getting counselling for this.

This is what the Foster Parent is saying to me, she was happy for a moment, because she was getting a new Playstation, a new bed which is a Canopy, a new Clothes, new toys, new stuff, she is getting everything she can possibly can, but at the end, she realizes, she lost her Family and still cries. The Foster Parent was wondering why she is crying?

UP and downs, such things can be a long term emotional abuse for this Teenager, and she may not have a good life in the Future. because she would be wondering, if she made the right choice for giving her self up. Because the CPS told her if she won't give her self in, she would remain in the Foster Care for rest of her Life until 18. NO one is adopting her, until this Foster Parent, already licensed, taking in about 6 other Children every day, decided to adopt her.

Well as I see it some things are never right within this system that they call Justice..there are more and more kids yanked out of homes everyday...where kids will have to endure the pain of the parents emotions or their own...Melissa sweetie..just cuz the social worker has never been to your house and all that...dont think that she is trustworthy..by the time you get this I am sure that you have already had a visit from her and know of the ending result...not saying all workers are bad but the vast majority let the job and the senioroity get the better of them... you have to realize that a lot of times social workers come to your house cuz they dont have the info to gain access to take those kids and keep them...so they come to your house to get some type of information that they think might hurt you...so I would say just be careful...what is this country coming to..where they say it is free..well it isnt and I think that these poor innocent children and parents *myself included* can say that we will suffer from this and there is no free...it is a hell and a nightmare that even after you do or dont get your kids back can be a lifetime to get over...so just watch yourself when they come out and watch how they are when in your house..if they look around or if they seem over observant..they might be overanalyzing things...just be careful..
