Carolyn Futrell, murdered 7 year old - Please help!

If we do not help, a murderer is going to be allowed to walk out of jail although she is in jail charged with capital murder and felony child abuse of the child the courts appointed as a guardian.

910 455 3113 - Call and ask for the Jailer. Simply ask the jailer if Carolyn Futrell has been released.

On August 24, 2003, Carolyn Futrell "allegedly" murdered 7 year old Kayla Yvonne Allen.

She was arrested May 20, 2004, charged with capital murder and felony child abuse.
This is one of the more horrific and heinous, intentional, murder using an insecticide poison, Atroban, intended for use on cattle, pig, and sheep farms.

According to toxicologist, she suffered tremendously before gagging and vomiting, aspirating the insecticide into her lungs, bursting the airsacs, and dying face down in her own vomit.

Carolyn has been in the Onslow County, North Carolina jail since May 20, 2004, held without bond.

Last week a bond hearing was held and "due to financial difficulties" of Carolyn's family the judge has posted her with a $200,000.00 bond. She has all the connections needed to raise 20 G. and she will be allowed to walk the street like anyone else.

A request from Kayla's Mommy:
"I am requesting that as many people show their support of her staying in jail by calling 910 455 3113 it's too the sheriff's dept.

All you have to do is call that # and ask for the JAILER and they'll connect you and you just ask if Carolyn Futrell has been released yet.

I'm recommending people call at least once a day, the more people who are concerned the more likely the judge wont let her out on house arrest and then she'll have to get out on her own.

This is a small town whether people think it is or not and all the law officials do converse about this issue so,

I'm positive that it will be well known to ALL OFFICIALS involved if we make sure they know how concerned people are about her being free.

Please whenever you are just sitting around and have a free moment just call and ask and I do believe it will make a HUGE difference.

hope, what did they do with this Carolyn Futrell person?

Was there any way to say that this poisoning was accidental?

Was it in a foster home where they're supposed to
be constantly ready for an inspection?

Indicted Child Murderer Set Free

1. Kayla was murdered with a granular pesticide poison on August 24, 2003.
Atroban warns that when mixing the granules with water, to wear heavy-duty gloves that come up the arm because the MIST will burn the skin off a grown man's arm. (red and gray granules were noted in the autopsy. Granules may become liquid but liquid does not change into granules, of two colors.

What would it do to a child's lips, mouth, esophagus, and stomach?
(the autopsy reveals no abnormalities)

2. Carolyn Futrell, previously married Kayla's Uncle and when they divorced, she kept Kayla.

Carolyn was arrested on May 20, 2004 and the GJ indicted her on Capital Murder, Felony Child Abuse, and is seeking the death penalty!

She was released on the Friday following the recent bond hearing on Monday.
No one has reported if she was released on house arrest or if she bonded out.
Wasn't Judge Lanier considerate of an indicted child murderer when he said he would wait to see if the family could raise the 20 G through the community, before deciding house arrest.

The Assistant DA has said that Carolyn Futrell's attorney, Miller, called Judge Henry around 1 a.m. the day of the hearing; having a somewhat inebriated, ex parte communication.

Judge Henry recused himself, allowing Judge Lanier to take the bench and rule on the bond hearing.

I am not a lawyer by any stretch of the imagination.
From what I know, Judge Henry had two choices:
1. Play into the hand of the defense attorney and recuse himself
OR
2. Call the attorneys into his chambers and let all attorneys know what had transpired and what was said, chastise Miller, and continue the hearing.

With my limited understanding of the Judicial Canons, Judge Henry has a responsibility to report Miller's actions to the BAR.

This case has been so messed up from the beginning I wonder if this child will have justice in her death,
since she certainly did not have justice in her life!

The Chief Medical Examiner of NC, John Butts, refuses to call Kayla's death as an accident, suicide, or homicide!
This helps the defense BIG TIME!!

The opinion of another, more experienced, forensic pathologist, who has only viewed the autopsy and toxicology:

The cause of death is well-established. As far as homicide vs.. suicide vs.. accidental, I don't see any way that a 6 year-old would want to drink this stuff so I think that eliminates suicide and accident.
Whoever gave her this stuff probably left the bottle under the pillow to make it look like she did it herself.
It would be interesting to see if any fingerprints can be lifted from the bottle.
In my opinion, this is a homicide that needs some good investigation.
If the state medical examiner got a smell or taste of this stuff, he would recognize that this was not voluntarily ingested.

There are more questions than answers in a case that appears to be so clear-cut for anyone who has seen the mounds of evidence.

Butts will not work WITH the DA's office, maybe a few email would get him to rethink how he got his job.

Carolyn also appears to have moved out of the County of Onslow, Richlands, NC, where the crime occurred.
This entire case has reeked from the beginning when not one word was printed about this healthy child’s sudden death, for nine months, when front page news was made when the garbage truck driver ran over a dog!

Precaution(s): Storage and Disposal

Do not contaminate water, food or feed by storage or disposal.
Storage: Store in cool, dry place away from heat or open flame.
Pesticide Disposal: Pesticide wastes are acutely hazardous. Improper disposal of excess pesticide, spray mixture or rinsate is a violation of Federal Law. If these wastes cannot be disposed of by use according to label instructions, contact your State Pesticide or Environmental Control Agency or the Hazardous Waste representative at the nearest EPA Regional Office for guidance.
Container Disposal: Triple rinse (or equivalent). Then offer for recycling or reconditioning, or puncture and dispose of in a sanitary landfill, or incineration, or if allowed by state and local authorities, by burning. If burned, stay out of smoke.
Physical or Chemical Hazard: Do not use or store near heat or open flame.
Environmental Hazards: This product is toxic to fish. Do not apply directly to water. Do not contaminate water by cleaning of equipment or disposal of wastes.

The only "puzzle" is how this alleged murderer was able to implode the granular pesticide into her stomach.

The alleged murderer told her co-workers, that Kayla died of a brain anuerism.
She told the school that Kayla died from an allergic reaction to the cough syrup she supposedly gave her.
She told the police and cornoer that Kayla had taken the wrong drinking bottle from under the sink, that contained Atroban

Yes, I have STATED, she COULD NOT have drank this noxious, permethrin based pesticide without it burning her lips, mouth, and esophagus.

I have talked with Toxicologist and Forensic Pathologist.
This child DID NOT DRINK this poison; the autopsy states, red and gray granules were found in her stomach.

The Chief Medical Examiner for NC, Dr. John Butts, refuses to list this as a homicide, suicide, or accidental.

WHY?

She was a tiny little girl who was very picky and the smell of this stuff from a distance will knock you out, melt your skin off,
so that rules out accidental ingestion of 4.5 oz.

She was a happy, healthy, little girl when she left school on Friday, and was dead on Sunday. She was not suicidal.

What does that leave?
One person was in the house with her at the time of her death, Carolyn Futrell...
HOMICIDE....

Do we need a rocket scientist to assist Dr. Butts in determining the cause of death?
He is an unusually rude man.

I speak with the NC DA on a regular basis and he cannot MAKE the Chief Medical Examiner of the state do what he is supposed to do; determine the cause of death.


Dr. Bonnell, forensic pathologist from CA, is our only hope at this point.

There are a lot of speculations as to why the Chief Medical Examiner will not rule this a homicide, suicide, or accidental death.

We can throw S&#T at the wall all day to see what sticks but:

Who does it serve for him to NOT rule the death a homicide?

The defense attorneys for certain!

The state is being sued for not protecting Kayla although over 13 reports were made, by the school, by the Taylor MI police 14 months before she was murdered, and by family, and others we do not know about. One report was made less than one month before Kayla's murder.

NC DSS came out with a statement the day after Carolyn was arrested stating they had done an internal investigation and no wrongdoing was found.

If they do not learn what they are doing wrong, they will continue to give preference to those who have family members working with DSS, family members who work for lawyers, and family members whose name means something in the small town of Onslow County.

I am keenly aware that this is not the only child who has died because DSS did not do their job.

This IS the only known death using Atroban in the U.S.

This child did not have justice in her life, and it appears there will not be any in her death either.

At this point, our goal is to have Kayla exhumed from NC and moved to MI where the Michigan Memorial Park has donated the plot.
We are raising money to pay for the exhumation and expenses associated with disinternment.

Why are we not MORE outraged that not only has a child been murdered,
--but the investigation was botched (according to DA),
--the Chief Medical Examiner for the state of NC is being as unprofessional as anyone I have had to deal with,
--and the alleged murderer is not required to even remain in the same county after her release from prison.


Whatever happened to ACCOUNTABILITY?
