Charges dropped in Yorktown false-report case

YORKTOWN - Charges against a Jefferson Valley man accused of filing false complaints against local parents have been dismissed.
Vincent Lovallo, 47, was cleared last week of five misdemeanor counts of falsely reporting an incident during the pre-trial phase in Yorktown Town Court.
Lovallo said today he was relieved.
"I never did anything," he said. "I told everyone I didn't do it."
The case stemmed from a series of allegations made via telephone against parents whose children played in the town's youth soccer program last year, claiming they had mistreated their children. The reports prompted investigations by child welfare authorities, who determined that no abuse had occurred.
Authorities concluded that Lovallo had filed the reports falsely, but David Sachs, his lawyer, called the case against Lovallo "circumstantial and wholly insubstantial."
A spokesman for the county District Attorney's Office said the office had just received word of the dismissal yesterday and was reviewing the case.

Woman Admits Child Abuse Claims False, Deputies Say

PORT RICHEY - The call went into a child abuse hot line on Monday, reporting that a 4-year-old was being abused at a local child care facility.
The woman identifying herself only as Victoria said her nephew, Charles Gibson, had been hurt at FootPrints PreSchool & Child Care Center, according to a Pasco County Sheriff's Office report. But investigators quickly learned it was a ruse.
Victoria Boekeloo, 19, of 8637 Paxton Drive was arrested Wednesday morning at her home on a charge of filing a false child abuse report, a third-degree felony.
Boekeloo was fired from FootPrints on Oct. 19, the report states.
'It looks like it was retaliation,' said Pasco sheriff's spokesman Kevin Doll.
A woman who identified herself as the manager of the New Port Richey school said she could not talk about the incident.
According to deputies, Boekeloo admitted making the fake call.
'I lied. I don't have a nephew and there's no Charles Gibson,' she said, according to the report.
She was released from the Land O' Lakes jail Wednesday after posting $5,000 bail.
'I'm not telling you anything,' Boekeloo said when reached by phone Thursday.
It wasn't clear why she was fired.
After the call was made to the hot line affiliated with the state Department of Children & Families, the information was forwarded to Pasco Child Protection investigators, who started their inquiry Wednesday.
The director of FootPrints told investigators Boekeloo's employment had just been terminated, Doll said.
DCF spokesman Andy Ritter said this scenario is unusual.
'Not too often do you have an example of a case like you told me when you have a malicious false allegation,' Ritter told a Pasco Tribune reporter. 'Most of the allegations we get are in the heat of a custody battle.'
Ritter stressed that people who suspect abuse happening should report it. If investigators do not find evidence of abuse, they will not be arrested.
'There's a difference in making an allegation that is malicious, or one that's simply not true,' he said.

For months, Brandy Cook told social services workers, law enforcement officers and anybody else who would listen, that her ex-husband, Robert Lee Hunter, was abusing their two children.
After an investigation, however, Cook was arrested in Huntsville on two charges of filing false reports. A Huntsville Municipal Court judge sentenced her to six months of probation on two counts of false reporting. She pleaded guilty when the charges were appealed in Madison County Circuit Court and received an identical sentence in circuit court.
Huntsville police investigator Charity Roe told a jury Thursday that Cook's claims were unfounded. Roe, social workers and a group of child advocates testified the accusations focused on custody issues and not on child safety.
State prosecutors say Cook's false reporting was part of a plan to deprive Hunter of his parental right to spend time with his children.
After a contempt of court hearing for Cook, her stepfather, John Christopher Lee Sr., shot Hunter and his mother, Debra Parker, in the face outside the Jackson County Courthouse on May 31, 2006.
Lee is on trial, facing two counts of attempted murder. If convicted, he could be sentenced to life in prison.
Lee has pleaded not guilty to the charges because of mental disease or defect. He claims he cannot remember anything within the narrow window of time it took to shoot Hunter and Parker.
At least five physicians agree that Lee has a form of depression, but they split on the severity of the illness and its effects on his mind.
State forensic psychiatrists James Hooper and Marisa Giggie testified Thursday that Lee's claim of memory loss is not credible. They said Lee is malingering, faking memory loss to avoid his legal problems.
Lee denied being part of any type of plan to keep Hunter away from his children. Lee, who was married to Cook's mother, Lori Lee, for 12 years, said he raised Cook, 26, from a 3-year-old.

KINGSPORT — A Maryland woman is headed to court Feb. 6 after abuse allegations against a Kingsport woman led Tennessee Department of Children’s Services officials to drop everything to check on two young boys within 24 hours of a hotline call now deemed to be a false alarm.
Geraldine Paulette Sylvester-Parsons, 46, of Randallstown, Md., allegedly called the hotline on Aug. 23 posing as a “Jane Curtin” — actually her great-grandmother’s name.
Sylvester-Parsons accused Audrey Parsons, of Kingsport, of sexually abusing a 10-year-old boy who is both her grandson and her adopted son. She further claimed the boy was abusing a 4-year-old boy at a neighbor’s home, according to an affidavit.
Although DCS spokesman Rob Johnson could provide no details about the allegations, he said a “priority one response” is warranted when a child is believed to be in imminent danger of serious bodily harm or death.
Priority one response protocols required Child Protective Services Investigator Myra Hale to meet face to face with the boys “no later than 24 hours” after the tip, Johnson explained.
Hale and Kingsport Police Department Detective Chris Tincher conducted a joint investigation into the allegations. The Child Protective Investigative Team then reviewed their findings and decided the accusations were unfounded.
Sullivan County Assistant District Attorney Barry Staubus listened to a recording of the hotline call and recommended a separate investigation into the possibility of false report charges against Sylvester-Parsons.
In a phone interview with Tincher on Aug. 28, Sylvester-Parsons denied making the call and said the allegations were false. She told Hale the same thing in a call placed two days later.
Tincher said Sylvester-Parsons didn’t deny it was her voice on the recording of the hotline call.
She was arrested on a charge of false reporting of child sexual abuse and posted $1,500 bond on Dec. 6.

The state jail felony is punishable by as many as two years in jail and as much as a $10,000 fine.
Lopez-Hess was arrested Monday and released from the Nueces County Jail that same day on a $2,500 bond, jail officials said.
Lopez-Hess was the supervisor for CPS' local sexual assault unit until she was fired in May. She had worked for the agency since December 1997, according to Patrick Crimmins, a department spokesman.
Crimmins said in an e-mailed statement that she was fired "for sharing confidential case information which damaged her professional credibility in the community."
He didn't give further details about her termination.
