The purpose of this memo is to provide social services districts with a summary of the recent New York State Court of Appeals decision in Nicholson, et al. v. Scopetta, et al. , which answers three specific questions regarding the meaning of State law governing child protection in cases where there are allegations of domestic violence.

Re: Initial Response to ... Circuit Court of Appeals Decision in Doe v. Heck

This decision relates to the authority of child protective services caseworkers to conduct child abuse and neglect assessments on private property.

We will be issuing a more formal response to the decision in the near future, but I would like to provide you with our initial responses and suggested actions county agencies can take in the meantime.

Issue of removal of state case to federal court

Conclusion
Accordingly, I recommend that this court (federal) DENY the “petition for removal,” the motion for joinder and the motion for a new trial because this court lacks jurisdiction to undo the consequences of a state court judgment in circumstances such as are presented
here.

(child protection, termination of parental rights case)
