The major NCANDS disposition categories are described below.

Indicated: An investigation disposition that concludes that maltreatment could not be substantiated under State law or policy, but there was reason to suspect that the child may have been maltreated or was at risk of maltreatment. This is applicable only to States that distinguish between substantiated and indicated dispositions.

Substantiated: A type of investigation disposition that concludes that the allegation of maltreatment or risk of maltreatment was supported or founded by State law or State policy.

Unsubstantiated: A type of investigation disposition that determines that there was not sufficient evidence under State law to conclude or suspect that the child was maltreated or at risk of being maltreated.

Magnitude of Child Abuse and Neglect -- National Data


Nationally, child protective services agencies (CPS) investigated an estimated two million reports alleging the maltreatment of almost three million children in 1997, the last year for which statistics were available. Of these children, the number of victims of substantiated or indicated maltreatment was estimated to be about 984,000, or about 33.4% of all reported children. The average substantiation rate among the states was 28.6%. The remaining 4.8% comprised allegations that some states disposed as indicated abuse/neglect (these 11 states use the indicated disposition when there is reason to suspect maltreatment but there is insufficient evidence under state policy to confirm the maltreatment. New Jersey is among 39 states and the District of Columbia that report substantiated abuse/neglect cases to the U. S. Department of Health and Human Services but do not either use the indicated disposition or report indicated abuse/neglect allegations). The rate of substantiation in 1997 decreased slightly from the rate reported in 1996, when slightly over one million (1,030,751) children, or 34.4% of all those reported, were found to be substantiated or indicated victims of abuse and neglect.

That state does not distinguish between the 2 types of indicated. What happens now ? A letter was written to try and get a hearing as letter received said to do. What happens now ?
