physological exams

Well, I was court ordered to do a physological and physosexual exams. Well, I got the results back. The physosexual exams results were good. However, she used the fact that I didn't know what some slang words ment like santorum (wtf does that mean is beyond me). Also there was one question that went along the lines as (How many children did you sexually abuse in the past a) 1-5 b) 6-10 or c) 10 or more) Well, I didn't awnser those 2 questions because I never sexually abused the child and why should I admit to something I didn't do? She gave me 7 different physosexual exams totaling between 850-1000 questions and I didn't awnser two. And she said that I skipped questions? That is bullshit. Then my physological exam she said that I was narrisstic. That I didn't think of anyone else except myself. I don't know what she is talking about. I have always done what ever makes people happy. I have always looked out for other people's welfare before my own. Oh and then she got me talking about my daughter's father and this other man (he downloaded child porn off of limewire and the police found it using some kind of program) confused. So, anyway the whole findings that this physologicalist wrote is totally screwed up. I could go on all day about it.

My question is this. How does this hold up in court? Is there a way I can get her findings dismissed? I dont' know what I can do at this point. She basically stated that I wouldn't be a good parent. I'm terriffed that DCF will take my baby forever and I just can't deal with anymore pain.

I felt silly that I had to google santorum because I had no clue what the heck it was either. After finding it, I no longer felt silly but disgusted.

The definition I found for it is "a frothy mix of lube and fecal matter that is sometimes the byproduct of anal sex".

I am no prude, but that has to be the most disgusting thing I have heard of and the fact that someone took the time to name this 'byproduct'.

I would be very worried about being ordered to do this test from the info that I found.

"When is a psychosexual evaluation needed?
It is needed when someone is known to have committed a sex offense. A psychosexual evaluation can assess the individual's treatment needs and risk for re-offending. This is described on ATSA's web site (http://www.atsa.com/pprsattaiwa.html)"

"When does an adult need a psychosexual evaluation?
When an adult has been found guilty or pled guilty to a sex offense of any kind.
When an adult is showing inappropriate sexual behavior such as:
Exposing oneself.
Peeping into others' windows.
Inappropriately touching others against their will.
Engaging in sexual activity with children.
Engaging in sexual activity with family members such as his children or step-children.
Engaging in sexual activity with a non-consenting partner.
Engaging in sexual activity with animals.
Engaging in unusual sexual practices such as cross-dressing or stealing women's underwear"


Does the person who conducted your test fit into this? This is the one that I would focus on the most:

"Who is qualified to conduct a psychosexual evaluation?
A mental health professional, usually with a master's or doctoral degree in counseling, social work, psychology or some other mental health discipline is qualified to conduct an evaluation. The professional should have received specialized training in how to assess and treat sexual deviancy. This is a specialty area in which most mental health professionals have not received training"

Who typically requests the psychosexual evaluation of an adult?
Judges may court order that an adult who is found guilty of a sex offense receive a sex offender evaluation or psychosexual evaluation as a condition of his probation, and that the offender follow any treatment recommendations given by the evaluator.
In many states, offenders are required to receive a psychosexual evaluation after they have been found guilty but before their sentencing hearing. In these cases, the psychosexual evaluator may be asked to assess whether the offender's risk for re-offending is low enough for him to be placed in the community on probation.
Probation officers may request that an adult sex offender who is on probation take a psychosexual evaluation in order to assess his treatment needs and risk for re-offending.
DFACS caseworkers may request that an alleged sexual perpetrator receive a psychosexual evaluation as a part of his DFACS case plan.
For example, a man who has been accused of molesting his daughter may be required by DFACS to receive a psychosexual evaluation to help offer recommendations regarding treatment and placement.
Other professionals may refer an adult who has a sexual deviancy problem.
A sex offender treatment program often requires that a client receive a psychosexual evaluation before beginning the treatment program.
ATSA recommends that a psychosexual evaluation be completed before an offender is accepted into a community-based treatment program.
A client's defense attorney may request a psychosexual evaluation of his client.
Usually, the defense attorney is hoping that the evaluator can recommend probation for his client if the client's risk for re-offending is low enough .
Sometimes, defense attorneys request a psychosexual evaluation in the hopes that the evaluator can state that the client did not commit the sex offense in question. However, evaluators can never assess guilt or innocence regarding a sex offense. There is no psychological test that can prove or disprove that a person committed a sex offense.
A concerned spouse may refer his or her partner for an evaluation and treatment.
Adults can request a psychosexual evaluation if they know or suspect that they have a sexual deviancy problem.
Unfortunately, adults who have a sexual deviancy problem rarely seek evaluation and treatment on their own since they typically have little motivation to change and/or they are afraid of the potential negative consequences of reporting their sex offense to a professional"

Thanks for the info.... What happened is a boyfriend put child pornography on my computer using limewire without my consent or knowledge. The cops searched my house and sezied the computer. I went to the police station all confused on why they took my computer and the next thing I knew I'm walking out in handcuffs. I guess telling them I had no clue it was there or even Limewire still existed, and giving the guys name and last known location was a reason to arrest me. I don't know I'm just pissed about the whole situation. And then the physo doctor lady said in the report "She doesn't take no responsibality on how she got in this postion" Uh HELLO people I'm not going to take responsiablity for someone's actions expecully this one. DAMN! Have we lost our flippin minds?
Anyway, during the exams the physologist asked how I was doing and I asked her just out of mere amusement on my part it was "Am I going crazy or and I being asked the same question over and over again?" Either way my boss is a paralegal so there is a physologist who is going to walk in there with her findings and to let the courts know that they got the wrong info.

BTW this video's (from what they say) doesn't have my child in them (thank GOD). It doesn't make it right by any means however, she wasn't abused.

I would say that you are in a pickle on this one.

The guy that you were dating that you said DL the porn, you couldnt remember his last name at the time, but you were dating him and knew him well enough to give him a key to your house where you lived with your daughter.

Even if they dont get the charges for kiddie porn to stick on you, they are going to say you put your daughter in danger by letting this man into your house, not to mention giving him a key.

Has his daughter gotten treatment yet at all?

His daughter no. However, I have documents stating that I made proper means to change the locks with my apartment complex. The apartment I was living in to get something done was difficult. I changed the locks myself. Then I got a call from the property manager stating that I needed to change them back. After I talked to her and stated that I gave somone a key and wanted the locks changed she stated that they would do so and never did. They dropped my criminal charges due to resaonable doubt. The procustion really didn't have a fight the defense out weighted by a long shot.

He didn't say that I dl the porn. The police have a program called the Gridsleuth system that was developed my Flint Waters that targets indviduls that download that crap.

you can go on the internet and find out how to read the psychological.

i had an issue with my husbands until i did a little research. so i was able to knock it completely out. here is what i know about a psychosexual.

normally cps using it to determine guilt, it is not for that. it is to figure out if a guilty person will commit the crime again.
there are axis for the diagnosis, if it a true diagnosis you will have a number beside it and it must be on the axis I. if it falls to axis II or greater it is only speculation. a great defense to the future axis is that most insurance companies only pay for axis I diagnosis.
investigate the test they use. certain test will only show you as a bad parent and if you answer the question and it shows all good parenting skills, the test will be labeled invalid because you must be making yourself look in a good light.

the psychosexual is trying to find deviant sexual behavior, there are 13 i think, but often they try to use other things to make you look guilty. point out to the worker that you do not suffer from any deviant sexual behavior. that the only issue you may have is bad judgement on a person you met, but hindsight is always 20/20 and you do learn from your mistakes...

be proactive not reactive, you will get alot further esp. with the psycho babble the try to use.

I stated that I do feel like an ass for being so trusting to let a person like that into my home. Not realizing what kind of person he was until after the events unfolded. Then I started to think "wow it all makes sense now". They are finally going to talk to the ex boyfriend and his daughter. God I hope he isn't doing anything to her. I showed them the e-mail he sent me the day after I was arrested....it diffently is a red flag for something. This is what it said.

HeyI don't know if you will ever read this or not but you did something I never would have asked anyone to do. You took the weight not for me but for my daughter and now its came back to haunt us. I'll probably see you on the inside but just wanted to say thanks and I love you!

Anyway, I will reserach the tests is there a good website that anyone can suggest? And how did you get those bumped off? They told me that I can go through my own physologist and pay for it.

i got a good counselor and when i got the knowledge to stand up to them, she backed me up. she knew that it was just all talk. an axis 2 diagnosis isnt anything, plus my husband had an 84 iq and his supposed victim had a 99 iq with severe mental disorders (the same dr did both evaluations). that within itself and her history made it easy to throw out.

to be honest, cps didnt really want my case but their policy made them have to take it on. i also got a good worker who only had my case. it made it easier, plus i became difficult to deal with according to all the supervisors. i pushed them hard.

Thanks for the help. My criminal stuff is done and over with I just have to fight CPS now to get my angel back. Ick I hate stress. I had my first appointment with the counselor on Friday and she said the same thing everyone else I know said "You don't seem to be narcissistic to me." So, hopefully we can get that nipped in the butt.

I am not sure if there is a right or wrong. I wish I knew some websites for you to go to. Should I find some, I will post same.

However, do not trust THEIR exam. Try with all your might to get another independent exam. In court, you must be able to refute their evidence with your own.

If you are unable finacially to provide your own independent exam----------insist that they allow you another exam with another examiner.

Do not give up.

I have heard of the Child Abuse Inventory-seems to have been around for some time. There is a manual on this.

I am not sure if this so called "test" has been disputed but I reckon it has to have been.

Please demand the results of all of your tests and ask your atty about getting second opinions.

I am so very sorry that you are having to go through all of this.

Be careful in all that you do.

Keep notes and demand test results be given to you personally and not just to CPS.

I called the phys doctor to get the test results or the copy of my tests with my awnsers so I can provide it to the court and show them that all the questions were awnsered. But she stated that they can't be copied. I'm going to see my attorney today and she if we can sepona the test results. They allowed me to do another set of tests but I have to pay for it. I should of left the part out that I'm suing CPS for violation of Civil Liberties, Due Process, Mental anquish, Slander, and Deframtion of Charater.

They used a Minnesota Multiphasic on you?

Track this down:

The man who created the MMPI wrote
in his instructions that it is invalid for
child custody cases (and CPS cases).

MMPI should never be used in any Child Protection case.

Get your attorney to cross examine the idiot
who administered that test.

Cross examine them about how great they
think the MMPI is and how accurate, etc.

Ask if MMPI is valid for CPS cases.

Ask if (creator's name) said this test is not
valid for cases like this, what would you say?

Then ask if they know who (creator's name) is.

Then put a copy of the (creator's) statement
that it shouldn't be used in custody cases
in front of them and ask them to read it.

Point out that (creator's name) is the guy
who created the MMPI and said that it
it invalid in custody disputes.

You sure got slammed with tests!

Most of them, like the sex abuse one, should
not have been directed without a basis.

I was directed into a psych eval and I
even tried to do it, but after a whole HOUR
the psychologist only asked for me to
release the CPS garbage to him.

They sent him a one inch stack, but conveniently
left out the document which proved they lied.

I called the psychologist at that point and
asked how I could possibly get a fair psych
eval when he was taking this input and direction
from non professionals who blatantly lied.
I asked him how he could judge my parenting
skills without seeing me do it.
I asked if he could judge my parenting skills
"in a vacuum".
I also asked how he could pretend that
the input would not contaminate the results.
I asked whether I was to be judged for
the ecology of my mind, or for the paperwork.

Later I found out that he contacted the
agency nitwits and complained that I
asked "legalistic questions".

Much later I got to cross examine the
MSW "adoption specialist" caseworker
after he was yanked off the case, and
on the witness stand he testified that
a stack of agency documents or even
a short grocery list of caseworker
"concerns" input into a psych eval
would taint it and make it not valid.

So after YEARS of us arguing that the
psych eval was RIGGED, and refusing
it on those grounds, their own
""expert"" gave testimony that it was.

I submitted a taped phone call I made
where I asked the caseworker to
clean up services like the rigged psych eval,
asked if I could see some other psychologist
without having it tainted with their garbage input.
She got very loud and insisted that they
would have to send INPUT to any new
psychologist I find as well.

As far as I am concerned, too many
psychologists are whores for CPS.
The psych eval doctor wanted INPUT
so he could know what CPS wanted him
to come up with.

When he reported to them that I was
troublesome and asked legalese questions,
was that an ethical report for him to make?

Would a truly professional psychologist
let the unqualified input from the
caseworkers into the psych eval
from the beginning? I could see
one obtaining the CPS garbage as
a postscript, as an addenda, but
to allow the process to be contaminated
doesn't seem very professional to me.

Was this person who tested you a licensed psychologist?

What are their actual credentials?

I had to complete a mmp yesterday, and the guy didn't even have the correct information. he had an old eval from 2003 that cps made me do. I was there 3 hours, what a pain in the neck.

Yes I was tested by a licensed psychologist. She is the only one that can give these tests for CPS in the county. My theory is that she works for them because who pays for it who? The state. Anyway I told my case worker that wasn't suppose to give me those tests. And I found out the company she orders the tests from and informed them taht she was doing that. Well she isn't going to be able to order tests from them any more.. :lol:

I was truthful. The physosexual exams came back that I wasn't a threat to society. According to the physological. I'm just a bitch.

The main thing with CPS is compliance and ability.I got my kids back around June of 2007 and the ability and compliance factors were primary reasons.I took several testings as well as going to AA on my own and attending substance abuse classes 2-3 times a week. If you are asked to do something then give a bit more.
Be like a Boy Scout. Go above and beyond what they ask of you.It was rough not having my kids in my home for 2 years but my wife and I made it. Do NOT get confrontational EVER with them. But ask ALOT of questions and always comply.
I resisted them to a certain degree but you need to know where the line has been drawn.
Keep your home and yard clean.Keep yourself looking as good as possible.As hard as it is, keep a positive attitude.
My pathetic father-in-law made things even harder for us when he filed a 10-50 something or other which was more or less him saying that my wife and I were too sorry to take care of the kids and he wanted custody.
He LOST that bid.
Watch the attitude.Be careful of whom you make friends with.Got a dog? It better be kid friendly.
I have a whole lot to say about this since Mias story is somewhat similiar to mine as far as the wide range of testing and the bad attitude goes.
But I can say this from my ordeal with CPS. I am a far better man today than I was 2 years ago.I took several sex oriented testings, attended AA, attended substance abuse classes with Coastal Horizons who go into every aspect of your life as how to deal with things,I also attended therapy for my marriage.
My wife and my children and I have a better relationship now than ever and although that 2 years was hell for us it DID make us a better family.Just keep complying, keep trying harder than they ask and keep your chin up!
Now my wife and kids look forward to Daddy coming home!!!

so I have been doing some research about this tests that I had to take and this is what I came up with for people that need to know...

The parent-child relationship inventory this is what i came up with

The PCRI is designed to be used in clinical evaluations of children
and families in combination with qualitative evaluation and clinical
judgment by making normative comparisons possible. The PCRI
should never be used in isolation as the sole basis for clinical
diagnoses, treatment decisions, or custody recommendations.
