You can certainly speak to an attorney to see if you have a case or not. Basically, the mother has a right to complete her case plan to achieve reunification. I can't speak for all cases or all states, but I was subjected only to a single psych eval near the beginning of my case. It found no diagnosable conditions. This is an interesting question. I'm sure you realize that TPRs require clear and convincing evidence, whereas it only take a preponderance for the state to assume temporary legal custody. If the state has custody of your daughter, you should at least have a court-appointed attorney representing you -- one who is on the public payroll. He/she might not have much time for your case in particular, but it's better than nothing.

I would have your attorney take this issue up with the judge. Now that the state has assume custody of your daughter, it is responsible for all of her needs, including education.

What does it mean that the judge ordered the termination on two of your kids? That would imply that it has already happened. Just because the child is staying with her grandma doesn't mean the state has legal custody. It could be a "voluntary" placement.

I expect the petition is for CPS to be given temporary legal custody over the child. It won't be to file criminal charges. Only the DA prosecutor can do that.

That's not the way it's "supposed" to happen. For example, in my case, the foster parents knew that they were only giving temporary support to our family. They already had four kids of their own, and didn't want any more. They didn't let my kids call them "Mom" or "Dad."...

I would say the answer is 'yes,' but with the caution that if it ever comes to the attention to CPS that your current living conditions are similar to those that led to their previous intervention, they will act with a vengence against your family.

Absolutely correct. There's no way you can follow a plan you're not allowed to see. Also, to be a valid plan, it has to be approved by the judge, so the court should have a record of it.
