Re: Do judges follow court-ordered shrinks' recommendations?

I had a friend who had a CPS psych eval. It came back with a diagnosis different from he past and current Psychiatrist. I just don't think that a doctor who sees you over a couple weeks can give a diagnosis. They are just making a guess. A Psychiatrist who works with a patient, gives medication, the...

case against CPS for lack of medical care

If it can be proven that CPS should have acted differntly to get a child medical coverage while under their care and the child had significant weight and height loss, meaning going from 87th percentile to 55th percentile in 6 months, is there a case? It has been documneted by doctors that this happe...

Re: What happens if a foster parent violated a court order?

Yes, I was referring to urgent care. I meant to reply to this before. I just wanted to clarify that the appointment wasn't urgent. There was just an availability the same day. I was pretty upset at the situation at the time, as I should have been. But now that months have past, I look back at the c...

Re: Direction Needed ASAP... Please

I would go to the file room and request a copy of the entire file. Then I would contact the Judge. Or possibly ask for an administrative hearing. I guess if it was my case, and I hit a dead end after this, I'd picket the CPS building. Someone might help. True story...I was helping someone with a lon...

Re: What happens if a foster parent violated a court order?

If they can claim it was a sudden or emergency doctor visit, there's no intent to evade the order. What the hell is a sudden doctors visit? That's the first time I heard that term. Well, yeah, it was sudden. It was suddenly made for no reason besides making it a pain in the ass to get to. No it was...

Re: What happens if a foster parent violated a court order?

Evidence of intent? Well, the Judge would not normally do an order for a parent to be informed of a Drs appt, because that is the parent's right already to attend. So the Judge had to go out of their way to spell it out in a court order. Intent? When you are told to specifically do something, then d...

What happens if a foster parent violated a court order?

The foster parent was told by the social worker to let the parent attend doctors appointments. The foster parent told the parent that they couldn't and the parent pleaded to them to let them. This was brought up in court. The Judge ordered that the foster parent allow the parent to attend and give 3...

Re: Do step parents who adopt have priority over other relatives

The fathers first name is on the birth certificate. But he hasn't been located and it's been 3 years. He was a drug user and became homeless shortly after the child was conceived. And it sounds like that has been his circumstances for the following year at least.

Re: Do step parents who adopt have priority over other relatives

I'm in CA. But I believe it's possible in most states, although rules may vary. The child is 3 and the bio father has been 100% absent since before birth, so no visits, calls or support. He knew the mother was pregnant, but that's it. We don't know how to contact him, by phone or address and don't h...

Re: Do step parents who adopt have priority over other relatives

As far as I know, and I have seen nothing different, other than the adoptive parents have same exact rights as bio parents. It would be a great way to divert a future case towards a certain person a parent would like their child to go to, just in case. That is what will be happening with my friend. ...

CPS approval of people you live with

What does CPS need to approve people a parent lives with? Whether a friend or relative or roommate? Do they have to pass a background check? What would disqualify someone? And do they have to take a drug test?

Re: Can CPS tell a parent to live with a specific person?

Hi KDus, I have seen enough to realize that there is an overall purpose of helping children and parents to be reunified. But around all of that is a big game. And that game really needs to be realized and played. It's too bad that well intentioned parents and innocent children are put through the st...

Re: Can CPS tell a parent to live with a specific person?

Thanks KDus for the details. That makes sense now. You say that they almost always move toward TPR. In my experience in hearing about other people cases (friend and stories from her of others), that TPR and reunification are options t the same time. But it depends on if the parent is doing everythin...

Do step parents who adopt have priority over other relatives

I was curious if a parent who had a previous closed case that resulted in reunification allows their spouse (step parent of the child) to adopt their child, would the step parent who adopted the child have the same priority in placement as a biological relative of the child (grand parent, aunt, etc)...

Re: Can CPS tell a parent to live with a specific person?

They can't tell you what to do about such things but they will punish you if you don't comply. Nowhere, nowhere anywhere, in my lengthy case did a report or worker ever say that I should leave my wife. But, that was exactly what they wanted. I was blunt and honest with my attorney and he gave me th...

Can CPS tell a parent to live with a specific person?

I know someone with an open CPS case, who is about to complete their plan and get unsupervised visits. The social worker told them that she strongly recommends that she lives with her mother (the childs grandmother). She said "no", she doesn't want to do that. Can CPS require a parent to l...

If you have had a CPS case and later marry and allow them to adopt your children, will the adoptive stepparent be given priority to raise the children over the prior foster parents?

CPS violating due process

If a case needs to be transferred to a different county and CPS in the original county takes 3 months to send over the file to the new county, and doing so delays the case for 3 months, is this violating rights for due process. As far as I know, all they had to do is copy and mail the file. Once tha...

Re: Hierarchy of credibility

I was told by a good court appointed CPS lawyer that is somewhat dependent on the county you are in. But in one county we discussing that everything that a kinship foster parent says about the parent in an investigation is taken as fact by CPS. So they can bury the parent in accusations to make thei...

When your case closes can you decide where you live?

After your case closes, are you allowed to choose where you want to live? I mean what county and what house? This is assuming you aren't moving in with a drug dealer or something. And assuming the place alone wouldn't cause a new CPS case. Just choosing, like any other free adult in America, where t...

Re: Right to move out of county

Thanks FamilyMan. Doesn't the state have legal custody when the case is open? If you have your children living with you, then that's physical custody, right? The reason for moving would just be a personal and practical choice and not to evade a cps case. The move would happen regardless of the cps c...

I would get my own drug analysis performed ASAP from a reputable lab that you can use as evidence at the initial emergency custody hearing, if it goes that far. No you didn't have to sign any of the papers, and without action from a court, any agreement you do sign or did sign is voluntary. What ma...

Right to move out of county

What rights does a parent have to move out of the county where they have a CPS case? Are parents "hostages" to the county where they have a case? Or are they allowed to move if it's in their best interests, due to housing, job, etc?

Re: How to avoid false CPS investigations?

I've been waiting to see if anyone had suggestions. I avoided CPS because I home-schooled (most of the time) and also became informed. I did have CPS agents show up again but by then I was awake and aware and managed to head 'em off at the front door. Did the investigation go anywhere? What did you...
