From my limited understanding of the law here in Ca is that anything can be reopened with new "cause or evidence". So if they think they have something new, then yes

My children are grown and want to sue

If you do a search you will see that CPS screwed us bad a few years ago and I fought it and won. I actually got a worker fired and got professional supervised visitation for my abusive ex for several years. Problem is that once I sued in pro per and got overwhelmed and was taking time away from my k...

I dont know what state you are in, but check the statute of limitations for personal injury lawsuits and if you are still within the time, then file a civil rights lawsuit against the sw and whoever else was involved.

LOL! I tried that but unfortunately the librarian knew less about this stuff than I......... However, I have found evidence code 1043 (?) that says I can get complaints about a peace officer as listed in penal code (I forget the number off hand, but it has to do with people who are authorized to car...

I have been searching for this for a long time. I have found laws about police officer complaints, but not social workers (maybe their stuff is too confidential?) I live in California. I got this particular worker fired and began a lawsuit in state court, but now I am in federal court. I have reques...

Would anyone know how to get complaints that have been filed against particular cps workers? Even if the officer does not work there anymore? Or her employment records?

Thanks

frcp 12 (b) motion dismiss and frcp 15 amendment complaint

Procedural status and background: The defendent filed a motion to dismiss. I have filed an opposition, and she filed a reply. The court is to decide the motion on Monday March 19th without an oral hearing. I said in my complaint and my opposition that I knew my complaint was not drafted right (I did...

Are Custody Evaluators Corupt????

Our custody evaluator knew that our child was abused by his father on multiple occassions and that our child was scared to death of him and that I was not lying and that the father was lying (she testified under oath about all of this...... The case is continuing. I have not been able to find an attorney, so everything I have done has been by studying and trial and error. The first thing you need to do is to check the statutes of limitations and study case law concerning them. In my case I found out that because I was diagnosed with po...

You are in West Virginia? The first thing I was told to do by an attorney in California, was to file a claim with the county. You have a very short time to take any action in California. In California you only have 6 months from the time of the injury to file a claim with the county. Then you can st...

So a child would not have to "actually" go into a foster home for the cws workers to lose immunity....right? It is that the Social Worker and the department and the county lose immunity just because they recieve money for this program.... right?

I filed my lawsuit today! I hope to make some changes!

After my Social Worker stole evidence, lied in her report and lots of other bad things I was able to prove it and get her disiplined. She had to resign. But when she did she went crazy and got dangerous. Her co-workers had covered up for her, she was seeing a psyc and on meds. The police had to come...

Lawsuit to require Prescreen Mental Exams of Social Workers

My social worker was crazy (honest!) I filed a lawsuit against the county today. There is not much money involved, so attorneys won't help me with it, so I had to do this on my own. I am hoping some attorney somewhere will come help and trying to get one... but I am doing the best I can on my own. H...

My suit could help the USA children, but I need an attorney

I was in an abusive marriage with children for many years. Child Welfare Services ran me out with the kids. We went to a womens shelter and were given a different social worker. The worker falsified her report, stole evidence and many other things. I was able to prove what she did, get her out-a-the...

Or the social worker could be insane!

Our worker falsified her report, stole evidence and many other things. I was able to prove what she did, get her out-a-there and go on to make changes in my County CWS. I found out that she was a long term officer and had severe mental problems and CWS knew it and covered up for her (this is proved ...
