Re: FAQ/FACTS AND QUESTIONS

To KDus:

When we hired an attorney to represent the baby in our case, he was then designated by the court to be Guardian ad Litum. There was no need for a CPS-appointed GAL if we were willing to pay for the baby to have representation.

Re: Lost in a system!!

I hate to come here without something positive to say, but I seem to be the only one around and your question deserves an answer. I am not a lawyer and my understanding of the child protection laws comes mostly from my adopted daughter's case and this excellent forum. What I think I know of TPR laws...

Re: Grandparents never considered for placement

After termination of your daughter's parental rights, you are no longer a grandparent; so the court would have no reason the grant you kinship rights.

Re: It's more important than ever to have a strong relations

In my adaughter's case, her birthparents separated and began a custody war where both parents called on CPS to enforse a judgement that the other was unfit to ever have access to the baby. It got ugly and both parents soon found themselves deprived of their parental rights. And the baby, who never h...

Re: newcomer Need advice

If you have had your parental rights terminated and the children are being adopted by your relative(s), you may still have a relationship with them if you get yourself straight and sincerely and honestly make your case for continuing contact. I would have given my daughter's birthmother (my niece) a...

Re: Opinions Please--Is this NEGLECT?

Yes, your daughter made a serious error in judgment when she left three small children alone in a motel room, for any length of time. So many bad things could have happened. The kids could have been injured while rough-housing, scalded by hot water from the tap or the bathroom coffee pot, or just fr...

Re: Retaliation/Harrassment

I'm sorry but I just can't agree that your daughter's decision to leave three very young children alone in a motel room was appropriate or necessary given her situation. Anything could have happened to those kids, from minor injuries sustained during unsupervised horseplay to the very real possibili...

Re: cps and my family

Did you file an appeal of your TPR decision within 30 days? If yes, was a hearing held on your appeal? If you didn't file an appeal on time or it was rejected at hearing, then you have no legal recourse.

Re: CPS Nightmare

Our ICPC was approved when my niece told CPS that she, too, would be relocating to her hometown (in a state 1,000 miles away) to live with her mother while she awaited trial. Because reunification was the plan at that time, the baby had to be allowed to come here for supervised visitation and parent...

Re: Taken advantage of??

Eljay, At the top of this page, above the "Fight CPS" logo in its box, there are usually links to websites of related interest (don't know who sponsors them). Mine says "Ask A Lawyer Online Now" and "Present Your Case Free". In smaller type below them, off to the right ...

Re: newbie but not so new

Jojo2, Most kinship care/relative providers do not receive any foster care money; however, they will qualify for Temporary Aid to Needy Families (TANF) through the state AFDC office. Tell Granny to apply in the child's name and list only income received by the child (like a monthly child support pay...

I second the recommendation that you write to the adoptive parents, not their son. The previous post was right about TPR'd parents losing any and all rights to have contact. It's not like an adoption following a voluntary relinquishment where there might be varying degrees of "openness" that would a...

The Appeal Process

Hi, Royal. I just wanted to try and clear up what I've found to be a common misperception about the legal process. I've been through it in Family Court and federal criminal court and this is what I learned. When you appeal a decision or a conviction, the judge will rarely if ever allow any new testi...

I want to thank you both for adding a few pieces to my puzzle. At the risk of sounding like the most gullible person in the world, it never seemed like my niece was a bad or neglectful mother, although I knew the pregnancy was not planned and maybe not welcomed by the mother-to-be. She was a woman c...

Can Anyone Help Me Understand Why

I'm not really a newcomer here. I've been reading along for quite a long time and I just posted my second post to Grandpa Carl. That post made me wonder if anyone here can help me understand what happened to my family. My husband and I were always worried about our niece, a young woman we loved very...

As someone who had a kinship care placement (that turned into our adoption of my great-niece), I think I can answer some of your questions. About relative placements: there is a federal law that says CPS must seek out relatives who will be willing to act as foster parents, but they don't have to pla...

Your brother should check and see whether Montana has a Putative Father Registry where he can declare that he believes himself to be the father. Once declared, the ex-girlfriend will have to prove that he's not the father or get his consent if she wants to place the baby for adoption.
