NC court case

I am trying to locate a court case in which the judge ruled against placing the grandchild with the grandparents based on the idea that they did such a poor job raising their daughter. Why should they be given a chance to mess up their grandchild's life. All I know is that the grandparents appealed the decision and the ruling was over turned and they got their grandchild back. I was told that the case happened in North Carolina within the last couple years but I know how time runs here. So, I would say that the case occured in the last eight years. I live in Catawba county,NC and this particular case would be beneficial for several grandparents that are seeking custody of their grandchildren. In North Carolina, grandparents dont have rights according to the law and CPS just loves this. Iam sick and tired of seeing CPS/DSS trash GOOD PEOPLES ( GRANDPARENTS) reputations over this. Your help would be greatly appreciated!!!!!!!!!!

Well... I'm not so sure that *grandparents* don't have the right to custody/visitation, due to recent/proposed legislation: http://ncfamily.org/stories/110321s1.html

This is one of the links from that page... maybe you can find a reference to that case mentioned here:
http://ncfamily.org/PolicyPapers/Findings%200310-ParentalRts.pdf

However, your *grandchild* has the right to be placed with family. I don't know if this will help, but it's the federal gov't DHHS guide on CPS practices and should be the "guiding hand" for what they do. Maybe you can find something in here to help: http://www.childwelfare.gov/outofhome/types/kinship.cfm

Call this law office, or any NC lawyers... if it were that important of a case, then maybe a practicing atty can remember.
