70 YEAR-OLD GRANDMOTHER IMPRISONED INDEFINITELY FOR ASSERTING HER FIFTH AMENDMENT PRIVILEGE AGAINST SELF-INCRIMINATION

Orange County Superior Court – July 18, 2016

Seventy year old Los Angeles resident and grandmother, Pauline Hunter, was imprisoned indefinitely today for simply asserting her Fifth Amendment privilege against self-incrimination. Ms. Hunter has no criminal record and was given physical custody of her two (2) minor grandchildren in the spring of 2014 by a dependency court. Thereafter, Hunter’s grandchildren sued Orange County Social Services Agency alleging horrific acts of physical, sexual and emotional abuse while in the care of the Agency’s social workers.

After becoming aware of the lawsuit, the embattled Orange County District Attorney’s Office filed felony kidnapping charges against Hunter claiming the Agency still had custody of the Children. Court orders directly contradict the District Attorney’s claim and show Hunter was given physical custody. The Children’s attorney, Chandler A. Parker, reports that Hunter’s grandchildren are safe and are not missing. Mr. Parker speculates that Orange County brought the criminal case against Ms. Hunter in retaliation for the Children’s lawsuit. Parker says “The DA should be ashamed. Everyone knows this is about the Children’s lawsuit and not their grandmother. She has done nothing wrong.”

Before Hunter was arraigned on the kidnapping charges, Judge Richard J. Oberholzer ordered Hunter to deliver the Children to the Social Services Agency. Hunter refused because the act itself of delivering the Children would be an implicit admission of guilt to the kidnapping charges in violation of her Fifth Amendment Privilege. Additionally, Hunter’s grandchildren were suing the Social Services Agency for having been abused while in its custody. Therefore, it would be an inherent conflict of interest for the Agency to be awarded custody over the same Children it negligently permitted to be abused.

Despite Hunter’s constitutional objections, Judge Richard J. Oberholzer remanded Hunter into the custody of the Orange County Sheriff’s Department. Hunter will be imprisoned indefinitely unless she surrenders her grandchildren. How Hunter is expected to do anything while imprisoned is anyone’s guess. Hunter’s Attorney, Margarette M. Mow, says she intends to file a Habeas Corpus Petition because Hunter is being illegally restrained in violation of the United States Constitution. Ms. Mow says her client is “completely innocent of the charges and should be released immediately.”

I'm onboard for a lawsuit against CPS. They are too quick to remove children from their parents. Parents when they win their case move on and forget about it because they are happy to get their kids back. Meanwhile children are left mentally traumatized and suffer abuse while in CPS care. CPS needs to start being accountable for their actions when they lie on their reports. They need to be prosecuted for perjury and when a child is hurt in their care they need to be prosecuted. Maybe then they will start checking the foster care homes better, or at least make sure that removal of children from their home is their best option. My 10 month old grand baby had a bruise on his cheek our last visit, the case worker treated it as no big deal. If that happens to a Parent it is classified as abuse. Anyone can make an accusation true or false. If a parent doesn't cooperate then they are considered guilty until proving innocence. I have known of caseworkers that are single with no children which have no clue about what it takes to raise children, yet they determine what is in a child's best interest. The children are our future, we need to stand up and fight to protect their rights. The government and it's assigned agencies must be held accountable.
