Do you have consent from either parent ?
Have an established relationship ?
Have the child ever stayed with you for an extended time period ?
Have the parents been terminated rights ?
Are the parents incarcerated for a long time ?
Is the child in foster care ?
These are just some of the questions and factors I know exist .
What state are you in as well . Look up grandparents rights in your state .
You also can look up an attorney in your area for a free consultation . So you can get a better understanding .
The answer is No you don't need an attorney if you can learn the laws in your state , not be afraid to address questions and assert yourself in court on the record .
