BEING RAILROADED

I AM IN THE MIDDLE OF AN ACS CASE WITH MY TWO SONS AGES 15 AND 11....MY TEENAGER IS A TROUBLED CHILD THAT I HAVE PUT IN THE HOSPITAL HAD HIM EVALUATED MANY TIMES...HE SEES A COUNSELOR A PSHYCHATRIST HAS A CASE WORKER THAT CHECKS ON HIM REGULARLY...BUT HE CONTINUES TO SMOKE WEED AND CUT SCHOOL ...BUT I AM EXHAUSTING ALL MY MEANS TO HELP HIM AND HAVE BEEN WAY BEFORE ACS CAME INTO MY LIFE...MY YOUNGER SON IS DOING WELL IN SCHOOL IS IN ACTIVITIES..AND IS A HAPPY CHILD....
THEY SHOWED UPO AT MY HOUSE WITH CRAZY ALLIGATIONS THAT ARE VERY FAR FROM THE TRUTH AND I OBVIOUSLY HAVE PROOF OF IT......
NOW MY SON AND I WERE DRUG TESTES WITH ACS DRUG PROGRAM MY SON CAME UP WITH A LEVEL 72 BUT I HAVE ALREADY SET UP AN INTAKE AT A DRUG PROGRAM FOR HIM...I CAME UP A LEVEL 8...I HAD SMOKED ONE OR TWO TIMES WITH MAJOR ANXIETY ATTACKS OVER MY SON AND MY MOTHER ALMOST DIEING ON ME ...I THEN OFFERED THEM ANOTHER URINE TEST TO PROVE I AM NOT SMOKING, I AM ON ANTI ANXIETY MEDICTAION.
NOW THE DRUG PROGRAM IS RECOMMENDING A 90 PROGRAM WITH THEM AND I HONESTLY DONT FEEL IT IS NECESSARY , THEY CLAIM AT THIS POINT IT IS MY CHOICE TO REFUSE IT ..MY CASE IS STILL UNDER INVESTIGATION.WHAT DO I DO?
BETWEEN COUNSELING, PSHYCHATRIST AND A FULL TIME JOB PLUS ANOTHER CHILD I AM TRYING TO KEEP BALANCED IT SEEMS LIKE ALL THEY ARE DOING IS ASKING ME TO ADD MORE TO MY PLATE AND TAKE FOCUS OFF OF MY CHILDREN ...DO I HAVE A RIGHT TO REFUSE THEM FOR THIS PROGRAM IM SO CONFUSED AND AM STARTING TO FEEL LIKE IM GETTING railroaded
PLEASE HELP ME

Make a list of the consequences that will befall you if you do their plan that you can take to the meeting. If it includes unemployment and neglect of your kids, then ask them to help make adjustments until you find something that works. You are supposed to be a part of the development of the service plan.

do we have an idea of what can happen if i refuse the program they are talking about. especially if my next test comes up clean ..so far the worker is stating that the 90 days is the drug counslors assesment ....should i just wait to see what there final report states. The worker has stated to me that there is really nothing they can tell me to do for my children that i am not already doing and was doing well before they got involved in my life. I feel very vulnerable right now

You can take the perspective that you are willing to do what the judge says you should do. Especially if you are doing all that you possibly can, according to CPS. If you don't agree with their plan, then state that you're willing to let the judge decide. The judge/court is there to be the judge of what your family really needs. If you don't agree with the CPS plan, then you should let the judge know that. Keep in mind that CPS is motivated by money to make you do these things -- classes, therapy, treatment, etc. -- so if it's not warranted, you should hold out and let the judge decide. Don't, however, let them delay/drag this out for months because they will present a story to the judge that you have been refusing for MONTHS to comply with their wishes, when, in reality, you simply disagree with their plan. If they are insisting on it now, call your attorney and tell him that you want this heard in court NOW so that if it is necessary, you can make arrangements ASAP.

Yeah they told me you dont have to comply with the "services" they are offering, but if you dont they can take your children.What kind of option is that? More like blackmail if you ask me. And what makes them think that taking a drug test is some kind of service to me? Dont agree to anything or sign anything unless the judge has court ordered you to do it. And dont forget that using drugs does not constitute neglect. Only if the drugs are used around the children or if you are using your resources for food or other things to buy drugs instead.

At the end you state it doesn't constitute neglect, but is there anything in a rcw or something to back it up? I too am being railroaded, and I had a positive (or 2 depending on which one you talk too) that came up in a case that was unfounded. Now they claim I am starving my children, and failing to take them to doctor's appts. however, the specialists I had scheduled, they are being taken to. Seems they have decided to change their doctors. Anyway, all they are focusing on is the past UA. Now mind you, the dad now has my son, and he and his 3 room mates are all alcoholics and my son sleeps on the couch. His sucks up to the workers so they are easy with him. Me... well when we left the 30 day care conference my lawyer told me I could get a new sw by going to drug court. Nice huh
