Family Based Services

I've read through this site and I've never seen anything about Family Based Services. I'm in Texas, not sure if it's only here or what. I had two different investigations. From what I understood they were both closed and ruled out. After reading posts off this site I got my papers out and re-read them. They say medical neglect and physical abuse---unable to determine. So that means it's on my record? My son is allergic to mosquito bites and has been to the doctor and is on steroids for it during the summer. He swells ups with bumps. His school is a government based school so they took pictures of his bumps. Cps showed me the pictures and I confirmed they were mosquito bites. How can they say medical neglect when he's on medicaid and he has never missed a texas health steps check up? The doctor's office knows us by name because he is allergic to mosquito bites and dairy products we were always at the doctor.
Back to the topic.... my caseworker said I'm closing your case and referring you to a family based service worker who is going to offer you any community help you need. This workers business card says cps specialist III. She came in and made me send my kids to live with my mom and forced me to take classes. Who is she to do that? If my kids were so much "at risk", why didn't the investigator take my kids during the two investigations over 5 months instead of closing my case?

Generally speaking, the child abuse register on which you may have been named, is held at a state's capitol. I would suggest that you call and/or write Austin to determine if you have indeed been indicated for child abuse/neglect -and if you have been-research the method to appeal that determination.

CPS does not follow any reason; they do what they do because they can.

Do you have an attorney? In my opinion, you will need one to get CPS out of your life.

It is good that you have your doctor behind you. Talk to the doctor and get whatever records you can that concern your child to help you fight CPS.

GOOD NEWS!

I sent a complaint to the consumer of affairs about a week ago today. The next day I got an email saying my case was being reviewed and today I got a phone call from my caseworker's supervisor's supervisor. She advised me I am right and my case shouldn't have been going on this long. She is going to talk to my caseworker and tell her to close the case or update my services. Which, knowing my caseworker, she'll give me more services. At least now maybe they'll see I'm not a dumb young mother and I know what I'm doing. I'm not playing a game when it comes to my kids. She seemed very upset with my caseworker. She actually told me what was in my family service plan is wrong. Hopefully this is going in the right direction now. I'm scared to trust any of it since she too is part of cps but this is the first time someone has sided with me. Please pray this works out in my favor! :D

I've called my case worker everyday for over a week and left voicemails. I get a text message from her today that says she's skiing in colorado and to call her supervisor. I called the supervisor and left her a hateful message. I decided to call her supervisor's supervisor again and can't get a return call from her either. That's real sad to know they're out skiing and enjoying their family for Christmas when so many people are spending their Christmas without their kids because of them. They have money for vacations like that because they get paid to take kids away from loving homes. Pathetic!

You need an attorney. CPS will not respond, will not do anything until you have private legal counsel. Are there any legal clinics in your area?

CPS is not your friend, they are your foe. No matter what you do, it will not be enough, nor wil lit work unless you level the playing field and retain able legal counsel.

I got a call from my family based services case worker today and she said I'm getting a new case worker and just hang tight unitl she comes in and asseses me and my kids. I'm going to let her in to do the assesment then if she says i have to take more classes or anything else beside that she's closing my case I'm going to tell her I want to go to court and I'll have to get a lawyer. I don't have money for one and the one here that does services for leagal aide is my ex brother n law's unlce. I couldn't even use him for my divorce. They said it's a conflict of intrest. I was sent to a town an hour away to get another one and they stopped answering my calls.

Do you live in or near any major city? Most major cities have legal clinics and/or law schools that may have clinics.

Just tell me your closest major city and I will see if I can find anything.

I guess the closest ones would be Abilene, Tx or San Angelo, Tx. Thank you so much for your help.
