I totally agree that a bad lawyer is worse than no lawyer. My son had a court appointed lawyer, and a caseworker that hated him and he lost his children. He did everything that DHs ask him to do but I will never get to see my grandbabies again and it is tearing me apart

Blue- Check your state statutes for Grandparent Visitation laws. Normally, I am against such legislation as it relates to fit parents fighting disgruntled grandparents--However, when it comes to a grandparent fighting the state, I am behind the grandparents 100 percent.

Many states' statutues allow for grandparent visitation post adoption. Please look into this. To you and your son, stay strong.

I am looking for any advice about "step-parent" rights in Oregon. My son is in the middle of a divorce (nearly over actually) the courts are giving him full custody of his biological 2 year old son and his 4 year old "step-daughter". He has been with the biological mother since the child was 4 monthes old. No biological father of record. He is the child's dad. Due to drug use on the mother's part, she is currently serving a 15 month sentence. DHS is involved, however no matter what steps my son takes to prove his stability as a parent, they are hell bent on placing the "step-child" in foster care and placing the biological child with my son. This has been going on and on. There are so many attorneys involved, as a tax payer I am appaulled! No body has done anything in the best interest of these children! Can anyone give me any advice on "step-parent" rights in Oregon?

We are preparing a Declaration of Facts to present to the courts next week. The attorneys should be doing this, but you know they have other concerns, like ensuring that they continue to get referrals from DHS! Seriously, does nobody see the severe abuse of power here? It's the craziest thing I have ever seen.

Any help/advice would be greatly appreciated!

I'm not familiar with Oregon law. In CA where I live there's a de-facto parent law.

Hello, am a mother of two beautiful girls. In 2006, CPS took my daughter away from me. I took it upon myself to voluntarily do everything in the "case plan" before it was court order. After 8 months, when we finally got a hearing to sign the case plan, it was dismissed due to me having already completed everything.

I was recently on probation for driving on a suspended license. During my last visit to probation I was drug tested, which I failed for a pain medication known as roxycotine. I was placed under arrest and sent to jail for ten days. At the court hearing I admitted guilty and they dismissed my probation giving me time served. Meanwhile, my probation officer called CPS. The case worker never made any attempt to contact me yet when to my mothers, spoke with my two year old daughter and took pictures of her. I have been home from jail for two days and have yet to be able to speak with this case worker. She called my mother today and told her that my daughter cannot stay with me and is suppose to be calling me. I have called her office several times with no answer. I am now assuming she is on her way to come to my home and possibly remove my child.

I have and will continue to do whatever it takes to prevent this! I have an appointment with an outpatient drug treatment center scheduled for this Tuesday. In the meantime, what should I do?

Here are a few suggestions...

1. Keep notes... see Case Notebook.

2. Don't call the caseworker anymore. If she forgot you or something more important came up, would you want to keep reminding her to come check you out?

3. If she does come to your home you don't need to invite her inside. You know about the Fourth Amendment, right?

4. Don't sign a safety plan without an attorney's advice. If you sign you're admitting guilt.

5. If you're taken to court, don't sign a guilty plea. It is usually better to request a full trial and make the social worker prove her case.

6. Don't ever admit any type of guilt. Anything you say can be twisted and used against you. If you tell her you're going to counseling, for example, she'll twist that and make it evidence that you need to be court ordered into counseling... even if you were voluntarily going already.

7. The less you say to social workers, the better.

8. The best thing you could say to a social worker is "My attorney told me not to discuss this without him being present. Would you like to meet in his office?" Having an attorney already is the #1 best way to prevent a fledgling CPS case from growing larger and more complicated.

I need help with some things as well. I am going through something with DCFS right now. They are trying to force the child back into our home when all he does is beat up on the youngest child in the house and he also beats up on people in the house as well. I have been threatened with being put in jail if I do not do what they tell me to do. I have went through so much money and it seems like there is no end in sight. First they tell me that I have no choice in the matter and that I have to take him back into the home then they tell me that if I do not bring him back into the home then I will be sent to jail. It has been an ongoing battle with DCFS/CPS for 8 years now. I am at a loss of words and I do not feel that I should have to bow down to them anymore. Our tax paying dollars go to this sorry bunch and all they want to do is steal your children, give them to foster care because foster care people do bow down to DCFS. They are double dipping into our pockets and are also trying to FORCE me to pay child support. This is how we are torn down is through this department. This is how our socialist government destroys families and our family life as we know it.

I just recently had my two children taken from my home from cps, I didnt know my rights and I stupidly signed their papers, before searching all this stuff. what can I/ should I do now to get my kids back.

Start a new topic in the "CPS Investigations" forum and tell us what is going on... nothing too specific (no names or cities, maybe change ages a wee bit to ensure CPS isn't spying and ramping up their lies). Provide your state, what really happened, what they are alleging, etc. In order to help you "play your cards" well, we need to know what is in their hands as well as what you've got.

Please pray for us cps in texarkana ar illegally took our 3 children 2 years ago stateing enviornmental neglect because i had my electric shut off even though the children where at there grandmothers across the street during that time.they have recently taken my 2 month old after leaving her n our care for over a month in a half we have done everything they asked and been in a stable house with all utilities on for 9 months there was no allegation on physical or emotional abuse on or three boys we are trying to get out of fostercare or our newborn Kimber Rios They have put my 7 year old on narcotis and had him on them for a year when he has no mental illness please pray for him there names our Heath Durham Princeton Durham and Jonathon Durham and Kimber Rios

Prayer is great and all, but what you REALLY need is information, education, and knowledge on how to fight on CPS turf to get your kids back. CPS people are not usually moved by the will of God, but by court motions and judges. If you want to fight them, start your own thread and we will point you in the direction you need to go. Electricity is not necessary to be a good parent.

Hello Everyone;

I would very much like to introduce myself. My name is Sharon and I am fairly new to this site. Unfortunately I recently got involved with DEFCS in Statesboro Georgia regards to my 2 granddaughters who I have recently gained custody of. My family and I live overseas and were blessed to have been able to go back to America to re gain our Custody and get them out of the nasty system over there! Unfortunately, one of the Social Workers apparently is taking revenge on the fact that not only did we manage to get the both girls out of the system; also the fact that we left and took them out of America. My husband was nice enough to skype with her along with the 2 girls. She went ahead and told our attorney that there was no disciplinary as well as supervision. Luckily, a friend who also happens to be a Child Educational Psychologist was in our home at the time my husband was skyping with this woman and had mentioned to me after I had mentioned to my friend of what went on that every word that was coming from this vengeful social worker is nothing but False Accusations!
