How, & what does a parent file when CPS took longer than the 72 hrs to file the initial petition and has already taken temporary custody of my newborn from hospital! ?

The 72 hours sounds like a state social services regulation. I'd copy the law and take it to my lawyer, if the case isn't settled yet.
You could file for a state administrative hearing (call the state; don't bother telling your caseworker) but that would take months to settle and by that time the juvenile court would already have made a ruling.
